G32-18 Ordinance No. G32-18 AN ORDINANCE GRANTING A CONDITIONAL USE TO ESTABLISH A COMMERCIAL EVENT SPACE INVOLVING VARIOUS ASSEMBLIES OF PEOPLE IN THE CCI CENTER CITY DISTRICT (216 Prairie Street) WHEREAS, written application has been made requesting conditional use approval to establish a commercial event space for activities pertaining to assembly of people at 216 Prairie Street; and WHEREAS, the zoning lot with the building containing the premises at 216 Prairie Street is legally described herein (the "Subject Property"); and WHEREAS, the Subject Property is located within the CC 1 Center City District and a commercial event space for activities pertaining to assembly of people is listed as a conditional use within the CC 1 Center City District; and WHEREAS,the Planning and Zoning Commission conducted a public hearing concerning said application on May 7, 2018 following due notice including by publication; and WHEREAS, the Community Development Department and the Planning and Zoning Commission have submitted their Findings of Fact concerning said application; and WHEREAS, the Community Development Department and the Planning and Zoning Commission recommend approval of said application, subject to the conditions articulated below; and WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings and recommendations of the Community Development Department and the Planning and Zoning Commission; and WHEREAS,the City of Elgin is a home rule unit and as a home rule unit may exercise any power and perform any function pertaining to its government and affairs; and WHEREAS,zoning, including,but not limited to,this ordinance granting a conditional use in the CC 1 Center City District pertains to the government and affairs of the city. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the City Council of the City of Elgin hereby adopts the Findings of Fact, dated May 7, 2018, and the recommendations made by the Community Development Department and the Planning and Zoning Commission, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. Section 2. That a conditional use for a commercial event space for activities pertaining to assembly of people is hereby granted for the property commonly known as 216 Prairie Street, and commonly identified by Kane County Property Identification Number (PIN) 06-13-309-008, and legally described as follows: The East 2 feet 6 1/2 inches of Lot 11 and the West 49 '/2 feet of Lot 12 in Block 13 in the Original Town of Elgin on the East side of the Fox River,in the City of Elgin,Kane County, Illinois. (commonly known as 216 Prairie Street) Section 3. That the conditional use for the Subject Property as authorized by this ordinance shall be subject to the following additional conditions: 1. Substantial conformance to the Development Application submitted by Mark and Aimee Novelli,as applicants,and THKFL, Inc.,as property owner, received March 22, 2018, and supporting documents including: a. Undated 216 Prairie Street Conditional Use Application Response to Comments 1- 10 letter, received April 16, 2018; b. Statement of Propose and Conformance letter, prepared by Mark Novelli, dated March 14, 2018, received April 16, 2018; c. Plat of Survey, prepared by Luco Construction Co., dated January 30, 2012; and d. Undated four-page Floor Plans,prepared by Imago Creative Studios,received April 16, 2018. In the event of any conflict between such documents and the terms of this ordinance or other applicable city ordinances, the terms of this ordinance or other applicable city ordinances shall supersede and control. 2. A food handling/food establishment permit is not required if food is not prepared on site, and if dishes, utensils and other food contact equipment are not washed, or sanitized onsite. Food must be catered by a licensed caterer, and all soiled food contact equipment must be washed, rinsed and sanitized at a licensed commercial facility. 3. Assembly uses permitted by this grant of conditional use shall include: a. Art Classes; b. Business Meetings, Business Dinners, Breakout Session, and/or Round-Table Discussions; c. Banquets (General); d. Baby Showers and/or Bridal Showers; e. Baptisms and/or Christenings; f. Celebrations, Soirees, and Private Parties, such as Anniversaries, Birthdays, Bar Mitzvahs and Bat Mitzvahs, and/or Quinceaneras; g. Conferences, Conventions, and/or Seminars; 2 h. Colloquiums; i. Consumer Shows, Trade Shows, Trunk Shows, and Fashion Shows; j. Cooking Competitions; k. Corporate and/or Non-profit Events; 1. Design and Creative Workshops, such as Calligraphy, Art, Pottery,and/or Painting Classes; m. Exhibitions, including but not limited to Art Shows; n. Expositions; o. Fairs and/or Festivals; p. Mind and Body Classes and Sessions, including but not limited to Mediation and/or Yoga; x. Networking Events; y. Plenary or General Sessions; z. Political Events; aa. Press Conferences; bb. Incidental entertainment as an accessory use to a permitted principal use is permissible, in so long as said entertainment complies with all city codes