In Witness Whereof, I have hereunto set my hand and affixed the corporate seal of the City of Elgin at the said City in the County and State aforesaid this July 9,2009. uses Fit tkl- City Cler This instrument prepared'by: Return to: William A.Cogley Diane Robertson Corporation Counsel Elgin City Clerk p� City of Elgin 150 Dexter Court (( I 150 Dexter Court Elgin, IL 60120 Elgin,IL 60120 �y 43 , i 2009KO54465 1/12 • Ordinance No. T33-09 AN ORDINANCE ALLOCATING THE COSTS OF CERTAIN SANITARY SEWER IMPROVEMENTS AREA 10 FROM POINT K TO POINT B (10" PVC SANITARY SEWER) WHEREAS; Toll II LP, an Illinois limited partnership (hereinafter referred to as the "Developer-) is the owner or developer of 326 acres commonly known as the Bowes Creek Country Club ("Subject Property"); and WHEREAS, Developer will cause certain sanitary sewer improvements to be constructed which consist of those improvements from Point K to Point B as shown on the plat entitled "On Site Sanitary Improvements And Recapture Areas", attached hereto as Exhibit A (hereinafter referred to as the "Certain Sanitary Sewer Improvements from Point K to Point B"); and WHEREAS, the Certain Sanitary Sewer Improvements from Point K to Point B have been oversized beyond the requirements of the Developer making the Certain Sanitary Sewer Improvements from Point K to Point B accessible to certain other properties and thereby benefits said properties; and WHEREAS, it is reasonable to require owners of property nearby the Certain Sanitary Sewer Improvements from Point K to Point B to bear a proportionate cost of the Certain Sanitary • Sewer Improvements from Point K to Point B in the event that said owners desire to connect to and use the Certain Forcemain Improvements from Point K to Point B; and WHEREAS, the City of Elgin is a home rule unit authorized to exercise any power and perform any function pertaining to its government and affairs; and WHEREAS, the construction of sanitary sewer improvements and the allocation of the costs of sanitary sewer improvements to benefited properties pertains to the government and affairs of the City of Elgin; and WHEREAS, a listing of all benefited properties which benefit from the Certain Sanitary Sewer Improvements from Point K to Point B is shown on the document entitled "Bowes Creek Country Club Recapture Summary Service Area No. 10 (K-B) attached hereto as Exhibit B (hereinafter referred to as the "Subject Benefited Properties") and a map depicting the Subject Benefited Properties is attached hereto as Exhibit D; and WHEREAS, the estimated total Project Costs of the Certain Sanitary Sewer Improvements from Point K to Point B is estimated to be $53,135, of which $9,673.23 is the estimated amount allocated to the Subject Property; and WHEREAS, the City Council of the City of Elgin hereby finds that the estimated fair proportionate share of the costs of the Certain Sanitary Sewer Improvements from Point K to • Point B for the Subject Benefited Properties by the availability of such Certain Sanitary Sewer . Improvements from Point K to Point B should be computed at the estimated rate of$132.51 per acre set forth in Exhibit B. ("Estimated Rate") with the final rate for such properties to be computed as set forth in Section 5 of this ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN. ILLINOIS: Section 1. That the owner of any of the Subject Benefited Properties identified in Exhibit B, who desires to connect to and use the Certain Sanitary Sewer Improvements from Point K to Point B shall pay to the Developer the amount allocated as the fair proportionate share of the costs of the Certain Sanitary Sewer Improvements from Point K to Point B for such property as the estimated rate of$132.51 per acre as set forth in Exhibit B (Estimated Rate) with the Final Rate for such properties to be computed as set forth in Section 5 of this ordinance. Said fee shall be in addition to any and all other fees established by the City of Elgin for sanitary sewer services and in addition to any and all other requirements established by the City of Elgin for connection to sanitary sewer services including, but not limited to, annexation into the City of Elgin. Section 2. No property listed in Exhibit B that will be connected to the Certain Sanitary Sewer Improvements from Point K to Point B shall hereinafter be annexed into the city or shall be issued a building permit or otherwise permitted to connect or to otherwise use the Certain Sanitary Sewer Improvements from Point K to Point B until such time as payment is made to the Developer in an amount equal to such property's proportionate share of said • improvements as