G27-16Ordinance No. G27 -16 EWES] 101ZEW140 ESTABLISHING SPECIAL REGULATIONS FOR STREET GRAPHICS WITHIN THE GRAND VICTORIA CASINO AREA OF SPECIAL CHARACTER AND ESTABLISHING A PROGRAM FOR GRAPHICS (250 and 255 South Grove Avenue) WHEREAS, said territory commonly referred to as the Grand Victoria Casino at 250 and 255 South Grove Avenue has been classified in the PCC Planned Center City District; and WHEREAS, written application has been made to add the property commonly known as Grand Victoria Casino at 250 and 255 South Grove Avenue within an area of special character; and WHEREAS, Section 19.50.105 of the Elgin Municipal Code, 1976, as amended, provides that the City Council may designate specific locations within the city as Areas of Special Character in order to provide appropriate flexibility in the regulation of street graphics through the adoption of special regulation for these areas that can vary from the regulations contained within the City's Street Graphics Ordinance; and WHEREAS, the City Council, in its Ordinance No. G26 -16, has designated the property commonly referred to as Grand Victoria Casino at 250 and 255 South Grove Avenue, and further described in Section 1 of said ordinance as the Grand Victoria Casino Area of Special Character pursuant to Section 19.50.105; and WHEREAS, written application has been made to adopt special regulations for street graphics and a Program for Graphics on the property commonly referred to as Grand Victoria Casino at 250 and 255 South Grove Avenue, those regulations being further described in Section 1 of this ordinance as part of the Grand Victoria Casino Area of Special Character; and WHEREAS, the Planning and Zoning Commission held a public hearing concerning adding the property at Grand Victoria Casino at 250 and 255 South Grove Avenue as an Area of Special Character and concerning the proposed special regulations and program for graphics, and has submitted its written findings and recommendation, hereto attached as Exhibit A, that the subject property be established as the Grand Victoria Casino Area of Special Character and that the special regulations for street graphics be granted; and WHEREAS, the City Council has previously determined that the Grand Victoria Casino Area of Special Character has unique characteristics including the area's location, and value to downtown Elgin's cultural and entertainment district; and WHEREAS, the City Council further finds that the location and use of the subject property as a regional tourist facility, presents specified unique challenges and demands such that the City's street graphic ordinance cannot adequately regulate street graphics for such use in such area; and WHEREAS, the proposed special regulations and program for graphics for the subject property are consistent with the unique character and unique use of the Grand Victoria Casino Area of Special Character and departures from the street graphics ordinance as contained within such proposed special regulations are limited to address the unique and particular area characteristics and use characteristics of the subject property's portion of the Grand Victoria Casino Area of Special Character; and WHEREAS, the City of Elgin is a home rule unit and as a home rule unit may exercise any power and perform any function pertaining to its government and affairs; and WHEREAS, zoning, including, but not limited to, this ordinance establishing special regulations for street graphics and a program for graphics pertain to the government and affairs of the city. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. The following Special Regulations for Street Graphics for the Grand Victoria Casino Area of Special Character, such property being legally described in the Ordinance Amending Chapter 19.50 of the Elgin Municipal Code, 1976, as Amended, entitled "Street Graphics," Regarding the Grand Victoria Casino Area of Special Character, Ordinance No. G26- 16 (the "Subject Property "), be and are hereby granted and approved pursuant and subject to the following terms and conditions: 1. Compliance with the graphics exhibit entitled Electronic Message Board Monument Sign B -001, Proof No. 2 dated March 24, 2016; and two (2) wall - mounted signs B -002 Proof No 1, dated February 17, 2016 prepared by Image 360, attached hereto as Exhibit 1 (such plan is hereinafter referred to as the "Subject Special Sign District Plan"). Pursuant to the Subject Special Sign District Plan, one free- standing monument style double -faced light emitting diode (LED) electronic changeable copy graphic (the "Special Sign A ") and depicted, and one wall mounted single -faced light emitting diode (LED) electronic changeable copy graphic (the "Special Sign B ") shall be permitted on the Subject Property in the location as set forth in paragraph 3 below. 2. Compliance with the Program for Graphics attached hereto as Exhibit 2, such program for graphics prepared by Image360, including the following exhibits: a. Master Location Plan dated February 17, 2016 b. Plat of Survey prepared by Alan J. Coulson, P.C. dated January 13, 1988 c. Illuminated Monument Wayfinding Sign A -012, A -013, A -014, A -015, A- 016, and A -017, Proof No. 2 dated March 24, 2016 d. Refacing Existing Sign, Exhibits A -001 (rear of boat), A -002 (circular cabinet between smoke stacks), A -003 (paddle wheel signs), A -004 (crosswalk pedestrian bridge illuminated channel lettering), A -005 and A -006 (southeast end parking lot), A -007 and A -008 (parking garage south and north facing entrance /exit), A -009 (parking garage south facing entrance /exit dimensional lettering), A -010 (parking garage west facing entrance /exit), A -011 (parking garage west facing entrance /exit dimensional lettering), A -018 (illuminated wayfinding sign) — dated February 24, 2016. -2- e. Removal of Signs exhibits C -001, C -002, C -003, C -004, C -005, C -006 and C- 007 dated February 17, 2016 at various locations on the property, with no proposal for replacement of these graphics. 