and ordinances, including but not limited to the restrictions upon "uses, accessory" as articulated within Section 19.90.015, "Definitions and Regulations" of the Elgin Municipal Code, 1976 as amended, and as said section may be amended from time to time. 5. Any event of an above assembly use may be catered, with food preparation and service provided either by the applicant or from an off-site establishment, subject to compliance with applicable health and sanitation codes, ordinances, rules, and regulations. Similarly, any event of an above assembly use may include the incidental 3 service of alcohol, with such service provided either by the applicant or from an off- site establishment, subject to compliance with applicable health, sanitation, and liquor codes, ordinances, rules and regulations. 6. Any event of an above assembly use may include the incidental playing of amplified live or recorded music, subject to compliance with applicable noise codes, ordinances, rules and regulations. The incidental playing of amplified live or recorded music is only permitted on the interior of the commercial event space. The applicant must comply with Chapter 10.30 "Noise" of the Elgin Municipal Code, 1976 as amended. 7. All street graphics must comply with the zoning ordinance requirements. 8. The hours of operation for the commercial event space shall be: Friday 4:00 pm— 12:00 am,Saturdays 9:00 am- 12:00 am,Sunday 9:00 am— 10:00 pm,and Monday-Thursday 5:00 pm - 10:00 pm. 9. The applicant must have at least one staff member present at all events. 10. The day after an event, the applicant shall remove any litter from the property and Prairie Street, from Grove Avenue to Dawson Drive, even if not originated by event attendees. 11. The applicant must install the necessary building upgrades to meet the building, fire, and life-safety codes within six months from the adoption of this ordinance granting the conditional use approval. 12. Draft Ordinance BACKGROUND Mark and Aimee Novelli, as applicants, and THKFL, Inc., as property owner, are requesting a conditional use to establish a commercial event space for activities pertaining to assembly of people at the property commonly referred to as 216 Prairie Street. The property is zoned CC 1 Center City District. The 6,800-square foot property is located on the south end of downtown Elgin and is improved with a one-story 6,500-square foot commercial building. The building is located across the street from River Park Place townhome development and is adjacent to the city-owned surface parking lot to the east with 54 parking spaces. A service alley in rear separates the building from the Fulton Street parking garage to the north. The existing building is occupied by the Imago Creative Studios' offices, a media services and graphic design company. The building was constructed in the 1920s and features exposed brick and exposed barrel ceiling. The front of the building is a gallery space, while the rear is set up as an open space warehouse. Imago staff offices, a conference room, and several storage rooms are located near the center of the building. Proposal Imago is now requesting conditional use approval to rent the facility for various types of events, including but not limited to weddings,live performances(musical, dance,dramatic,and readings), birthday parties, art/gallery exhibits, fundraisers, and various other social events. The building layout allows for various configurations based on the type of event. Interested clients would be able to rent the front gallery space, the rear warehouse space, or the entire building. Access to the private offices and storage rooms would not be permitted during the events, but attendees would have access to the kitchen and all restrooms. The proposed hours of operation for the commercial events are 4:00 pm — 12:00 am Friday, 9:00 am — 12:00 am Saturday and Sunday, and other occasional weekdays from 5:00 pm — 10:00 pm. One staff member would be presented during all events. The applicant is aware a liquor license(Class S liquor license,the same type of license held by the Haight facility) is required prior to service of any alcohol at the facility. The zoning ordinance does not require off-street parking for any land use within the CC1 district. On-street parking is provided on both sides of Prairie Street between S. Grove Avenue and Villa Street. In addition,employees and attendees of the events will have access to all 54 parking spaces in the adjacent city-owned surface parking lot, as well as the Fulton Street parking garage with a total of 452 parking spaces. - 4 - Recommendation & Findings of Fact Petition 10-18 - May 7 2018 The proposed commercial event space for activities pertaining to assembly of people is listed as a conditional use in the CC1 Center City District, requiring the review and recommendation by the Planning and Zoning Commission and approval by the City Council. The Community Development Department offers the following additional information: A. Property History. The subject property