G16-98 Ordinance No. G16-98 AN ORDINANCE CREATING CHAPTER 16 . 36 ENTITLED ONE AND TWO FAMILY DWELLING CODE OF THE ELGIN MUNICIPAL CODE, 1976 , AS AMENDED WHEREAS, the City of Elgin may adopt by reference any published compilation of rules and regulations prepared by a nationally recognized technical trade or service association pursuant to the provisions of Article 1, Division 3 of the Illinois Municipal Code ( 65 ILCS 5/1-3-1 et seq. ) ; and WHEREAS, the CABO One and Two Family Dwelling Code, 1995 Edition establishes minimum regulations governing the fabrication, erection, construction, enlargement, alteration, repair location and use of detached one-and-two-family dwellings, their appurtenances and accessory structures; and WHEREAS, the City Council of the City of Elgin has determined it is necessary and desirable to adopt the CABO One and Two Family Dwelling Code, 1995 Edition as published by the Council of American Building Officials with the additions, insertions, deletions and changes prescribed in this ordinance; and WHEREAS, one copy of the CABO One and Two Family Dwelling e" Code, 1995 Edition has been on file with the City Clerk for more than thirty days preceding the passage of this ordinance, in accordance with Section 1-3-2 of the Illinois Municipal Code ( 65 ILCS 5/1-3-2 ) . NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1 . That Chapter 16 . 36 , entitled One and Two Family Dwelling Code, of the Elgin Municipal Code, 1976, as amended, be and is hereby created to read as follows : 16 . 36 . 010 ADOPTED-EXCEPTIONS . That a certain document, one ( 1) copy of which is on file in the office of the City Clerk of the City of Elgin, being marked and designated as the CABO One and Two Family Dwelling Code, 1995 Edition as published by the Council of American Building Officials be and is hereby adopted as and shall be known as the One and Two Family Dwelling Code, of the City of Elgin for regulating the fabrication, erection, construction, enlargement, alteration, repair location and use of detached one-and-two-family dwellings, their appurtenances and accessory structures; and each and all of the regulations , provisions, penalties, conditions and terms of said One and Two Family Dwelling Code are hereby referred to, adopted, and made a part elk hereof, as if fully set out in this ordinance, with the " additions , insertions , deletions and changes prescribed in this chapter. 16 . 36 . 020 ADDITIONS, INSERTIONS AND CHANGES . The CABO One and Two Family Dwelling Code, 1995 Edition is amended and revised in the following respects : Section 107 , entitled Right of Appeal, shall be amended to read as follows : Appeals . A person shall have the right to appeal a decision of the code official in accordance with the provisions set forth in Chapter 3 . 60, Section 3 . 60 . 050 of the Elgin Municipal Code, 1976 , as amended. Section 111 . 2 , entitled Permit Fees, shall be amended to read as follows : Permit fees shall be in accordance with the provisions set forth in Chapter 16 . 48 of this code. Section 202 , entitled General Building Definitions, shall be amended to read as follows : Habitable Room. Habitable room shall mean any room meeting the requirements of this chapter for sleeping, living, cooking or dining purposes , excluding such enclosed places as closets, pantries, bath or toilet rooms, hallways, laundries, storage spaces, utility rooms and similar spaces . The floor of all sleeping and cooking rooms shall not be more than forty-four (44" ) inches below the grade outside the room or area on at least one wall and all windows required for natural light and ventilation shall be entirely above grade. A finished basement used for recreational purposes shall constitute a habitable room. Table 301 . 2a, entitled Climatic and Geographic Design Criteria, is amended to read as follows under the respective headings : Roof Live Load - lbs . per sq. ft. - 30psf Roof Snow Load - lbs . per sq. ft. - 30psf Wind Pressure - Buildings or portions thereof less than 30 ' in height - 25 lbs . per sq. ft. ; buildings or portion thereof 30 to 49 feet in height - 35 lbs . per sq. ft . Seismic Condition by Zone - Zero Subject to Damage from Weathering - Yes- Severe -2- Frost Line Depth - 42 inches below grade Subject to Damage from Termite - Moderate to Heavy Subject to Decay - Slight to Moderate Section 303 . 1 , entitled Habitable Rooms, shall be amended by adding the following language after the word Exceptions : The following exceptions shall not be applicable to habitable rooms used for sleeping purposes . Section 303 . 