AN ORDINANCE
AMENDING CHAPTER 6 . 06 OF THE ELGIN MUNICIPAL CODE, 1976
AS AMENDED, ENTITLED "ALCOHOLIC LIQUOR DEALERS"
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS :
Section 1 . That Chapter 6 . 06 of the Elgin Municipal Code,
1976, as amended, entitled "Alcoholic Liquor Dealers, " be and is
hereby amended by amending Section 6 . 06 . 115 , entitled, "BASSET
Training Requirements, " to read as follows :
A. The original or renewal license application for
a Class A, AA, B, B-1, C, D, E, E-1, F, G, H, I , J, K, L,
N, N-1, 0, P, Q, R, S and T license shall be accompanied
with proof of completion of a State certified "Beverage
Alcohol Sellers and Service Education and Training
Program" (BASSET) for all persons who serve or sell
alcoholic beverages pursuant to that license, subject to
the following provisions :
1 . Proof of completion of a State certified
tow "Beverage Alcohol Sellers and Service Education and
Training Program" (BASSET) shall not be required
for each person serving or selling alcoholic
beverages pursuant to a Class H, I or L license
provided any such person is at all times supervised
in the serving or selling of alcoholic beverages by
not less than one person present at the alcohol
sales or service area on the licensed premises and
provided such supervisor has successfully completed
a State certified "Beverage Alcohol Sellers and
Service Education and Training Program" (BASSET) .
2 . An original or renewal application for a
Class H, I or L license shall identify each person
who will be supervising the serving or selling of
alcoholic beverages at the alcohol sales or service
area on the licensed premises . Notwithstanding the
provisions of subparagraph B of this section, each
such designated supervisor shall submit proof of
his or her successful completion of a State
certified "Beverage Alcohol Sellers and Service
Education and Training Program" (BASSET) at the
time the original or renewal application is filed.
B. New employees or managers of a licensee, who
are required to complete BASSET training, shall within
sixty (60) days from the beginning of their employment
with that licensee complete the BASSET program, and shall
until completion of the BASSET program work under the
supervision of a person who has completed the BASSET
program.
C. A photocopy of evidence of completion of the
BASSET program must be filed with the city clerk within
twenty one (21) days of completion of the BASSET program.
D. Employees or managers of the licensee who have
completed the BASSET program shall maintain evidence of
completion of the BASSET program on the premises of the
licensee or on their person while on the premises of the
licensee .
Section 2 . That all ordinances or parts of ordinances in
conflict with the provisions of this ordinance be and are hereby
repealed.
Section 3 . That this ordinance shall be in full force and
effect on June 1, 2002 upon its passage and publication in the
manner provided by law.
