G58-01 AN ORDINANCE AMENDING CHAPTER 6.06 OF THE ELGIN MUNICIPAL CODE, 1976 AS AMENDED, ENTITLED "ALCOHOLIC LIQUOR DEALERS"" PASSED BY THE CITY COUNCIL OF THE CITY OF ELGIN ON THIS 8TH DAY OF AUGUST 2001 Published in pamphlet form by authority of the City Council of the City of Elgin, Kane and Cook Counties, Illinois, on this 10th day of August 2001. I further certify that on August 8, 2001, the Corporate Authorities of such municipality passed and approved Ordinance No. G58-01, which provided by its terms that it should be published in pamphlet form. The pamphlet form of Ordinance No. G58-01, including the Ordinance and a cover sheet thereof, was prepared, and a copy of such Ordinance was posted in the municipal building commencing on August 10, 2001, and continuing for at least ten days thereafter. Municipal Clerk (SEAL) AW �+ Ordinance No. G58-01 f AN ORDINANCE AMENDING CHAPTER 6 . 06 OF THE ELGIN MUNICIPAL CODE, 1976 AS AMENDED, ENTITLED "ALCOHOLIC LIQUOR DEALERS" BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS : Section 1 . That Chapter 6 . 06 of the Elgin Municipal Code, 1976, as amended, entitled "Alcoholic Liquor Dealers, " be and is hereby amended to add Section 6 . 06 . 129, entitled, "Posting of Notice Regarding Preservation of the Peace on Licensed Premises, " to read as follows : "Every licensee holding a class of license permitting the consumption of alcohol on the licensed premises shall display at all times in a prominent place on the licensed premises a printed sign which shall read substantially as follows : Liquor License Holder' s Duty to Maintain Peace on the Premises ep" The Elgin Municipal Code imposes a duty on all liquor license holders and their employees to maintain the licensed premises in a peaceable and orderly manner. License holders and their employees are required to prevent any patron, employee or member of the public on the licensed premises from committing any criminal act or any other act which act done in such an unreasonable manner that it alarms or disturbs another or provokes a breach of the peace. A liquor license holder or employee of any licensee who observes any type of criminal activity or fighting on the licensed premises is required to immediately notify the City of Elgin Police Department of such conduct . Failure to report any such incident shall subject the licensee to the revocation or suspension of the retail alcoholic liquor dealer' s license, as well as a possible fine from the City of Elgin Local Liquor Control Commission. " Section 2 . That Section 6 . 06 . 050 of the Elgin Municipal Code, 1976, as amended, entitled "Licenses—Number to be Issued, " be and is hereby amended by amending subparagraph B to read as follows : B. The number of Class B licenses shall not exceed nineteen (19) in number. " Section 3 . That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. Section 4 . That this ordinance shall be in full force and effect upon its passage and publication in the manner provided by law.
