G71-98 . a ..� look Ordinance No. G71-98 AN ORDINANCE GRANTING A CONDITIONAL USE FOR A PLANNED DEVELOPMENT ( 339 Sadler Avenue) WHEREAS, written application has been made for an MFR Multiple Family Residence District conditional use for a planned development at 339 Sadler Avenue; and WHEREAS, the Zoning and Subdivision Hearing Board conducted a public hearing after due notice by publication and has submitted its findings of fact; and WHEREAS, the City Council of the City of Elgin has considered the findings and recommendation of the Zoning and Subdivision Hearing Board. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1 . That a conditional use for a planned development at 339 Sadler Avenue and legally described as follows : LOTS 2 AND 3 IN BLOCK 1 IN LYNNDALE PARK ADDITION TO HANOVER, IN THE NORTHWEST QUARTER OF SECTION 19, TOWNSHIP 41 NORTH, RANGE 9 , EAST OF THE THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS . be and is hereby granted subject to the following conditions : A. The use and development of land and structures shall be subject to the provisions of Chapter 19 . 10, Land Use. The following enumerated "land uses" [SR] shall be the only land uses allowed as a "permitted use" [SR] : 1 . Trucking services (421) . 2 . Motor vehicle repair shop (753) , limited to the vehicles used in support of the principal use, trucking services . 3 . Commercial operations yard (UNCL) , used exclusively in support of the principal use, trucking services . B. The use and development of land and structures shall be subject to the e,,. provisions of Chapter 19 . 12, Site Design, and shall be in substantial conformance to the Statement of Purpose and Conformance prepared by Robert Gatto, dated May 18, 1998 with a Site Plan for 339 Sadler Avenue C. Compliance with all other applicable codes and ordinances . Section 2 . That the conditional use granted herein shall expire if not established within one year from the date of passage of this ordinance. Section 3 . That this ordinance shall be in full force and effect immediately after its passage in the manner provided by law.
