AN ORDINANCE
AMENDING SECTION 10.88.010 OF THE ELGIN MUNICIPAL CODE, 1976,
AS AMENDED, ENTITLED "DISCHARGE OF FIREARMS"
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS
Section 1. That Section 10.88.010 of the Elgin Municipal Code, 1976, as amended,
entitled "Discharge of Firearms" be and is hereby further amended to read as follows:
"It is unlawful for any person to fire or discharge any cannon, gun, pistol or other firearm
in any part of the City; provided that this Section shall not be construed to prohibit (1) the
discharge of blank cartridges by any military company while on parade and under a
commanding officer, (2) the discharge of firearms by any City officer or other person in
the discharge of a legal duty, when the same is done in such a manner so further provided,
(3) the discharge of blank cartridges for ceremonial purposes by any veterans, civic or
religious group while under the direct supervision of the Police Department after having
obtained and pursuant to a permit issued by the Chief of Police,(4) the discharge of firearms
within a lawfully established and licensed shooting gallery /firing range; or (5) the
discharge of a firearm by a person engaged in a lawful act of self - defense."
Section 2. That all ordinances or parts of ordinances in conflict with the provisions of
this ordinance be and are hereby repealed to the extent of any such conflict.
Section 3. That this ordinance shall be in full force and effect upon its passage and
publication in the manner provided by law.