3. The Special Sign A shall be installed only at a location at the northwest corner of the intersection of National Street and South Grove Avenue as depicted on Exhibit 1 attached hereto. The Special Sign will be landscaped in an area equal to no less than 2.5 times the surface area of the graphic. The Special Signs B shall installed only on the north and south facing elevations of the pedestrian bridge also as depicted on Exhibit 1 attached hereto. 4. The graphics shall be oriented in such a manner as to create minimum negative impact to the greatest extent possible on residential property in the vicinity. 5. The light emitting diode (LED) electronic display panels included as part of the graphics shall also comply with the following additional standards: a. All images, displays or messages of any type or nature (hereinafter collectively "Image" or "Images ") shall be static without any type of movement or motion whether the Images are in the form of animation, video, text or otherwise. No continuous traveling, scrolling, flashing, spinning, revolving or shaking, or any other type of movement or motion of an Image shall be allowed. b. The rate of change for any Image shall be for a minimum period of ten (10) seconds, i.e., each Image displayed shall be displayed for a minimum period of ten (10) seconds. C. Any Image or message change sequence shall be accomplished immediately with no transition by changing from one screen to another or by means of fade or dissolve mode. d. The intensity or maximum brightness of the light emitting diode (LED) electronic display panels shall not exceed five thousand (5,000) nits when measured from the sign's face at its maximum brightness, during daylight hours, and five hundred (500) nits when measured from the sign's face at its maximum brightness between dusk and dawn, i.e. the time of day between sunrise and sunset. The light emitting diode (LED) electronic display panel shall include an ambient light meter at a programmable or manual dimming capacity. e. The square footage of the light emitting diode (LED) electronic message center shall not exceed the following dimensions: i. 56.3 square feet for the monument sign (Special Sign A) ii. 60 square feet for each of the wall mounted signs on the pedestrian bridge facing a northerly and southerly direction (Special Sign B) -3- f. The light emitting diode (LED) electronic changeable copy graphics, as well as all other street graphics within the Subject Property shall not be operated, in whole or in part, as Off Premises Street Graphics. g. The light emitting diode (LED) electronic display panels shall display Images limited solely and only to displaying in text the names, logos and messages of the functions and activities of the Subject Property. h. In the event of any conflict between the standards for the light emitting diode (LED) electronic display panel as provided for in this Subsection 5 and the provisions within the Subject Special Sign District Plan, the provisions of this Subsection 5 shall supersede and control. 6. The owner shall be permitted to obtain any required building and zoning permits to modify the following attributes of the graphic without requiring further amendment to this ordinance: a) Re- location of the graphic (Special Sign A) along the frontage of National Street or Grove Avenue. b) Position and dimensions of the electronic display panel within the overall graphic (Special Sign B) as long as the surface area of such panel does not exceed 60 square feet in surface area. 7. In the event of any conflict between the special regulations for the Subject Property as provided herein, and the provisions of Chapter 19.50 of the Elgin Municipal Code, 1976, as amended, entitled "Street Graphics ", the provisions of these special regulations for the Subject Property as contained herein shall supersede and control. 8. With the sole exception of the Special Signs A and B (i.e., the light emitting diode (LED) electronic changeable copy graphics described in paragraph 1 and the non- electronic graphics described as part of the Program for Graphics in Paragraph 2 of this section as authorized in this ordinance), all other street graphics on the Subject Property shall comply with the following additional provisions: Substantial conformance to the development application, statement of purpose and conformance with attachments submitted by Image360, dated received on February 19, 2016. 