3, entitled Bathrooms, shall be amended to read as follows : Bathrooms . Bathrooms, water closet compartments and similar rooms shall be mechanically vented to the exterior using wall louvers or roof caps with insect screens . Vent discharge into the attic or soffit is prohibited. Mechanical vents shall be sized to provide five (5) air changes per hour. Section 305 . 1, entitled Minimum Height, shall be amended to read as follows : Every habitable room, with the exception of habitable rooms for storage or utility, shall have a ceiling height of not less than seven ( 7 ) feet six ( 6 ) inches for at least fifty ( 50 ) percent of its required area. Not more than fifty ( 50 ) percent of the habitable rooms required area may have a sloped ceiling measuring less than seven feet six inches in height provided no portion of the habitable rooms required area is less than six ( 6 ) feet in height . Section 305 . 1, entitled Minimum Height, Exception 2 , shall be deleted in its entirety. Section 305 . 1 , entitled Minimum Height, Exception 3, shall be amended to read as follows : Ceiling height in basements without habitable spaces may not be less than seven ( 7 ) feet six ( 6 ) inches clear except for under beams , girders, ducts or other obstructions where the clear height shall be six ( 6 ) feet eight ( 8) inches . Section 309 . 1 , entitled Garages--Opening Protections, shall be amended to read as follows : Regulations Regarding Attached Garages . 0' 1 . Construction standards shall be identical to those required for dwellings . -3- eft. 2 . Six ( 6 ) inch curbing shall be provided at the service door and common walls or the garage floor shall be constructed not less than six ( 6 ) inches below the adjoining floor. 3 . Installation of a dwelling heating unit or other fuel burning appliance in the garage is prohibited. One hour fire-rated partitions between space containing house heating unit and garage space shall be installed. Doors are not permitted common to heater room or fuel burning appliance room and garage. Exception: Garage heating units with UL approval or equivalent shall be permitted. 4 . Wood frame walls and doors common to dwelling and garage: Walls shall consist of one-hour fire-rated construction or have two layers of 5/8" fire code drywall on the garage side. Where gable-type connection is used, a one-hour fire-rated bulkhead shall be established in the attic space directly above and continuous from the interior one-hour fire-rated garage wall to the underside of the roof sheathing. 5 . Where habitable rooms are constructed over the garage, the ceiling and all walls shall be of one-hour R/" fire-rated construction or have two layers of 5/8" fire code drywall on the garage side. The second layer of drywall shall be positioned perpendicular to the first layer. All joints shall be taped and spackled. 6 . Service doors common to the dwelling unit shall be one-hour fire-rated or consist of one-and-three-quarter-inch thick solid core wood door with a closer. 7 . Hot air heat duct openings shall be a minimum of four (4 ) feet above the garage floor with a B Label fire damper. Cold air returns shall be prohibited. 8 . Concrete floor: A minimum four (4 ) inches of concrete on minimum a four (4 ) inch crushed stone, sand or gravel base shall be provided. The floor area used for parking of vehicles shall be sloped to facilitate the movement of liquids toward the main vehicle entry doorway. Section 309 . 2 , entitled Garages--Separation Required, shall be amended to read as follows : Regulations Regarding Detached Frame Garages . Detached frame garages shall comply with the /f'' construction requirements for one-story dwellings with the following exceptions : -4- 1 . Garages constructed within four (4 ) feet of a residence dwelling are required to meet minimum foundation requirements for dwellings . Foundation walls and footings shall not be less than forty-two ( 42 ) inched below finish grade. The minimum foundation thickness shall be eight ( 8) inches . 2 . Grade beam construction is permitted for garages constructed more than four ( 4 ) feet from the dwelling. The grade beam design shall be as follows : twenty (20) inches deep by twenty ( 20) inches at the top and ten ( 10 ) inches at the base with two one-half inch diameter re-bars continuous around the perimeter and poured monolithically with the floor slab. Floor slab shall be a minimum four ( 4 ) inches thick with six ( 6 ) inch by six ( 6 ) inch number ten ( 10) welded wire fabric throughout. The Grade beam shall rest on undisturbed soil . Garages larger than 480 square feet require foundations to be extended to forty-two (42 ) inches below grade. A twelve-inch thick trench footing is permitted. (See Illustration A. ) 3 . The maximum spacing for studs shall be twenty four (24 ) inches O.C. and sixteen ( 16 ) inch O.C. if square footage is over 480 square feet. 4 . Wall sheathing and building paper may be omitted e" if corner bracing is used. Each corner is to be braced from the top outward in two directions to a minimum of seventy-two ( 72 ) inches from corner at sill plate, and may be applied on the inside surface of studs . The minimum bracing size shall be one ( 1) inch by four (4 ) inches . 