set forth in this ordinance. The Developer shall issue a certificate of payment in the form approved by the city upon the payment of reimbursement from the owner of a benefited property. Section 3. That any property held in common ownership with and contiguous to property subject to the provisions of this ordinance on the effective date of this ordinance shall be subject to payment based on the entire amount established for the entire parcel as provided in this ordinance. Section 4. That any person desiring to connect to the Certain Sanitary Sewer Improvements from Point K to Point B may pay the amount allocated without interest if payment is made no later than seventy-five (75) days of the date the City Council of the City of Elgin adopts a resolution accepting such improvements. If payment is made more than seventy-five (75) days after the adoption of such a resolution accepting the improvements, then payment shall be made in full plus interest at the rate of six percent (6%) per annum accruing from the date of the adoption of the resolution accepting the improvements until the date of payment. Section 5. Within thirty (30) days after the date of completion of the Certain Sanitary Sewer Improvements from Point K to Point B, the Developer's Engineer, Cowhey Gudmundson Leder Ltd., or such successor engineer retained by the Developer, shall certify the certified cost- final for Certain Sanitary Sewer Improvements from Point K to Point B and shall submit the same to the City Engineer for his concurrence ("Certified Cost-Final"). The Certified Cost- Final shall then be used to recompute the Estimated Rate per Acre provided for in Section 1 and i I ' I . Exhibit B hereof, which shall become the "Final Rate". Within thirty (30) days after the City • Engineer has concurred with the Developer's Engineer's Certified Cost-Final to provide for the Final Rate the Developer shall send out True-Up notices to the then current property owners of the Subject Benefited Properties whose names appear on the most recent tax bills for the Subject Benefited Properties advising the property owners of the Final Rate and the resulting True-Up between the Estimated Rate provided for in this ordinance and the Final Rate. The Owner of any of the Subject Benefited Properties which has previously paid the Estimated Rate and the Developer shall True-Up. If the Final Rate is less than the Estimated Rate, then within thirty (30) days after notice from the Developer, Developer shall pay said owners of benefited properties said excess amount. If the Final Rate is greater than the Estimated Rate, then the owner of any of the Subject Benefited Property which has previously paid the Estimated Rate shall pay to the Developer within thirty (30) days after receipt of notice from the Developer the amount owed. No interest shall be due or owing on the payment of True-Up amounts between the Developer and the owner of any of the Subject Benefited Properties who has previously paid the Estimated Rate. Section 6. Notwithstanding anything else to the contrary in this ordinance, any property owned by the City of Elgin or any other governmental unit shall not be subject to this Recapture Ordinance and the City of Elgin and any other governmental unit shall not be required to pay any recapture pursuant to this ordinance or otherwise. Section 7. The provisions of this ordinance are not intended and shall not be construed as to authorize or entitle the owner or any of the Subject Benefited Properties, or any • other person or entity, the right to annex into the City of Elgin. Section 8. In the event of any conflict between the provisions of this ordinance and the provisions of any other ordinance, the provisions of this ordinance shall supersede and control. Section 9. Developer shall within thirty (30) days of the adoption of this ordinance record a certified copy of this ordinance with the Kane County Recorder. Developer shall also within thirty (30) days of the adoption of this ordinance, send out by regular mail notice of the adoption of this ordinance with a copy of the ordinance to the property owners whose names appear on the tax bills for the PIN numbers identified on Exhibit B. Section 10. The provisions of this ordinance shall be nonrecourse to the City of Elgin and the City of Elgin shall not be responsible in the event there is no development of any of the Subject Benefited Properties and/or the recapture payments provided for in this ordinance are otherwise uncollected for any reason. Section 11. That this ordinance shall be in full force and effect from and after its passage and publication in the manner provided by law.
