AN ORDINANCE
AMENDING CHAPTER 3 . 75 OF THE ELGIN MUNICIPAL CODE,
1976 , AS AMENDED, ENTITLED "CULTURAL ARTS COMMISSION"
WHEREAS, the City of Elgin is a home rule unit pursuant to
Article VII of the Illinois Constitution; and
WHEREAS, the City of Elgin, as a home rule unit, may
exercise any power and perform any function pertaining to its
government and affairs ; and
WHEREAS, the City Council of the City of Elgin has
determined that it is necessary and desirable to amend the
appointment procedure for the appointment of members to the
city' s cultural arts commission; and
WHEREAS, the appointment of members to the cultural arts
commission pertains to the government and affairs of the City
of Elgin.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS :
Section 1 . That Section 3 . 75 . 020 of the Elgin Municipal
Code, 1976 , as amended, entitled "Membership, Appointment and
Term of Office" be and is hereby amended in its entirety to
mead as follows :
" 3 . 75 . 020 MEMBERSHIP, APPOINTMENT AND TERM OF
OFFICE .
The commission shall consist of ten members, all
of whom shall be appointed by the city council .
A. All members shall be residents of the city
who are known to have an interest and expertise in
the functions of the commission and who shall be
voting members of the commission.
B. One member shall be a member of the Hemmens
advisory board and shall be a non- voting ex officio
member of the commission.
C . One member shall be a member of the city
council and shall be an ex officio member of the
commission and shall vote only in the event of tie
vote . "
Section 2 . That all ordinances or parts thereof in
conflict with this ordinance be and are hereby repealed .

tow Section 3 . That this ordinance shall be in full force and
effect from and after its passage and publication in the manner
provided by law.
