AN ORDINANCE
VACATING PORTIONS OF CERTAIN PUBLIC STREETS AND AN ALLEY
(Water Street, Brook Street and Alley)
WHEREAS, the public interest will be served by vacating Water
Street and a portion of Brook Street and a portion of a public
alley in the City of Elgin, Kane County, Illinois, as shown in
Exhibit "A" attached hereto; and
WHEREAS, said property is not necessary to serve the public
for the purposes of public streets and a public alley.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS :
Section 1 . That Water Street and a portion of Brook Street
and a portion of a public alley in the City of Elgin, Kane County,
Illinois, legally described as follows :
Of a 16 . 50 foot wide public alley lying East of the
East line of Grove Avenue, West of the East line of Brook
Street, South of the South line of Lots 63 through 68
both inclusive and North of the North line of Lots 73
through 78 both inclusive all in Phineas J. Kimballs
Addition 2nd Addition Elgin Illinois, being a subdivision
of part of Section 14, Township 41 North, Range 8 East of
the Third Principal Meridian in the City of Elgin, Kane
County, Illinois .
Also
A 49 . 50 foot wide public street known as Water
Street lying East of the East line of Grove Avenue, South
of the South line of Lots 74 through 78 both inclusive,
North of the North line of Lots 79 through 83 both
inclusive and West of the West line of Brook Street as
platted in Phineas J. Kimballs Addition 2nd Addition
Elgin Illinois, being a subdivision of part of
Section 14, Township 41 North, Range 8 East of the Third
Principal Meridian in the City of Elgin, Kane County,
Illinois .
Also
A variable width public street known as Brook Street
lying West of the West line of unnumbered lot, North of
the North line of Symphony Way (formerly North Street) ,
East of the East line of Lot 74 and 83 and the East line
of Water Street and South of the South line of Lot 73
excepting therefrom that part vacated per Document No.
990460 as platted in Phineas J. Kimballs Addition 2nd
Addition Elgin Illinois, being a subdivision of part of
Section 14 , Township 41 North, Range 8 East of the Third
Principal Meridian in the City of Elgin, Kane County,
Illinois .
Also
A variable width public street known as Brook Street
described as follows : Lots 68 and 73 in Phineas J.
Kimballs Addition 2nd Addition Elgin Illinois, being a
subdivision of part of Section 14 , Township 41 North,
Range 8 East of the Third Principal Meridian excepting
therefrom the westerly 8 . 00 feet thereof and that part
lying North of a line described as follows : Commencing
at the northwest corner of Lot 63 in said Phineas J.
Kimballs Addition 2nd Addition Elgin Illinois; thence
South 00 degrees 00 minutes 14 seconds East, along the
West line of said Lot 63 , a distance of 62 . 56 feet for
the point of beginning of said line; thence South 89
degrees 52 minutes 12 seconds East on a line that
intersects with the East line of Lot 51 in said
Phineas J. Kimballs Addition 2nd Addition Elgin Illinois
at a point 61 . 93 feet South, as measured along said East
line, of the northeast corner of said Lot 51, a distance
of 728 . 02 feet for the terminus of said line in the City
of Elgin, Kane County, Illinois .
be and the same is hereby vacated.
Section 2 . That a certified copy of this ordinance together
with a plat of said vacated right of way be filed with the Recorder
of Deeds of Kane County, Illinois .
Section 3 . That this ordinance shall be in full force and
effect from and after its passage in the manner .rovid-d by law.
