AN ORDINANCE
AMENDING ORDINANCE NO. S6-05 ANNEXING CERTAIN TERRITORY
TO THE CITY OF ELGIN
(Tuscan Woods—2105 Highland Avenue)
WHEREAS, a petition signed by all the owners of record of certain territory has been filed
with the City Clerk requesting annexation of said territory to the City of Elgin, Illinois; and
WHEREAS,said petition includes therein a statement under oath by all the owners of record
that no electors reside on the subject territory; and
WHEREAS, said territory is contiguous to the City of Elgin and is not within the corporate
limits of any municipality; and
WHEREAS, legal notices of the intent of the City of Elgin to annex said territory have been
forwarded to all public bodies required to receive said notice in the manner provided by law; and
WHEREAS,on February 23,2005,Ordinance No. S6-05 was passed annexing into the City
of Elgin such territory known as the Tuscan Woods Subdivision at 2105 Highland Avenue; and
WHEREAS,a scrivener's error has been discovered in the legal description of said territory
as recited in Ordinance No. S6-05 and it is necessary and desirable to correct the scrivener's error in
the legal description of such ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That Section 1 of Ordinance No. S6-05 passed on February 23,2005,be and is
hereby amended by amending the legal description in Section 1 of Ordinance No. S6-05 to read as
follows:
Parcel 1:
That part of the north half of section 16,township 41 north,range 11 east of
the third principal meridian described as follows: commencing at the point of
intersection of the center line of Highland Avenue with the east line of said section:
thence south along the east line of said section 884.09 feet;thence west parallel with
the south line of the northeast quarter of said section 1684.53 feet for the point of
beginning;thence north parallel with the east line of said section 1257.50 feet to the
center line of said Highland Avenue road;thence northwesterly along said centerline,
being along a curve to the right having a radius of 2301.73 feet, distance of 314.34
feet to the point of tangency of said curve;thence northwesterly along said center line
723.28 feet; thence northwesterly along said center line which forms an angle of 1
degrees 04 minutes to the left with the prolongation of the last described course
127.37 feet to the north line of said section; thence southwesterly at right angles to
said center line of highland avenue road 211.74 feet; thence northwesterly along a
line that forms an angle of 78 degrees 52 minutes with the prolongation of the last
described course 445.63 feet;thence northwesterly along a line that forms an angle of
07 degrees 54 minutes to the right with the prolongation of the last described course
229.25 to the north line of said section; thence west along said north line 503.00 feet
to the northwest corner of the east half of the northwest quarter of said section;
thence south along the west line of the east half of said northwest quarter 1074.80
feet to a point 1572.20 feet north of the southwest corner of the east half of said
northwest quarter; thence east parallel with the south line of said northwest quarter
1321.25 feet to the west line of the northeast quarter of said section; thence south
along said west line 702.00 feet to a point 870.20 feet north of the southwest corner
of said northeast quarter; thence east parallel with the south line of said northeast
quarter 959.89 feet to the point of beginning;in the township of Elgin,Kane County,
Illinois.
Parcel 2:
That part of the north half of Section 16,township 41 north,range 11 east of
the third principal meridian described as follows:
That portion of Highland Avenue lying northerly of Parcel 1 and south of the
north line of the northwest quarter of said Section 16,not previously annexed to the
City of Elgin, in the Township of Elgin, Kane County, Illinois.
Section 2. That a certified copy of this ordinance shall be filed with the Recorder of Deeds,
Kane County, Illinois.
Section 3. That this ordinance shall be in full force and effect immediately after its passage
in the manner provided by law.