has been part of the City of Elgin since its incorporation. The property was originally classified as E Commercial District by the first zoning ordinance in 1927. In 1962, the property was rezoned to B3 Service Business District. In 1992, the property was rezoned to CC1 Center City District as part of the comprehensive amendment to the zoning ordinance. The existing building was constructed in the 1920s. Imago Creative Studios, a media services and graphic design company, opened in 2014. B. Surrounding Land Use and Zoning. The properties to the north, east, and west are zoned CC1 Center City District. The property to the west is improved with a one-story commercial building that is currently vacant. The properties to the north and east are owned by the City of Elgin and are improved with public parking facilities; Fulton Street parking garage to the north, and a surface parking lot to the east. The property to the south is zoned PCC Planed Center City District and is improved with River Park Place townhome development. C. Comprehensive Plan. The subject property is designated as "Community Mixed-Use Center"by the City's 2005 Comprehensive Plan. Community Mixed-Use Centers provide focus, identity, and convenient goods and services, as well as some employment, for a number of surrounding neighborhoods, in a larger trade area. The ideal community mixed- use center should be between 30-100 acres of commercial, office entertainment, medium density residential, and institutional uses accessed by arterial streets and transit service. The center would have parcels and buildings scaled to pedestrians, small enough to encourage parking once and walking to more than one destination. Off-street parking is hard and on-street parking helps to contribute to the intimate scale of well-functioning pedestrian environments. Parking located between and behind buildings permits people to walk more safely and comfortably between uses that front sidewalks rather than large parking lots. Seating and shade along pedestrian routes promotes walking and informal gathering. Downtown Elgin functions as a unique community mixed-use center within the planning area. It is the historic and traditional heart of the community. Recommended land uses include a compatible mix of residential (30 + du/ac), employment, educational, civic, and office uses, combined with a cultural and entertainment center focus that extends activities throughout the day. Pedestrian, bicycle, transit and vehicular circulation systems are - 5 - Recommendation & Findings of Fact Petition 10-18 May 7, 2018 coordinated and efficient. Streets and places are designed to encourage pedestrian activity. Buildings and structures of historic or architectural value are maintained in active service, where feasible. D. Zoning District. The purpose and intent of the CC1 Center City District is to facilitate the implementation of the official comprehensive plan for the city center, as focused on a distinctive subarea of the city with a common urban fabric. The CC1 zoning district provides for a concentration of finance, service, retail, civic, office, and cultural uses in addition to complementary uses such as hotels, entertainment and housing. The development standards are intended to encourage a mix of activity in the area while providing for quality development that maintains a sense of history, human scale and pedestrian-oriented character. E. Trend of Development. The subject property is located within the traditional downtown area that has historically been developed with a mix of commercial, retail, service, restaurants,residential, and institutional uses. The property is located across the street from the River Park Place townhome development completed in 2005. Most recent new developments and businesses in the downtown area have established near the Festival Park and Riverside Drive Promenade, such as several restaurants along S. Grove Avenue and the Elgin Art Space Lofts building at 51 S. Spring Street. The City encourages downtown development that will foster a vibrant, walkable, mixed-use center for the community, as well as a regional center with an urban fabric unique to the Chicago metropolitan region. FINDINGS After due notice as required by law, the Planning & Zoning Commission conducted a public hearing in consideration of Petition 10-18 on May 7, 2018. Testimony was presented at the public hearing in support of the application. The Community Development Department submitted a Conditional Use and Written Findings &Recommendation to the Planning&Zoning Commission dated May 7, 2018. The Community Development Department and the Planning & Zoning Commission have made the following findings regarding this application against the standards for conditional uses outlined within § 19.65.030: STANDARDS FOR CONDITIONAL USE A. Site Characteristics Standard. The suitability of the subject property for the intended conditional use with respect to its size, shape, significant features including topography, watercourses, vegetation, and existing