G83-98 Ordinance No. G83-98 AN ORDINANCE GRANTING A CONDITIONAL USE FOR A COMMERCIAL PLANNED DEVELOPMENT ( 975 North Randall Road) WHEREAS, written application has been made for an AB Area Business District conditional use for a commercial planned development for a retail/commercial building and accessory off-street parking at 975 North Randall Road; and WHEREAS, the Zoning and Subdivision Hearing Board conducted a public hearing after due notice by publication and has submitted its findings of fact and recommended approval; and WHEREAS, the City Council of the City of Elgin concurs in the findings and recommendation of the Zoning and Subdivision Hearing Board. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1 . That the City Council of the City of Elgin hereby adopts the findings of fact made by the Zoning and Subdivision Hearing Board, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. Section 2 . That a conditional use for a commercial planned development for a retail/commercial building and accessory off-street parking at 975 North Randall Road and legally described as follows : LOT 563 IN VALLEY CREEK UNIT 14 , BEING A SUBDIVISION OF PART OF SECTION 9 , TOWNSHIP 41 NORTH, RANGE 8 EAST OF THE THIRD PRINCIPAL MERIDIAN, IN THE CITY OF ELGIN, KANE COUNTY, ILLINOIS. be and is hereby granted subject to the following conditions : 1 . Substantial conformance with the Statement of Purpose and to the Development Plan prepared by Chipman Adams Ltd. , received August 5, 1998 . 2 . Plan for Retail/Commercial Building, prepared by Chipman Adams Ltd. , dated received August 5, 1998 BACKGROUND An application has been filed by Greenwood Realty Development, Inc. requesting a conditional use for a commercial planned development in the AB Area Business District. The subject property is located at 975 North Randall Road (reference Exhibits A, B and C) . The applicant proposes to develop the subject property with a 10,000 square foot retail/commercial building and accessory off-street parking. The applicant proposes to limit occupancy to business , office, or mercantile-type retail uses . No restaurants are to be allowed as occupants (reference Exhibit D) . FINDINGS e' . After due notice, as required by law, the Zoning and Subdivision Hearing Board held a public hearing in consideration of Petition 56-98 on August 19 , 1998 . The applicant testified at the Exhibit A FINDINGS/PZTEXT/3000DV.SV/3200PD.PC/3220CN.US/32200ON. 98/PET56 .98 hearing and presented documentary evidence in support of the ,s' application. The Planning Department has submitted a Conditional Use Review, dated July 30, 1998 and revised August 19, 1998 . The Zoning and Subdivision Hearing Board has made the following findings concerning the requested conditional use for a commercial planned development: A. Site Characteristics Standard. The suitability of the subject property for the intended conditional use for a planned development with respect to its size; shape; significant natural features including topography, watercourses and vegetation; and existing improvements . Findings. The subject property is comprised of 47,674 square feet of land, located within a 34 acre commercial subdivision and zoning lot (Valley Creek Unit 14) . The at-grade elevation of the building site is approximately 15 feet lower than the at-grade elevation of the Randall/Royal intersection. The subject property is currently unimproved. B. Sewer and Water Standard. The suitability of the subject property for the intended conditional use for a planned development with respect to the availability of adequate municipal water, wastewater treatment and stormwater control em- facilities . Findings. The subject property can be served with sanitary sewer and municipal water systems . C. Traffic and Parking Standard. The suitability of the subject property for the intended conditional use for a planned development with respect to the provision of safe and efficient on site and off site vehicular circulation designed to minimize traffic congestion. Findings. The subject property is located within Unit 14 of Valley Creek Subdivision. The subdivision unit is bounded by Randall Road (limited access arterial street) , Royal Boulevard (collector street) , and Fletcher Drive (local street) . Access to the subdivision unit is limited to Royal Boulevard and Fletcher Drive. The development plan provides adequate parking to serve the proposed uses . D. Zoning History Standard. The suitability of the subject property for the intended conditional use for a planned development with respect to the zoning history of the property. Findings. The subject property was zoned as follows for the years listed: FINDINGS/PZTEXT/3000DV.SV/3200PD.PC/3220CN.US/3220O0N. 98/PET56 .98 emk 1978 Annexed, B-3 Service Business District 1992 B-3 Service Business District Present AB Area Business District The subject property is part of a conforming zoning lot. E. Surrounding Land Use and Zoning Standard. The suitability of the subject property for the intended conditional use for a planned development with respect to consistency and compatibility with surrounding land use and zoning. Findings. The areas located to the north, south and east of the subject property are zoned AB Area Business District. These areas are developing with commercial service, business, and retail uses . The area located to the west of the subject property is zoned PORI Planned Office Research and Industrial District. The area is developed with a corporate office building. F. Trend of Development Standard. The suitability of the subject property for the intended conditional use for a planned development with respect to consistency with an existing pattern of development or an identifiable trend of development in the area. Findings. The subject property is located within a developing commercial area. G. Zoning Districts Standard. The suitability of the subject property for the intended conditional use for a planned development with respect to conformance to the provisions for the purpose and intent, and the location and size of a zoning district. Findings. The purpose of the 'AB Area Business District is to provide commodities and services to several neighborhoods, and in some instances to a community wide or regional supporting population. H. Comprehensive Plan Standard. The suitability of the subject property for the intended conditional use for a planned development with respect to conformance to the goals, objectives, and policies of the official comprehensive plan. Findings. The subject property is designated as "area business center" by the Official Comprehensive Plan of Elgin. I. Location, Design, and Operation Standard. The suitability elk of the subject property for the intended conditional use for a planned development with respect to it being located, designed, and operated so as to promote the purpose and intent of this title and chapter. FINDINGS/PZTEXT/3000DV.SV/3200PD.PC/3220CN.US/3220O0N. 98/PET56 .98 Finding. The Planning Department does not make findings regarding the location, design, and operation of a proposed conditional use. PLANNED DEVELOPMENT DEPARTURES AND EXCEPTIONS A planned development may be granted certain departures from the normal standards, regulations, requirements, and procedures of the Elgin Municipal Code. The applicant is requesting departures from the following sections of the municipal code regulating development in the AB Area Business District: o 19 . 12.300 (E) Principal Buildings per Zoning Lot. In all business districts, no more than one principal building is allowed on a zoning lot. The intended use will add an additional building on the zoning lot (Valley Creek Subdivision Unit 14, which now includes Walmart, Sears Hardware, and Elliot's restaurant) . o 19. 12.400 (D) Setbacks from a Private Street or Driveway. A minimum 20 foot building setback is required from the curb line of the shared driveway accessing Royal Boulevard. The proposed building is set back 14 feet 8 inches from the curb line. o 19 .35.435 (E. 1) Building Street Setback. The required rft. building setback from an adjoining street is 53 feet, based on the area of the 34 acre zoning lot. The proposed building is set back 42 feet from the Royal Boulevard right of way, and 38 feet from the Randall Road right of way. • RECOMMENDATION The Zoning and Subdivision Hearing Board recommends the approval of Petition 56-98 . On a motion to recommend the approval of Petition 56-98, subject to the following conditions, the vote was five (5) yes and zero (0) no: 1. Substantial conformance with the Statement of Purpose and to the Development Plan prepared by Chipman Adams Ltd. , dated received August 5, 1998 . 2 .