2. Draft Ordinances BACKGROUND Planning & Zoning Commission April 4, 2016 Grand Victoria Casino, is requesting an amendment of Title 19 "Zoning" of the Elgin Municipal Code, specifically Chapter 19.50 "Street Graphics" to establish an Area of Special Character; request special regulations for electronic message (LED) graphics within the area of special character; and establish a program for graphics at the property commonly referred to as 250 and 255 South Grove Avenue. The properties and structures that will be subject to these regulations include the pavilion, river boat, parking areas and open spaces. Grand Victoria Casino proposes to replace all exterior graphics on the property with the intention of updating them through a program for graphics that will assist with wayfinding and marketing. Approval is requested under four categories: 1. Replacement of current wayfimding and branding graphics with similar graphics that are proposed to meet the requirements of the graphics ordinance for surface area and height, but in a new updated design 2. Installation of LED electronic message center graphics at two locations on the property: • One LED graphic at the comer ofNational Street and Grove Avenue containing an electronic message board of 60 sq.ft. • Two LED graphics on the pedestrian bridge connecting the parking garage to the pavilion — one on each side (facing northbound and southbound Grove Avenue) — and each containing an electronic message board of 60 sq.ft. 3. Removal of existing graphics that are no longer needed, or where the graphic would be more effective in a different location on the property 4. Installation of temporary graphics at two locations, one location which, on the pedestrian bridge, is proposed as an alternative to the LED sign proposed at the same location. The proposed LED graphics can only be provided through the designation of the property within an Area of Special Character. Additionally, special regulations will need to be provided for the location design and operation of all proposed graphics. Approval of such graphics can only be approved through a public hearing of the Planning & Zoning Commission with final approval of the Elgin City Council. The applicant is concurrently requesting approval of a text amendment to the zoning ordinance to include the subject property within an area of special character, and herein requests approval of the special regulations that will govern the location, design and operation of the electronic message center (LED) graphic. The applicant is not proposing any modification to the location, design, operation and configuration of the existing facilities and structures that comprise the Grand Victoria Casino and its related properties that include the pavilion, parking deck and surface parking areas. -2- Findings of Fact Petition 09 -16 FINDINGS OF FACT Planning & Zoning Commission April 4, 2016 After due notice, as required by law, the Planning & Zoning Commission held a public hearing in consideration of Petition 09 -16 on April 4, 2016. The applicant testified at the public hearing and presented documentary evidence in support of the application. The Community Development Department submitted a Planned Development Review dated April 4, 2016. The following are the findings of the Planning & Zoning Commission on the special regulations for an electronic changeable copy graphic. A. Site Characteristics Standard. The suitability of the subject property for the intended zoning district with respect to its size, shape, significant natural features (including topography, watercourse and vegetation), and existing improvements. Findings. The subject property is suitable for the intended zoning district with respect to the site characteristics standard. The subject property is irregularly shaped and contains two parcels of land separated by the South Grove Avenue public right -of -way. The site is developed with the pavilion and a handicap accessible surface parking lot of the Grand Victoria Casino on the west side of Grove Avenue and the three story parking garage and surface parking lot of the casino on the east side of Grove Avenue. The pavilion is built to the water's edge of the Fox River and leads to the river boat located immediately to the west. A covered pedestrian bridge connects the upper floor of the parking garage to the second floor of the pavilion. There are no significant natural features or natural water bodies present on the property. The Fox Fiver runs past the property in a southerly direction immediately west of the property. B. Sewer and Water Standard. The suitability of the subjectpropertyfor the intended zoning district with respect to the availability of adequate municipal water, wastewater treatment, and storm water control facilities. Findings. The subject property is suitable for the intended zoning district with respect to the sewer and water standard. The property is currently served within municipal water, storm and sanitary sewer utilities. C. Traffic and Parking Standard. The suitability of the subject property for the intended zoning district with respect to the provision of safe and efficient on -site and off -site vehicular circulation designed to minimize traffic congestion. Findings. The subject property is suitable for the intended zoning district with respect to the traffic and parking standard. -3- Findings of Fact Petition 09 -16 Planning & Zoning Commission April 4, 2016 The subject property has frontage along Grove Avenue, Lake Street and National Street. National Street is designated as an arterial street connecting properties on the east side of Elgin to the west side by means of the National Street vehicular bridge across the Fox River. Grove Avenue is a collector street serving the commercial properties of downtown Elgin and Lake Street is a local street providing service access to the pavilion and parking garage of the casino, and residential neighborhoods located to the east of