5 . Corner posts may consist of two (2 ) two ( 2 ) inch by four( 4 ) inch posts or one ( 1) four (4 ) inch by four ( 4 ) inch post. 6 . Top plates may be single, provided rafters occur directly over the studs and the plate at the corners is lapped to provide tie. 7 . Rafter ties at eaves shall not be less than two (2 ) inches by 4 (4 ) inches with maximum spacing of six ( 6 ) feet O.C. 8 . Concrete floor: A minimum four ( 4 ) inches of concrete on minimum a four (4 ) inch crushed stone, sand or gravel base shall be provided. The floor area used for parking of vehicles shall be sloped to facilitate the movement of liquids toward the main vehicle entry doorway. Section 309 . 3, entitled Garages--Floor Surface, shall be amended to read as follows : -5- Regulations Regarding Detached Masonry or Masonry Veneer Garages . Detached masonry or masonry veneer garages shall comply with the construction requirements for one-story dwellings with the following exception: Combined foundation wall and footing shall be permitted provided it extends forty-two ( 42 ) inches below grade and the bottom is flared to sixteen ( 16 ) inches . The wall width shall be wide enough to support the wall above but shall not be less than eight ( 8 ) inches wide. Section 309 . 4 , entitled Maximum Height of Detached Residential Garages, shall be created to read as follows : The maximum height of a detached residential garage shall be fifteen ( 15) feet. (See Illustrations B and C. ) The following illustrations shall be created to supplement Sections 309 . 1 , 309 . 2 309 . 3 and 309 . 4 of this chapter: GRADE BEAM SLAB ( Illustration A) BUILDING HEIGHT "Building height" means the vertical distance measured from the established average grade at the foundation to the highest point of the underside of the ceiling beams, in the case of the flat roof; to the deck line of a mansard roof; and to the main level of the underside raters between the eaves and the ridge of a gable, hip, or gambrel roof . Chimneys, spires, towers, elevator penthouses, tanks, and similar projections other than signs shall not be included in calculating the height. Point A is the ridge of the roof . Point B is the average level of the underside of the rafters between the eaves and the ridge of the roof . Point C is the underside of the rafters at the eave. Point D is the minimum grade at the foundation. Point E is the average grade at the foundation. Point F is the maximum grade at the foundation. (Illustration B) BUILDING HEIGHTS es" Building height is the vertical distance measured from the established grade to the highest point of the -6- , roof surface for flat roofs ; to the deck line of mansard roofs; and to the average height between eaves and ridge for gable, hip and gambrel roofs . (Illustration C) Section 310 . 2 , entitled Emergency Egress Required, shall be amended by adding the following language after the words above the floor: Basements or cellars shall emergency egress by direct access to the dwellings exterior by utilizing thirty ( 3 ) inch by eighty ( 80) inch door or by utilizing a window having an openable area at least twenty-four ( 24 ) inches in width and thirty-six ( 36 ) inches in height. The sill of any window used for emergency egress shall be not more than thirty-six ( 36 ) inches above the floor. The area well outside of the egress window shall be thirty-six ( 36 ) inches in width by thirty-six ( 36 ) inches in length and shall extend from the grade to six ( 6 ) inches below the window sill . The Operation of any window used for emergency egress shall not require the use of a key or special tool . Section 314 . 2 , entitled Treads and Risers, shall be amended so that the first sentence of the section reads as follows : The maximum riser height shall be eight and one-quarter ( 8 . 25 ) inches and the minimum tread depth shall be nine ( 9 ) inches . Sections 402 , 1, 402 . 1 . 1, 402 . 1 . 2 entitled Materials, shall be deleted in their entirety. Section 403 . 