G87-03 te- AN ORDINANCE IMPOSING FINES FOR PARKING VIOLATIONS ON DESIGNATED SNOW ROUTES BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS : Section 1 . That Chapter 11 . 60 of the Elgin Municipal Code, 1976, as amended, entitled "Stopping, Standing and Parking, " be and is hereby amended by deleting subsection (E) of Section 11 . 60 . 090, entitled, "Snow Emergency Routes . " Section 2 . That Chapter 11 . 62 of the Elgin Municipal Code, 1976, as amended, entitled "Administrative Adjudication, " be and is hereby amended by amending Section 11 . 62 . 110 , entitled, "Schedule of Fines and Penalties, " to read as follows : A. The violation of any provision of this title, as amended, restricting or regulating the standing or parking of vehicles or the condition or use of equip- ment on a vehicle and the violation of any provision of the Illinois Compiled Statutes governing the stand- eft ing or parking of vehicles or the condition or use of equipment on a vehicle adopted by reference in this title shall be an offense punishable by the fine in the amount of twenty dollars ($20 . 00) . B. Notwithstanding the provisions of subsection A of this section, a violation of section 11 . 60 . 155 or 11 . 60 . 156 of this title, as amended, shall be an offense punish- able by a fine in the amount of one hundred dollars ($100 . 00) . C. Notwithstanding the provisions of subsection A of this section, a violation of section 11 . 40 . 095 of this ti- tle, as amended, shall be an offense punishable by a fine in the amount of two hundred fifty dollars ($250 . 00) . The owner of a vehicle impounded in connec- tion with the violation of section 11 . 40 . 095 of this title, as amended, shall also be liable for fees for the towing and storage of the vehicle as provided in section 11 . 40 . 095 of this title . D. Notwithstanding the provisions of subsection A of this section, a violation of section 11 . 60 . 090 of this ti- tle, as amended, shall be an offense punishable by a fine in the amount of fifty dollars ($50 . 00) . The owner of a vehicle impounded in connection with the violation of section 11 . 60 . 090 of this title, as amended, shall also be liable for fees for the towing and storage of the vehicle as provided in section 11 . 60 . 090 of this title . E. Failing to pay the indicated fine within twenty one (21) days of the issuance of the determination of li- ability and the exhaustion of or the failure to ex- haust any administrative review procedures as set forth in section 11 . 62 . 090 of this chapter shall re- sult in the imposition of a late payment penalty fee in addition to the fine as follows : 1 . A penalty of thirty dollars ($30 . 00) shall be im- posed if the fine is paid more than twenty one (21) days following the issuance of the determi- nation of liability but within forty two (42) days following the issuance of the determination of liability. 2 . A penalty of fifty five dollars ($55 . 00) shall be imposed if the fine is paid more than forty two (42) days following the issuance of the determi- nation of liability but within sixty three (63) days following the issuance of the determination of liability. 3 . A penalty of eighty dollars ($80 . 00) shall be im- posed if the fine is paid more than sixty three (63) days following the issuance of the determi- nation of liability. F. Notwithstanding the provisions of subsection E of this section, failing to pay the indicated fine for a vio- lation of section 11 . 60 . 155 or 11 . 60 . 156 of this ti- tle, as amended, within twenty one (21) days of the issuance of the determination of liability and the ex- haustion of or the failure to exhaust any administra- tive review procedures as set forth in section 11 . 62 . 090 of this chapter shall result in the imposi- tion of a late payment penalty fee in addition to the fine as follows : 1 . A penalty of fifty dollars ($50 . 00) shall be im- posed if the fine is paid more than twenty one 2 (21) days following the issuance of the determi- nation of liability but within forty two (42) days following the issuance of the determination of liability. 2 . A penalty of one hundred dollars ($100 . 00) shall be imposed if the fine is paid more than forty two (42) days following the issuance of the de- termination of liability but within sixty three (63) days following the issuance of the determi- nation of liability. 3 . A penalty of one hundred fifty dollars ($150 . 00) shall be imposed if the fine is paid more than sixty three (63) days following the issuance of the determination of liability. G. Notwithstanding the provisions of subsection E of this section, failing to pay the indicated fine for a vio- lation of section 11 . 60 . 090 this title, as amended, within twenty one (21) days of the issuance of the de- termination of liability and the exhaustion of or the failure to exhaust any administrative review proce- dures as set forth in section 11 . 62 . 090 of this chap- ter shall result in the imposition of a late payment penalty fee in addition to the fine as follows : 1 . A penalty of twenty-five dollars ($25 . 00) shall be imposed if the fine is paid more than twenty one (21) days following the issuance of the de- termination of liability but within forty two (42) days following the issuance of the determi- nation of liability. 2 . A penalty of fifty dollars ($50 . 00) shall be im- posed if the fine is paid more than forty two (42) days following the issuance of the determi- nation of liability but within sixty three (63) days following the issuance of the determination of liability. 3 . A penalty of seventy-five dollars ($75 . 00) shall be imposed if the fine is paid more than sixty three (63) days following the issuance of the de- termination of liability. r 3 Section 3 . That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. Section 4 .
