G55-17 Ordinance No. G55-17 AN ORDINANCE AMENDING THE CITY OF ELGIN'S HOTEL OR MOTEL ROOM RENTAL TAX WHEREAS, the City of Elgin is a home rule unit pursuant to Article VII Section 6 of the Illinois Constitution; and WHEREAS, as a home rule unit the City of Elgin may exercise any power and perform any function pertaining to its government and affairs including,but not limited to,the power to regulate for the protection of the public health, safety, morals and welfare and to tax; and WHEREAS,the City of Elgin has previously adopted a hotel or motel room rental tax as set forth in Chapter 4.24 of the Elgin Municipal Code, 1976, as amended; and WHEREAS, the City Council of the City of Elgin has determined that it is necessary and desirable to amend such hotel or motel room rental tax by increasing the rate thereof. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Chapter 4.24 of the Elgin Municipal Code, 1976, as amended, entitled "Hotel or Motel Room Rental Tax" be and is hereby further amended by amending Section 4.24.020A thereof to read as follows: "A. There is levied and imposed a tax of eight percent (8%) of the rent charged for the privilege and use of renting a hotel or motel room within the City for each twenty four (24) hour period or any portion thereof for which a daily room charge is made; provided however, that the tax shall not be levied and imposed upon any person who rents a hotel or motel room for more than thirty (30) consecutive days or to a person who works and lives in the same hotel or motel." Section 2. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed to the extent of any such conflict. Section 3. That this ordinance shall be in full force and effect on and after January 1,2018, upon its passage and publication in the manner provided by law. avid J.