1, entitled General , shall be amended by deleting the last sentence in the section, and by adding the following language: 1 . Concrete Footings General : a. Design for proper distribution of superimposed loads . Minimum depth in all instances shall be forty-two ( 42 ) inches below grade . Where a foundation system is designed and certified by a licensed architect or structural engineer these foundation amendments are not required. b. Material : Cast in place concrete. c . Reinforce with steel bars where footings cross or bear on filled trenches or other unstable soil . -7- d. Footing dimensions are based upon soils of average bearing capacity 2 , 000 pounds per square foot. For soils of lesser bearing capacity or where unusual loading conditions exist, larger footings will be required. The building official may require soil borings and/or engineer designed footings and foundation. 2 . Concrete Wall Footings . The minimum dimension for concrete trench footings shall be twelve ( 12 ) inches thick (one story, no masonry) with two (2 ) number four (4 ) re-bar top and bottom continuous all around footing. Minimum dimensions for spread footings shall be eight ( 8 ) inches deep by eighteen ( 18) inches wide except that masonry veneer on frame and solid masonry walls shall be ten ( 10) inches deep by twenty (20) inches wide. 3 . Pier, Post and Column Footings . a. The design shall be based on loading and soil conditions . For other than open wood decks; architect or structural engineer sealed foundation drawings are required. b. Open decks shall be a minimum eight ( 8) inch diameter concrete pier forty-two ( 42 ) inches below grade. 4 . Chimney footings shall have a minimum thickness of twelve ( 12 ) inches . The minimum projection on each side shall be six ( 6 ) inches . The footings shall be poured integral with the wall footing when the chimney occurs in the outside wall or the inside bearing wall . Section 403 . 2 , entitled Footings for Wood Foundations, shall be deleted in its entirety. Section 403 . 3, entitled Insulated Footings, shall be deleted in its entirety. Figures 403 . 1b, 403 . 1c, Table 403 . 3 and Figure 403 . 3a and Table 403 . 3 shall be deleted in their entirety. Section 404 . 3, entitled Wood Foundation Walls, shall be deleted in its entirety. Section 404 . 4 , entitled Trench Type Foundations, shall be created to read as follows : Trench type foundations, when approved, shall be a minimum twelve ( 12 ) inches thick and a minimum forty-two (42 ) inches below grade with two (2 ) number four ( 4 ) re-bar reinforcing continuous at top and bottom all around. -8- Section 404 . 5, entitled Concrete Foundation Wall Openings, shall be created to read as follows : Concrete foundation wall openings shall be as specified in Illustration D, for required foundation wall reinforcing at openings . FOUNDATION WALL REINFORCING (Illustration D) Section 405 . 2 , entitled Wood Foundations, shall be deleted in its entirety. Section 406 . 2 . 1, entitled Concrete and Masonry Foundation Waterproofing, shall be created to read as follows : Concrete and Masonry foundation waterproofing shall required in compliance with Section 406 . 2 of this chapter where the basement is a walkout or English-type half basement. Section 406 . 3, entitled Dampproofing for Wood Foundations, shall be deleted in its entirety. Section 408 . 3, entitled Structural Requirements, shall be amended to read as follows : r 1 . Wood columns shall be not less in nominal size than four (4 ) inches by four ( 4 ) inches . 2 . Steel columns shall be not less than three ( 3 ) inch continuous diameter standard pipe. 3 . All columns shall be adequately anchored at top and bottom to prevent lateral displacement. Section 502 . 12 , entitled Floor Joists Bearing Into Masonry Walls, shall be created to read as follows : Floor joists bearing into masonry walls shall have their ends fire cut. Section 601 . 2 , entitled Requirements, shall be amended to read as follows : The wall construction shall be capable of accommodating all loads imposed according to Section 301 of this chapter and transmitting the resulting loads to its supporting structural elements . Walls which will contain any one and one-half inch diameter supply or waste piping or larger shall be framed with minimum two (2 ) inch by six ( 6 ) inch studs . Exterior walls that contain water supply and waste piping shall be framed to -9- '4°k allow a minimum of R-13 insulation between the piping and the exterior sheathing of the wall . Section 601 . 2 . 2 , entitled Insulation, shall be created to read as follows : Insulation. The "R-value" of insulation in exterior walls shall be not less than R-13 . Section 701 . 1 . 1, entitled Application, shall be amended by adding the following language after the last sentence in the section: The use of corrugated plastic siding material shall be prohibited. Section 703 . 