AN ORDINANCE
ANNEXING CERTAIN TERRITORY TO THE CITY OF ELGIN
(Mulberry Grove)
WHEREAS, a petition signed by all the owners of record of
certain territory has been filed with the City Clerk
requesting annexation of said territory to the City of Elgin,
Illinois; and
WHEREAS, said petition includes therein a statement under
oath by all the owners of record that no electors reside on
the subject territory; and
WHEREAS, said territory is contiguous to the City of
Elgin and is not within the corporate limits of any
municipality; and
WHEREAS, legal notice of the intent of the City of Elgin
to annex said territory have been forwarded to all public
bodies required to receive said notice in the manner provided
by law.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS :
Section 1 . That the territory and lands described as
follows be and are annexed to and made a part of the City of
Elgin and the boundaries of the City of Elgin be and are
hereby enlarged and extended to include in the corporate
boundaries of the City of Elgin said territory:
That part of the North Half of the Southwest
Quarter and of the Southeast Quarter of the
Southwest Quarter of Section 33 , Township 41 North,
Range 8 East of the Third Principal Meridian, lying
northerly of the northerly line of the right-of-way
of the Illinois Central Railway Company, in the
township of Elgin, Kane County, Illinois and more
particularly described as follows :
Commencing at the Northwest Corner of the
Southwest Quarter of said Section 33 ; thence North
88 degrees 53 minutes 02 seconds East, 89 . 35 feet
along the North line of said Southwest Quarter to a
point on the East line of Randall Road as shown on
an unrecorded plat of highways, said point also
being the point of beginning; thence North 88
degrees 53 minutes 02 seconds East, 2 , 564 . 65 feet
continuing along said North line to the center of
said Section 33 , said point being 3 . 22 feet East of
the center of section as monumented by Woodbridge
South Unit 4 recorded January 3 , 1994 as Document
No. 94K000311 ; thence South 00 degrees 02 minutes 05
seconds West, 2 , 368 . 85 feet along the East line of
said Southwest Quarter to a point 279 . 79 feet North
of the Southeast Corner of the Southwest Quarter of
said Section 33 ; thence North 89 degrees 57 minutes
55 seconds West, 252 .26 feet to a point on the
northeasterly line of the Illinois Central Railway
Company (now Chicago, Central and Pacific Railroad
Company) right of way per Document No . 1752213 ;
thence North 46 degrees 34 minutes 21 seconds West,
586 . 50 feet along said northeasterly line to a point
of curvature; thence northwesterly 837 . 80 feet
continuing along said northeasterly line, being a
curve concave Southwest, having a radius of 5, 815 . 40
feet and a chord bearing North 60 degrees 41 minutes
59 seconds West, 837 . 07 feet to a point on the East
Line of land conveyed to Chicago, Madison and
Northern Railroad Company (now Chicago, Central and
Pacific Railroad Company) by deed recorded as
Document No. 24977; thence North 00 degrees 00
minutes 43 seconds West, 84 . 62 feet along said East
Line; thence South 88 degrees 51 minutes 25 seconds
West, 190 . 35 feet along the North line of land
conveyed by said Document No . 24977 to a point on
the aforesaid northeasterly line of the Illinois
Central Railway Company right of way; thence
northwesterly 12 . 99 feet along said northeasterly
line, being a non-tangential curve concave
Southwest, having a radius of 5, 775 . 40 feet and a
chord bearing North 56 degrees 52 minutes 64 seconds
West, 12 . 99 feet to a point of tangency; thence
North 56 degrees 56 minutes 46 seconds West,
1, 264 . 29 feet continuing along said northeasterly
eft. line to a point on the aforesaid East line of
Randall Road; thence North 00 degrees 05 minutes 41
seconds West, 302 . 30 feet along said East Line to a
point of curvature; thence northerly 306 . 92 feet
continuing along said East Line, being a curve
concave East, having a radius of 1, 870 . 08 feet and a
chord bearing North 04 degrees 36 minutes 25 seconds
East, 306 . 57 feet to the point of beginning.
Section 2 . That a certified copy of this ordinance
together with an accurate map of said territories shall be
filed with the Recorder of Deeds, Kane County, Illinois .
Section 3 . That this ordinance shall be in full force
and effect immediately after its passag ' n he manner