improvements. - 6 - Recommendation & Findings of Fact Petition 10-18 May 7, 2018 Findings. The subject property is suitable for the intended conditional use with respect to its size, shape, significant features including topography, watercourses, vegetation, and existing improvements. The proposed use would occupy the existing one-story approximately 6,552-square foot commercial building currently home to a media services and graphic design company. The existing building includes two open space areas, one in the front (gallery space) and the second in the rear (warehouse space) both of which are well suited to host commercial events. However, no more than one commercial event would be held at any one time. The building is located adjacent to a public parking lot and a public parking garage. The applicant is not proposing to make any exterior changes to the building or the site. The proposed commercial events will be restricted to the interior of the existing building,which can adequately serve the. proposed use. There are no significant features including topography, watercourses, or vegetation that will have a negative impact on the proposed use. B. Sewer and Water Standard. The suitability of the subject property for the intended conditional use with respect to the availability of adequate water, sanitary treatment, and storm water control facilities. Findings. The subject property is suitable for the intended conditional use with respect to the availability of adequate water, sanitary treatment, and storm water control facilities. The property and the subject commercial space are currently served by municipal water, sanitary sewer, and storm water systems. The applicant is not proposing any changes to the existing sewer and water utilities. The existing facilities can adequately serve the proposed use. C. Traffic and Parking Standard. The suitability of the subject property for the intended conditional use with respect to the provision of safe and efficient on-site and off-site vehicular circulation designed to minimize traffic congestion. Findings. The subject property is suitable for the intended conditional use with respect to the provision of safe and efficient on-site and off-site vehicular circulation designed to minimize traffic congestion. The existing 6,552-square foot building covers the entire property with no on-site parking or vehicular access. Pedestrian access is provided directly from Prairie Street. The subject property is located in an area that functions with safe and• efficient vehicular circulation. The proposed use will not have any negative effect on the existing traffic configuration in the neighborhood. The zoning ordinance does not require off-street parking be provided by any land use within the CC1 district. The property is located adjacent to a city-owned surface parking lot and Fulton Street parking garage both of which offer free public parking. Employees and attendees of the events will have access to all 54 parking spaces in,the adjacent city- - 7 - Recommendation & Findings of Fact Petition 10-18 May 7, 2018 owned surface parking lots, and all 492 parking spaces in the Fulton Street parking garage. On-street parking is also provided on both sides of Prairie Street between S. Grove Avenue on the west end and Villa Street on the east end. D. Location, Design, and Operation Standard. The suitability of the subject property for the intended conditional use with respect to it being located, designed, and operated so as to promote the purpose and intent of this title and chapter. Findings. The subject property is suitable for the intended conditional use with respect to it being located, designed, and operated so as to promote the purpose and intent of the ti zoning ordinance. The applicant is not proposing any exterior changes to the building. All commercial event activities will be conducted on the interior of the building without any impact on the surrounding properties. No evidence has been submitted or found that the proposed use will be located or operated in a manner that will exercise undue detrimental impact on surrounding properties. Music will be permitted on the interior of the commercial event space, and the applicant must comply with Chapter 10.30 "Noise" of the Elgin Municipal Code, 1976 as amended. E. Historic Preservation Standard. Where applicable, the conditional use shall make possible an efficient contemporary use of or a compatible improvement to a designated landmark or property located in a designated historic district while preserving those portions and features of the property which are significant to its historic, architectural, and cultural values to an historic preservation plan. Findings. This standard is not applicable. The subject property is neither designated as a local historic landmark nor is it located within a locally designated historic district. RECOMMENDATION The Community Development Department and the Planning & Zoning Commission recommend approval of Petition 10-18, subject to the following conditions: 1.
