I further certify that on May 8, 2002, the Corporate Authorities of such municipality passed and approved Ordinance No. G33-02, which provided by its terms that it should be published in pamphlet form. The pamphlet form of Ordinance No. G33-02, including the Ordinance and a cover sheet thereof, was prepared, and a copy of such Ordinance was posted in the municipal building commencing on May 10, 2002, and continuing for at least ten days thereafter. Municipal ' ler (SEAL) r Ordinance No. G33-02 AN ORDINANCE AMENDING CHAPTER 3 . 03 OF THE ELGIN MUNICIPAL CODE, 1976, AS AMENDED, ENTITLED "ATTENDANCE AT MEETINGS" WHEREAS, the City of Elgin is a home rule unit and may therefore exercise any power and perform any function pertaining to its government and affairs; and WHEREAS, the City Council of the City of Elgin has determined that it is necessary and desirable to provide for certain procedures, regulations and qualifications relating to the city' s boards, commissions and committees; and WHEREAS, procedures, regulations and qualifications relating to the city' s boards, commissions and committees pertain to the government and affairs of the city. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1 . That Chapter 3 . 03 of the Elgin Municipal Code, 1976 , as amended, entitled "Attendance at Meetings" be and is hereby further amended in its entirety to read as follows : "Chapter 3 . 03 GENERAL PROVISIONS 3 . 03 . 010 APPLICATION. The provisions of this Chapter shall apply to the city boards, commissions and committees set forth in Title 3 of this code, except for the Police Pension Board and the Firemen' s Pension Board, and to the Property Maintenance Board of Appeals . 3 . 03 . 020 MINIMUM ATTENDANCE REQUIREMENTS . Any member who fails to attend two-thirds of the meetings of a board, commission or committee including regular, special or emergency meetings in any calendar year shall be deemed to have abandoned his office thereby creating a vacancy unless a majority of the city council, after consideration of the relevant facts and circumstances, votes to retain such member in his office, in which case no abandonment shall be deemed. Such requirements shall not apply to ex officio members of boards, commissions and committees . 3 . 03 . 030 NO COMPENSATION. Unless otherwise specifically provided for by an ordinance of the city council members of all city boards, commissions or committees shall serve without compensation. 3 . 03 . 040 TERMS . The terms of the members of city boards, commissions or committees shall be as set forth in the ordinance establishing such board, commission or committee, provided, however, all members shall continue in such capacity until their successor has been duly appointed and qualified. Any member of a city board, commission or committee appointed to fill a vacancy prior to the expiration of the term for which his predecessor was appointed shall serve for the remainder of such term. 3 . 03 . 050 LIMITATION ON TERMS . Members of any city board, commission or committee shall be limited to a maximum term of six years as a member of the same board, commission or committee and an additional six years as chairman of the same board, commission or committee . For the purpose of determining the length of service an unexpired term shall not be included in making such determination. Such limitation shall not apply to ex-officio members of boards, commissions and committees and to members of the board of health, building commission, board of stationary engineers and the property maintenance board of appeals . 3 . 03 . 060 RESIDENCY REQUIRED. All members of any city board, commission or committee shall be required as a condition of their original appointment and continued membership of a board, commission or committee to have and to maintain their bona fide residence and principal place of abode within the corporate city limits of the City of Elgin. The residency requirement provided for in this section shall not apply, however, to members of any city board, commission or committee when the city council determines in its discretion that such members require specific professional or technical training or knowledge . 3 . 03 . 070 REMOVAL. The city council, in its discretion, may remove any member of a city board, commission or committee for failure to meet the qualifications for membership, for incompetence, neglect of duty, or malfeasance in office or when such removal is in the best interests of the city. A member shall be provided notice as to the proposed reason or grounds for removal and opportunity to be heard prior to any such removal . 3 . 03 . 080 MEETING PROCEDURES . A board, commission or committee may establish rules regarding the conduct of meetings and where not otherwise provided Robert' s Rules of Order, Newly Revised, shall apply. Minutes shall be taken at all meetings . All meetings of a board, commission or committee established by the city council shall be conducted in accordance with the Open Meetings Act . 3 . 03 . 090 TRAVEL. Members of city boards, commissions or committees shall not travel out of state at city expense unless otherwise specifically provided for by an ordinance of the City Council and a budget appropriation has previously been made for the proposed out of state travel . " Section 2 . That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. Section 3 .
