G34-04 '` Ordinance No. G34-04 AN ORDINANCE GRANTING A CONDITIONAL USE FOR A MASTER SIGNAGE PLAN (127 SOUTH GROVE AVENUE) WHEREAS, written application has been made for a conditional use for a master signage plan in the CC1 Center City District at 127 South Grove Avenue; and WHEREAS, the Zoning and Subdivision Hearing Board conducted a public hearing after due notice by publication and has submitted its Findings of Fact and recommended approval; and WHEREAS, the City Council of the City of Elgin concurs in the findings and recommendation of the Zoning and Subdivision Hearing Board. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. Draft Conditional Use Ordinance (see enclosed) BACKGROUND An application has been filed by the Prairie Rock Brewing Company,requesting to repeal an existing conditional use for a master signage plan(ordinance G23-03)and to grant a conditional use for a new master signage plan. The subject property is located at 127 South Grove Avenue(see exhibits A,B, C, D, and E). Prairie Rock Brewing Company is currently undergoing a change in business identity to improve several aspects of the existing restaurant. Prairie Rock Brewing Company is proposing to establish additional wall signs on the Prairie Street and Grove Street elevations. These signage changes are primarily requested so that the signs can accurately reflect the new identity of the business. A total of 4 signs are proposed for the Grove Street elevation.The applicant is proposing to maintain the existing 12.5 square foot projecting wall sign and to add a suspended sign, measuring approximately 3.75 square feet, on the bottom of the projecting sign. Additionally,the applicant is proposing a painted wall sign,measuring approximately 6 square feet,and a sign painted on a fence, measuring approximately 4 square feet,in an entryway to the outdoor beer garden(see exhibit E-2). On the Prairie Street elevation, the applicant is proposing to establish a total of 6 wall signs for a total of 241 square feet (see exhibits F, G, and H). Additionally, a conditional use for a master signage plan was granted in 2003 (Ordinance 23-03)to allow the signs which currently exist on the building. The existing ordinance must be repealed if signs are to be added to the Prairie Street elevation. FINDINGS After due notice, as required by law, the Zoning and Subdivision Hearing Board conducted public hearings in consideration of Petition 11-04 on February 18, 2004. The applicant testified at the public hearing and presented documentary evidence in support of the application. The Community Development Group submitted a Conditional Use Review dated February 13, 2004. The Zoning and Subdivision Hearing Board has made the following findings: A. Zoning History Findings. B. Surrounding Land Use and Zoning Findings. The subject property is located within the Center City and is zoned CC1 Center City District. The properties located to the north, east, and west are zoned CC 1 and are developed with commercial uses and a parking lot. The property to the south is zoned CC2 Center City District and is developed with a public parking lot and open space. The properties to the west and south are the subject of the proposed River Park Place residential/commercial development. The property to the southwest is the site for the proposed Festival Park. C. Trend of Development Findings. The subject property is located at the south end of the commercial core of Elgin's center city. The trend of development for the downtown is the continuation of revitalization. New residential uses and additional commercial and recreational uses are envisioned for the immediate area. D. Zoning District Findings. The purpose of the CC1 Center City District is to facilitate the implementation of the official comprehensive plan for the center city, as focused on a distinctive subarea of the city with a common urban fabric.The CC 1 zoning district provides for a concentration of finance, service, retail, civic, office, and cultural uses in addition to complementary uses such as hotels,entertainment,and housing.The development standards are intended to encourage a mix of activity in the area while providing for quality development that maintains a sense of history, human scale and pedestrian-oriented character. STANDARD FOR A CONDITIONAL USE FOR A MASTER SIGNAGE PLAN Master Signage Plans may be established to provide an opportunity for a creative approach to signage which may not conform to all of the provisions of other sections of the sign ordinance. Findings. It is the opinion of the Zoning and Subdivision Hearing Board that the proposed master signage