S30-03 Ordinance No. S30-03 AN ORDINANCE VACATING A PORTION OF A PUBLIC STREET (Franklin Street) WHEREAS, the public interest will be served by vacating a portion of a public street in the City of Elgin, Kane County, Illinois, as shown in Exhibit "A" attached hereto; and WHEREAS, said property is not necessary to serve the public . NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS : Section 1 . That a portion of a public street in the City of Elgin, Kane County, Illinois, legally described as follows : That part of Franklin Street lying West of the West line of Grove Avenue (formerly River Street) as platted in P.J. Kimballs Jr. Third Addition to Elgin being a subdivision of part of Sections 11, 13 and 14 in Township 41 North, Range 8 East of the Third Principal Meridian situated in the City of Elgin, Kane County, Illinois re. be and the same is hereby vacated. Section 2 . That the previously disconnected sanitary sewer line and water line located in the right-of-way vacated by this ordinance be and are hereby abandoned in place with the city hereby disclaiming any and all further rights, obligations or responsibility to the future use, maintenance, repairs, removal, upgrade and/or replacement of such previously disconnected sanitary sewer line and/or water line. Section 3 . That this ordinance shall not become effective until the closing of the land exchange agreement between the City of Elgin and the Gail Borden Public Library District and thereafter a certified copy of this ordinance, a plat of said vacated right- of-way and a special warranty deed shall be filed with the Recorder of Deeds of Kane County, Illinois, and thereupon the Gail Borden Public Library District, a body corporate and politic, as the owner of the parcels of property abutting such portion of Franklin Street vacated by this ordinance shall acquire title to the entire area of Franklin Street vacated by this ordinance . Section 4 .
