NOW, THEREFORE, BE IT ORDAINED BY TH; CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1 . That no territory descri.ed and identified in Exhibit A, attached hereto and made pa t hereof, shall be permitted to connect to or otherwise us: the sanitary sewer described herein until such time as paymen is made to Owner of an amount allocated as the fair proport onate share of said improvements as set forth in Exhibit B, attached hereto and made a part hereof by reference. Proper ies not included in the service area in Exhibit A are not enti led to tap into this sewer line without a written agree ent for fees and reimbursement previously approved by Owner. Section 2 . That any property held n common ownership with other adjoining property subject to th- provisions of this ordinance on the effective date of this ordinance shall be subject to payment based on the entire amount established for the entire parcel as provided in this ordin.nce. Section 3 . That any person desiring to pay the amount allocated to any property subject to this ordinance may do so without interest if payment is made prior t. acceptance of said sewer by the City of Elgin. If full payme t is not made prior to acceptance of said sewer by the City of Elgin, then payment shall be made in full plus interest at the rate of seven ( 7%) percent per annum accruing from and after the date that the sanitary sewer described herein is a• cepted for public ownership and maintenance. Section 4 . That any amounts received •y Owner pursuant to this ordinance shall be considered reimbu sement for the cost and expense of extending the sanitary sewer described above. Section 5 .