2 , entitled Weather-Resistant Sheathing Paper, shall be amended to read as follows : Asphalt saturated building felt paper ( 15# minimum) or approved house wrap free from holes and breaks shall be applied over the sheathing of exterior walls of all new construction. Such felt or material shall be applied horizontally, with the upper layer lapped over the lower layer not less than two(2 ) inches . Where joints occur, material shall overlap not less than six ( 6 ) inches . ek Section 703 . 2 . 1 , entitled Felt or Material, shall be amended by deleting subparagraphs 2 , 3 and 5 . Section 801 . 2 . 1 , entitled Insulation Requirements, shall be created to read as follows : Insulation requirements . The minimum R-value for insulation in attic roofs shall be R-30 (twelve ( 12 ) inches of fiberglass batt insulation) with the exception of roofs having vaulted ceilings without an attic which may have a minimum R-value of R-19 (six ( 6 ) inches of fiberglass insulation) with a nominal two (2 ) inch air space for ventilation purposes . Section 801 . 3, entitled Roof Drainage, shall be amended by adding the following language after the last sentence in the section: Roof gutters and downspouts shall be installed and maintained at all locations where water will run off the roof onto a walking or driving surface below. Downspout leaders shall not discharge across walking or driving surfaces . Section 807 . 1 . 1 , entitled Accessible Attic Access, shall elk be amended to read as follows : -10- Attic access doors and hatches shall have a mechanical latching device such that the door will not open unless the latch is physically or manually released. Such doors and hatches shall be operable from both sides . Section 901 . 1 . 1, entitled Corrugated Plastic Roofing, shall be created to read as follows : Corrugated plastic roofing The use of corrugated plastic roofing material shall be prohibited. Section 1003 . 13, entitled Spark Arresters, shall be created to read as follows : Spark Arresters . Spark arresters with a minimum of one-half inch wire mesh or equivalent shall be required on all wood burning fireplaces and chimneys . Section 1101 . 2 , entitled Applications, shall be amended to read as follows : In addition to the general administration requirements of Chapter 1 , the administrative provisions of this chapter shall also apply to the mechanical requirements of Chapters 12 through 28 . Furnace installation instructions shall be made available to the A.► heating inspector upon request. Section 1901 . 1 . 1, subparagraph 4 , entitled Aboveground duct systems, shall be amended to read as follows : Gypsum products may be used as ducts or plenums, provided that the air temperature does not exceed 95 degrees Fahrenheit and exposed surfaces are not subject to condensation. Section 1901 . 1 . 1 , subparagraph 6 , entitled Aboveground duct systems , shall amended to read as follows : Structural areas between studs or partitions to be used as return ducts shall be isolated from unused spaces with tight-fitting stops of sheet metal, or with wood not less than 2 inch ( 51 mm) nominal thickness . Void spaces between wood and penetrating conduit and/or pipes shall be fire stopped. Stud wall cavities shall not convey return air from more than one room and/or one floor level . Section 1901 . 3 . 1 , entitled Joints and seams shall be amended to read as follows : Supply and return ducts shall be sized according to ACCA Manual D or SMACNA Installation Standards for Residential Heating and Air Conditioning Systems or other approved methods . In addition, for a residential air -11- e,, system, the main supply ducts shall be sized for an air velocity not to exceed one thousand feet per minute. All branch ducts shall be sized for an air velocity not to exceed six hundred feet per minute. Table 1901 . 1 . 1b, entitled Gages of Metal Ducts and Plenums Used for Heating or Cooling, shall be amended to read as follows : Round ducts : 6 diameter or less 30 GA 6 - 14 diameter 28 GA Over 14 diameter 26 GA Exposed rectangular ducts : 13 or less 26 GA 14 - 30 24 GA Over 30 22 GA Section 1901 . 3 . 2, entitled, Support, shall be amended to read as follows : Metal ducts shall be supported by not less than 1 inch by double 26 gage metal straps at intervals not exceeding 12 feet. Nonmetallic ducts shall be supported in e" accordance with the manufacturer' s installation instructions . Chapter 26 , entitled Fuel Gas Piping is hereby deleted in its entirety. Chapters 29 through 46 , inclusive pertaining to plumbing installation and electrical installation shall be deleted in their entirety. 16 . 36 . 