the casino. Primary access to the property is provided from Grove Avenue by means of a circular access drive leading to a porte cochere of the pavilion. Additional access to the parking garage and surface parking areas are also provided off Grove Avenue. Access to the three -story parking garage is provided from Lake Street and the surface parking lot to the south. The only connection to National Street is an egress drive at the south west corner of the handicap accessible parking lot. The former right -of -way of the Chicago and Northwestern Transportation Company Railroad (now owned by the Union Pacific Railroad) runs along the east of the parking garage and southeast surface parking lot. The tracks were removed with the termination of railroad service in 1998. The property is developed with 1,379 parking spaces within the three -story garage, 378 parking spaces within the southeast surface lot and 93 parking spaces within the southwest surface parking lot, of which 30 spaces are handicap accessible stalls; for a total of 1,850 off - street parking stalls to accommodate the large number of visitors and approximately 1,400 employees that arrive at the property on a daily basis. D. Zoning History Standard. The suitability of the subject property for the intended zoning district with respect to the length of time the property has remained undeveloped or unused in its current zoning district. Findings. The subject property is suitable for the intended zoning district with respect to the length of time the property has remained undeveloped or unused in its current zoning district. The subject property was added to Elgin as part of O. Davidson's Addition on June 18, 1860. The tracts east of Grove Avenue were later resubdivided in 1879 as part of Davidson's Grove Avenue Subdivision. With the advent of zoning in Elgin, the property was zoned "G" Industrial District until 1962, when it was rezoned to B4 General Service District. The property was developed with a variety of commercial and industrial uses, most notably the automobile dealerships that occupied Grove Avenue between Prairie and National Street. In 1992, the property was rezoned within the CC2 Center City District as part of a comprehensive amendment to the zoning ordinance. The casino pavilion and parking areas were constructed in 1994, and have operated as such since that time. It was also at this time that the existing street graphics on the property were installed. M Findings of Fact Planning & Zoning Commission Petition 09 -16 April 4, 2016 In 2000 the property was included within the Center City Preservation Overlay Zoning District to provide for the implementation of the Riverfront/Center City Master Plan. E. Surrounding Land Use and Zoning Standard. The suitability of the subject property for the intended zoning district with respect to consistency and compatibility with surrounding land use and zoning. Findings. The subject property is suitable for the intended zoning district with respect to consistency and compatibility with surrounding land use and zoning. The area to the north of the subject property is zoned PCC Planned Center City District and developed with the townhouses of River Park Place. The area to the south is zoned CC2 Center City District and is developed with a commercial shopping center. The area to the immediate west is zoned CF Community Facility District and comprises the open spaces that are part of the Fox River Trail. The areas to the east of the property are zoned RC3 and are developed primarily with single - family residences that were developed around the turn of the last century as part of workers housing for the Elgin National Watch Company. These properties are designated within the Elgin National Watch Historic District. F. Trend of Development Standard. The suitability of the subject property for the intended zoning district with respect to consistency with an existingpattern of development or an identifiable trend of development in the area. Findings. The subject property is suitable for the intended zoning district with respect to consistency with an existing pattern of development or an identifiable trend within the area. The subject property is located within downtown Elgin in an area that has developed with a mix of commercial, entertainment, retail, restaurants, and residential uses. G. Planned Development Districts Standard. The suitability ofthe subjectpropertyfor the intended zoning district with respect to conformance to the provisions for the purpose and intent, and the location and size of a zoning district. The purpose of the PCC Planned Center City district is to facilitate the implementation of the official comprehensive plan, as focused on a distinctive subarea of the city with a common urban fabric, subject to the provisions of Chapter 19.60 of this title. No PCC zoning district shall be mapped separately subsequent to the effective date of this title, unless such property to be mapped adjoins an existing CC2 center city district, CC2 center city district, or a PCC planned center city district. This PCC district is most similar to, but departs from the standard requirements of the underlying CC2 Center City District in terms of location, design and operation of land uses and site design features. The classification of the property within a PCC district provides for special regulations for signage that will allow for the LED graphic to be installed on the property. -5- Findings of Fact