G68-18 Ordinance No. G68-18 AN ORDINANCE AMENDING TITLE 3 OF THE ELGIN MUNICIPAL CODE, 1976, AS AMENDED, ENTITLED "BOARDS AND COMMISSIONS" WHEREAS, the City of Elgin is a home rule unit pursuant to the Illinois Constitution; and WHEREAS, the City of Elgin as a home rule unit may exercise any power and perform any function pertaining to its government and affairs; and WHEREAS, the City Council has determined that it is desirable to amend certain provisions with respect to various city boards and commissions including provisions relating to term limits, membership and student representation on various city boards and commissions; and WHEREAS, regulations relating to various city boards and commissions, including, but not limited to, limitation on terms, membership and student representatives pertain to the government and affairs of the city. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Section 3.03.050 of the Elgin Municipal Code, 1976, as amended, entitled "Limitation on Terms:" be and is hereby further amended to read as follows: "Members of any city board,commission or committee shall be limited to a maximum term of six(6)years as a member of the same board,commission or committee and an additional six(6)years as chairman of the same board, commission or committee. For the purpose of determining the length of service an unexpired term shall not be included in making such determination. Such limitation shall not apply to a member who continues to serve until their successor has been duly appointed and qualified pursuant to Section 3.03.040. Such limitation shall also not apply to ex officio members of boards, commissions or committees,city officials, officers or employees who are members of boards,commissions or committees or to members of the board of health, building commission, board of stationary engineers and the property maintenance board of appeals. Such limitation shall also not apply to members of any city board, commission or committee when the city council determines in its discretion that the appointment of a member is necessary for specific professional or technical training or knowledge or for the practical experience or knowledge of the member in question." Section 2. That Chapter 3.03 of the Elgin Municipal Code, 1976, as amended, entitled "Meetings; General Provisions" be and is hereby further amended by adding a new Section 3.03.120 thereto entitled "Student Representatives:" to read as follows: "3.03.120: STUDENT REPRESENTATIVES: The position of a student representative is hereby created on the following city boards and commissions: Cultural Arts Commission; Human Relations Commission; Parks and Recreation Board; and Sustainability Commission. The student representative position shall be a non-voting ex officio member of such boards and commissions and not be counted in determining the number of members or a quorum on such boards and commissions. A student representative shall be an Elgin resident and enrolled in high school as a sophomore, junior or senior in the year they will be serving as such student representative. The student representatives shall be appointed by the city council. The terms of the student representatives shall be for one year from September 1, of the year of appointment,to the following August 31." Section 3. That Chapter 3.24 of the Elgin Municipal Code, 1976, as amended, entitled "Elgin Image Advisory Commission" be and is hereby repealed. Section 4. That, effective December 31, 2018, Chapter 3.85 of the Elgin Municipal Code, 1976, as amended, entitled "Bicycle and Pedestrian Advisory Committee" be and is hereby repealed. Section 5. That Section 3.87.020 of the Elgin Municipal Code, 1976, as amended, entitled "Members:" be and is hereby further amended to read as follows: "The sustainability commission shall be composed of nine(9)members to be appointed by the city council. The terms of the members of the sustainability commission shall be for three (3) years. Appointments shall expire on June 1 in the anniversary year of the appointment of the member." Section 6. That all ordinances or parts of ordinance in conflict with the provisions of this ordinance be and are hereby repealed to the extent of any such conflict. Section 7. That this ordinance shall be in full force and effect upon its passage and publication in the manner provided by law. e / /I .