plan meets the standards for a conditional use for a master signage plan. 3 s 4 Findings of Fact Zoning and Subdivision bearing Board Petition 11-04 February 18, 2004 41111) The Prairie Rock Brewing Company is currently used as a bar with an outdoor beer garden in the western portion of the building and a restaurant/banquet area in the eastern portion of the building. The applicant is proposing to improve the image of the restaurant. In doing so, the applicant is requesting that additional signage be allowed on the building to better identify the new image of the restaurant. Staff believes that the proposed signage represents a creative approach to the use of signs. Grove Street Elevation: The sign ordinance allows a maximum of 2 wall signs on the Grove Street elevation, with a total allowable surface area of 80 square feet. The ordinance prohibits painted wall signs. The applicant is requesting a total of 4 signs (a 100% departure) with a total of approximately 26 square feet in surface area. The applicant is proposing to maintain the existing 12.5 square foot projecting wall sign and to add a suspended sign,measuring approximately 3.75 square feet,on the bottom of the projecting sign.Additionally,the applicant is proposing a painted wall sign,measuring approximately 6 square feet,and a sign painted on a fence,measuring approximately 4 square feet,in an entryway to the outdoor beer garden. Prairie Street Elevation: 41)The sign ordinance allows a maximum of 2 wall signs on the Prairie Street elevation, with a total allowable surface area of 80 square feet. The sign ordinance prohibits a sign from covering the outside of an architectural feature, such as a window. The applicant is proposing a total of 6 wall signs(a 300%departure)with a total of 241 square feet (a 301% departure). MITIGATION STANDARD The approval of a conditional use for a master signage plan is subject to the condition that the requested departures are mitigated by an equivalent and more restrictive application of other regulations of the ordinance. Findings. It is the opinion of the Zoning and Subdivision Hearing Board that mitigation has been proposed which is sufficient for the requested conditional use for a master signage plan. The applicant is proposing to remove an existing 75 square foot wall sign from the Prairie Street elevation. 4 Findings of Fact Zoning and Subdivision bearing Board Petition 11-04 February 18, 2004 SUMMARY OF FINDINGS,UNRESOLVED ISSUES,AND ALTERNATIVES The Zoning and Subdivision hearing Board has developed or identified the following findings, unresolved issues, and alternatives: A. Within the existing building Prairie Rock has rexperienced growth over the past few years in two of the three areas that are currently in operation. The group sales division has increased 15% over the past two years, anticipating and reacting to the needs of the area. The bar&grill area has increased 18% over the past two years. Both venues continue to grow and we anticipate double-digit growth this upcoming year. The one area that has not seen growth is the main dining room. We feel that a new identity is necessary for the restaurant to reach its growth potential. The new concept will be named Prairie Street Chop House. Our intension is to create a cook your own steak house that offers the finest cuts of meat; fresh fish; kabobs and marinated chicken breast. Guests will have the option of grilling their own steaks; seafood and chicken or upon request, one of our Chefs will grill their food at no charge. We've seen a lot of 14 growth in the banquet business, 15 to 18 15 percent between the two. The beer garden 16 started off had a great summer last year, so 17 we anticipate more great things this year. 18 We have a lot of plans for out there as far 19 as that venue is concerned. 20 So the growth -- the problem with the 21 growth area and the restaurant now is the 22 restaurant as far as creating the energy and 23 excitement . I have an Elgin residence. 10 I also oversee our Schaumburg location, but I 11 spend probably 70 percent of my time here. 12 And what we 'd like to do is retool the 13 restaurant portion of the business, leave the 14 bar and grill the way it is. We ' re proposing 15 that we change the sign over the bar and 16 grill from "brewing company" to "bar and 17 grill . " There is currently an entrance 18 there, a door that is used to facilitate an 19 outdoor patio that we 've removed the fence 20 from that, which has really cleaned up the 21 front of the restaurant, in my opinion. 22 We would like to create that as an 23 entrance to the bar and grill as a separate 24 entity.
