AN ORDINANCE
AMENDING CHAPTER 6.54 OF THE ELGIN MUNICIPAL CODE, 1976,
AS AMENDED, ENTITLED "SCAVENGERS"
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
Section 1. That Section 6.54.070 of the Elgin Municipal Code, 1976,as amended,entitled
"Hours of Collection,"be and is hereby further amended to read as follows:
A. Collection of refuse, trash or garbage shall not begin prior to five o'clock
(5:00) A.M. nor continue beyond eight o'clock (8:00) P.M.
B. Notwithstanding the provisions of subparagraph A of this section,no collection
of refuse, trash or garbage shall occur before seven o'clock (7:00) A.M. nor
continue beyond seven o'clock (7:00) P.M. on any residential dwelling unit
property in the city or on any property located within two hundred feet(200')of
a residential dwelling unit. The two hundred foot (200') distance shall be
determined by measuring from the location of the refuse,trash or garbage being
collected to the nearest property line of the parcel on which a residential
dwelling unit is located.
C. This section and the regulations contained herein shall not apply to the services
or operations of any governmental unit nor shall it apply to any such activities
performed by a private party pursuant to an agreement with any such
governmental unit.
Section 2. That all ordinances or parts of ordinances in conflict with the provisions of this
ordinance be and are hereby repealed.
Section 3. That this ordinance shall be in full force and effect upon its passage and
publication in the manner provided by law.
