G28-07 ��.• Ordinance No. G28-07 AN ORDINANCE GRANTING A CONDITIONAL USE TO PERMIT THE ESTABLISHMENT AND OPERATION OF AN EMERGENCY SHELTER (270 East Chicago Street) WHEREAS, written application has been made for a conditional use for a planned development which will allow for the establishment and operation of an emergency shelter within the CC2 Center City District at 270 East Chicago Street; and WHEREAS, the Zoning and Subdivision Hearing Board conducted a public hearing after due notice by publication and has submitted its findings of fact and recommended approval. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That a conditional use for a planned development which will allow for the establishment and operation of an emergency shelter within the CC2 Center City District at 270 E. Chicago Street and legally described as follows: The east one-half of Lot 9 and all of Lot 10 in block 7 of J.T. Gifford's Plat, being in the Northwest Quarter of Section 13, Township 41 North, Range 8 east of the Third Principal Meridian, in the City of Elgin, Kane County, Illinois (property commonly known as 270 East Chicago Street). be and is hereby granted subject to the following conditions: 1. Substantial conformance with the Statement of Purpose and Conformance, prepared by Angelo Valdes, dated September 27, 2006. In the event of any conflict between such Statement of Purpose and Conformance and any applicable codes, ordinances or other requirements of law, such applicable codes, ordinances or other requirements of law shall control. 2. Substantial conformance with the Floor Plan submitted by Angelo Valdes, dated September 27, 2006. Correction of code violations as identified by the Community Development Group report, dated September 26, 2006 (also identified as October 16, 2006 report). 4.