Petition 09 -16 Planning & Zoning Commission April 4, 2016 H. Comprehensive Plan Standard. The suitability of the subject property for the intended zoning district with respect to conformance to the goals, objectives, and policies of the official comprehensive plan. Findings. The subject property is suitable for the intended zoning district with respect to the Comprehensive Plan Standard. The subject property is designated as "Community Mixed Use" by the City's Comprehensive Plan and Design Guidelines dated 2005. The plan states that, "Community Mixed -Use Centers provide focus, identity, and convenient goods and services, as well as some employment, for a number of surrounding neighborhoods in a larger trade area. The ideal community mixed -use center should be between 30 -100 acres of commercial, office, entertainment, medium density residential, and institutional uses accessed by arterial streets and transit service. The center would have parcels and buildings scaled to pedestrians, small enough to encourage parking once and walking to more than one destination. Off - street parking is shared and on- street parking helps to contribute to the intimate scale of well - functioning pedestrian environments. Parking located between and behind buildings permits people to walk more safely and comfortably between uses that front sidewalks rather than large parking lots. Downtown Elgin functions as a unique community mixed -use center within the planning area. It is the historic and traditional heart of the community. Recommended land uses include a compatible mix of residential (30 plus du/ac), employment, educational, civic, and office uses, combined with a cultural and entertainment center focus that extends activities throughout the day. Pedestrian, bicycle, transit, and vehicular circulation systems are coordinated and efficient. Streets and places are designed to encourage pedestrian activity. I. Natural Preservation Standard. The suitability of the subject property for the intended planned development with respect to the preservation of all significant natural features including topography, watercourses, wetlands, and vegetation. Findings. The subject property is suitable for the intended planned development with respect to the Natural Preservation Standard. There are no natural features on the property that are worthy of preservation. The Fox River runs to the west of the subject property. The river boat casino is moored along its eastern bank. J. Internal Land Use Standard. The suitability of the subject property for the intended planned development with respect to the land uses permitted within the development being located, designed, and operated so as to exercise no undue detrimental influence on each other or on surrounding property. Findings. The subject property is suitable for the intended planned development with respect to the internal land use standard. CZ Findings of Fact Petition 09 -16 Planning & Zoning Commission April 4, 2016 No evidence has been submitted or found that the proposed planned development providing for special regulations for graphics will be located, designed, or operated in a manner that will exercise undue detrimental influence on itself or surrounding property. STANDARDS FOR AREAS OF SPECIAL CHARACTER The Planning & Zoning Commission has made the following findings concerning the Areas of Special Character: A. Area Characteristics: The suitability of the subject property for the intended area of special character with regard to the unique and particular characteristics of the area including its location, size, shape, significant natural features, including topography, water courses and vegetation, the nature of adjoining public rights of way, and architectural, historic or scenic features. Findings. The subject property is located within an area that possesses unique and particular characteristics of location. The property is located in downtown Elgin, which functions as the community's cultural and entertainment center. It is the historic and traditional heart of the community. The riverboat casino is the largest attraction of clients and tourists to Elgin's downtown. The special LED graphic proposed for the property is directed to the vehicle users and travelers to Elgin that arrive at the property along Nation Street and Grove Avenue. B. Use Characteristics: The suitability of the subject property for the intended area of special character with regard to the existing or proposed use of the area along with specified unique challenges and demands such that the street graphics ordinance cannot adequately regulate street graphics for such use in such area. Findings: The existing uses within the area would benefit from the use of special graphics due to the unique challenges and demands such that the street graphics ordinance cannot adequately regulate. The Grand Victoria Casino is developed with a casino on the river boat and contains a variety of gaming facilities including slots, Las Vegas -style table games, as well as poker. The pavilion contains four restaurants ranging from a deli to full service restaurants and a buffet. The second floor of the pavilion contains a large banquet hall and a number of private lounges. These uses stand to benefit from the messages that an electronic changeable graphic can project to the approximately 400,000 visitors that annually travel to and from the facility. C. Special Regulations: The suitability of the subject property for