AN ORDINANCE
AMENDING ORDINANCE NO. G46-16 AND CHAPTER 10.46 OF THE ELGIN
MUNICIPAL CODE, 1976, AS AMENDED, TITLED "PUBLIC
NUISANCE-FREE ZONES"
WHEREAS,on December 21,2016,the City Council ofthe City of Elgin adopted Ordinance
No. G46-16,which provided in part for a new Chapter 10.46 of the Elgin Municipal Code, 1976,as
amended relating to the Public Nuisance-Free Zones; and
WHEREAS,Section 2 of Ordinance No.G46-16 provided for a sunset provision whereby the
provisions of the new Chapter 10.46 regarding Public Nuisance-Free Zones would automatically
expire on December 31,2018,and for a report to the City Council prior to such date as to whether an
ordinance providing for the continuation of the Public Nuisance-Free Zones should be adopted;and
WHEREAS,the City Council has received a report from staff regarding the continuation of
Public Nuisance-Free Zones and has determined that it is appropriate to continue with such Public
Nuisance-Free Zones regulations.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That Section 2 of Ordinance No. G46-16 be and is hereby repealed,it being
the intent of the City Council of the City of Elgin that Chapter 10.46 of the Elgin Municipal Code,
1976, as amended, entitled "Public Nuisance-Free Zones" shall remain in full force and effect.
Section 2. That Section 10.46.010 of the Elgin Municipal Code, 1976, as amended,
entitled "Definitions:" be and is hereby further amended by amending the definition of"Nuisance
Activities" provided for therein by amending Subparagraph I thereof to read as follows:
"I. INTENTIONALLY OMITTED."
Section 3. That all ordinances or parts of ordinance in conflict with the provisions of this
ordinance be and are hereby repealed to the extent of any such conflict.
Section 4. That this ordinance shall be in full force and effect after its passage and
publication in the manner provided by law.