030 SUPPLEMENTAL REGULATIONS TO THE CABO ONE AND TWO FAMILY DWELLING CODE. The following requirements shall apply to one-family and two-family dwellings : A. Prohibited Return Ducts . No return duct of a mechanical warm air heating system shall regulate air from one dwelling unit to another dwelling unit. B. Supply Ducts Required. Supply ducts for dwellings erected on concrete slabs shall be installed from the furnace to the registers embedded and anchored in the slab on which the dwelling is erected. In two and three story dwellings , heating outlets shall be located not more than twelve inches as measured from top of the grille to the finished floor in that portion of a dwelling utilizing concrete slab floor. -12- Exception: Sites with a high water table, as determined by the building official, may be exempted from these requirements . C . Underground duct systems of metal or other approved materials installed in or below concrete floors or slabs shall be airtight. In addition, any such duct work shall be encased in at least two inches of concrete or shall be installed in accordance with the manufacturer' s recommendations , and shall be securely anchored every six feet prior to encasement in the concrete . D. Return air and supply air ducts shall be sized in accordance with length and resistance, maintain minimum airflow quantities, and maintain maximum velocities of 1000 FPM for main ducts and 600 FPM branch ducts . E . In supply air ducts transition fittings are required in all changes in duct size. Bullhead fittings are prohibited. F. Heating supply air shall be distributed to all rooms . Exception: Interior spaces mechanically vented e via other systems . G. Return air for warm air furnaces is required from all rooms except as prohibited by Section 1902 . 3 of this chapter. Central returns are prohibited. H. Flexible air ducts, both metallic and nonmetallic, shall be listed and labeled to indicate conformance with the requirements of U.L. 181 for Class 0 or Class 1 flexible air ducts . Flexible air ducts shall not exceed ten ( 10) feet in length. I . Flexible air connectors, both metallic and nonmetallic, shall be listed and labeled to indicate conformance with the requirements of U.L. 181 for Class 0 or Class 1 flexible air ducts . Flexible air ducts shall not exceed ten ( 10) feet in length. J. Flexible nonmetallic ducts and/or connectors shall not be installed in non-accessible areas of any dwelling. K. Where air diffusing supply grilles are placed in the baseboard or immediately above on interior walls, air velocities shall not exceed four hundred (400) feet per minute; where air grilles are placed in the baseboard or immediately above or in the floor on exterior walls, air velocities shall not exceed five hundred (500) feet per -13- minute. Where placement of grilles is above head level, velocity shall be from five hundred (500) to seven hundred ( 700) feet per minute. All living quarters shall be supplied with at least five (5 ) air changes per hour (one ( 1 ) air change every twelve ( 12 ) minutes) and all supply grilles shall be directly connected to either the heating unit or the main duct line. Velocity at the return air grille is not to exceed four hundred (400 ) feet per minute. L. All rooms containing bathtubs, showers, spas and similar bathing fixtures shall be mechanically exhausted. In addition, all rooms containing toilets, lavatories and similar fixtures shall be mechanically exhausted. The exhaust rate from each of these rooms shall be five ( 5 ) air changes for every one ( 1 ) hour (one ( 1) air change every twelve ( 12 ) minutes ) . The exhaust duct shall be sized not less than the fan discharge size and vent directly outdoors via a roof cap, wall cap, or wall louver with insect screens when required. M. Wall heaters venting to the exterior and drawing exterior air for combustion may be installed in existing buildings . N. Ventless heaters and fireplaces shall be prohibited. 16 . 36 . 040 CONFLICTS WITH OTHER PROVISIONS . Conflicts With Other Provisions . When the provisions of this chapter conflict with any other provision of the Elgin Municipal Code regulating the same subject matter, the more stringent or restrictive provision shall apply. In all instances where the provisions adopted in this chapter conflict with specific provisions of the electrical, plumbing, building or fire prevention codes of the city, either as presently adopted or to be adopted or amended in the future, the specific provisions of this code shall supersede and take precedence over the conflicting provisions in any other such code. Section 2 . That nothing in this ordinance or in the CABO One and Two Family Dwelling Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this ordinance. -14- Section 3 .