the intended area of special character with regard to special regulations that are consistent with the unique character and unique use of the area, and for which departures from the street graphics ordinance, if any, are specifically limited to address the unique and particular characteristics and use of the proposed area. -7- Findings of Fact Petition 09 -16 Planning & Zoning Commission April 4, 2016 Findings: The special regulations proposed for the area of special character are consistent with the unique use of the area, and for which departures from the street graphics ordinance, if any, are specifically limited to address the unique and particular characteristics and use of the proposed area. The street graphics ordinance limits the use of electronic message centers only to properties with frontage along Randall Road and the northerly portion of State Route 31. An area of special character provides for the use of these special graphics in remaining areas of the community. Installation of LED electronic message center graphics are proposed at two locations on the property: • One LED graphic at the corner ofNational Street and Grove Avenue containing an electronic message board of 60 sq.ft. • Two LED graphics on the pedestrian bridge connecting the parking garage to the pavilion — one on each side (facing northbound and southbound Grove Avenue) — and each containing an electronic message board of 60 sq.ft. Each electronic message board will only advertise messages pertaining to the Grand Victoria Casino, its amenities and programs. The images, displays or messages of any type will be static, without any movement or motion. Images are proposed to be displayed for a time interval of one minute. The intensity of the graphic will be lowered during the night time. DEPARTURES FROM THE REQUIREMENTS OF THE ZONING ORDINANCE The buildings, structures, and various improvements are constructed in conformance with the requirements of the PCC Planned Center City District and were granted a number of departures from the requirements of the zoning ordinance when they were approved for construction. No additional alteration, construction or demolition of any portion of these structures and site are currently proposed at this time. The existing graphics on the property were also granted departures from the requirements related to surface area and number of graphics. The following departures are additionally requested to allow for the implementation of the LED graphics and the proposed program for graphics: a. Departure to provide for the Electronic Message Board LED graphics: The proposed electronic message center (LED) graphic will depart from the requirements of the ordinance for maximum surface area and its operation as an electronic changeable copy (LED) graphic. However, an exception to the maximum surface area of a monument graphic is specifically provided for within an area of special character. The overall surface area of the proposed free standing graphic is approximately 150 square feet and includes the brick masonry base. The surface area of graphic panels is 56.3 feet square feet which is less than the area allowed by the zoning ordinance for shopping center graphics on larger commercial zoning lots. The height of the graphic is 10 feet and conforms to the height requirements of the zoning ordinance. Findings of Fact Petition 09 -16 Planning & Zoning Commission April 4, 2016 The two wall mounted LED graphics proposed for the pedestrian bridge are 78.40 square feet in surface area and will contain a 60 square foot LED panel each. In the event LED graphics are not proposed for these locations, they are proposed to be constructed as static window graphics and will occupy less than 15% of the window surface area of the bridge. The designation of the property within an area of special character and the approval of special regulations provides the needed flexibility to allow for an electronic changeable copy (LED) graphic that the standard provisions of the graphics ordinance would not otherwise allow. b. Other Departures from the Requirements of the Graphics Ordinance The existing graphics were granted departures from the requirements of the zoning ordinance related to the surface area and number of monument and wall mounted graphics. No further departures from the requirement of monument and wall mounted graphics is requested. Rather, the monument and wall mounted graphics that are proposed as new upgrades have been designed in conformance with the surface area and height requirements of the zoning ordinance. The only remaining departures being requested pertain to the temporary graphics proposed on the property and are as follows: a. Section 19.50.090.11 — Temporary Graphics i. Surface Area. The maximum size of a temporary graphic allowed by the zoning ordinance is 32 square feet. The applicant is requesting approval of a temporary graphic with a surface area of 88.33 square feet. ii. Number. The maximum number of temporary graphics allowed to be displayed at any time is one. The applicant is requesting 3 temporary graphics to be displayed at a time. iii. Duration of Display for Uses with a Certificate of Occupancy. The zoning ordinance provides for a display period of 15 consecutive days. The temporary graphics are proposed to be displayed for up to six events through the calendar year on a 28 day cycle, every other month, thereby requiring a departure from these requirements of the zoning ordinance.
