G12-97 Ordinance No. G12-97 AN ORDINANCE AMENDING TITLE 20 OF THE ELGIN MUNICIPAL CODE, 1976, AS AMENDED, ENTITLED "DESIGNATION AND PRESERVATION OF HISTORICALLY AND ARCHITECTURALLY SIGNIFICANT PROPERTY" WHEREAS, Title 20 of the Elgin Municipal Code, 1976, as amended, provides for the city' s regulations for the designation and preservation of historically and architecturally significant property; and WHEREAS, such regulations currently provide for general design guidelines as set forth under the Secretary of the United States Department of the Interior Standards for Rehabilitation and Guidelines for Rehabilitating Historic Buildings; and WHEREAS, the City Council of the City of Elgin has determined that it is necessary and desirable to adopt more detailed design guidelines to be applied in the consideration of whether a certificate of appropriateness should be issued for proposed construction, alterations, removal or demolitions affecting the exterior architectural appearance of any designated landmark or of any property within a historic district of the city; and WHEREAS, the Elgin Heritage Commission in conjunction with the City' s consultant Thomason and Associates have drafted and prepared a Design Guideline Manual; and WHEREAS, the Elgin Heritage Commission has conducted a public hearing on the proposed Design Guideline Manual . NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1 . That the City Council of the City of Elgin hereby approves and adopts the Elgin Design Guideline Manual dated March, 1997 , prepared by the Elgin Heritage Commission and consultant Thomason and Associates as the design guidelines for whether to issue certificates of appropriateness for proposed construction, alterations, removal or demolitions affecting the exterior architectural appearance of any designated landmark or of any property within a historic district of the c 'ty. Section 2 . That Section 2 . 04 . 055 entitled "Design Guidelines" of the Elgin Municip 1 Code, 1976, as amended, entitled " be and is hereby further amended to read as follows : "Design Guideline" means the Design Guideline Manual dated March, 1997, repared by the Elgin Heritage Commission and co sultant Thomason and Associates, and other guidelines which may be adopted by the City Council from time to time. " Section 3 . That Section 20 . 04 . 094 entitled "Significant Exterior Architectural Feature" be and is hereby added to the Elgin Municipal Code, 1976, as amended, to read as follows : "20 . 04 .094 SIGNIFICANT EXTERIOR ARCHITECTURAL FEATURE. "Significant exterior architectural feature" means foundation; siding; masonry; stucco; roofs; chimneys; gutters; downspouts; entrances and doors; windows; porches; stoops and railings; cornices and friezes; ornamentation including trim, brackets, hood molds, shutters, awnings and light fixtures; grade levels adjacent to buildings; garages, out buildings and other accessory structures . " Section 4 . That Section 20 . 08 . 010 entitled "Certificate of Appropriateness Required" of the Elgin Municipal Code, 1976 , as amended, be and is hereby further amended by amending subparagraph B to read as follows : "B. Any construction, alteration, removal or demolition affecting a significant exterior architectural feature. " Section 5 . That Section 20 . 08 . 030 entitled "Design Guidelines" of the Elgin Municipal Code, 1976 , as amended, be and is hereby further amended to read as follows : "In considering an application for a certificate of appropriateness, the Heritage Commission and the Design Review Subcommittee shall apply the design guidelines as set forth in the Design Guideline Manual dated March, 1997 , prepared by the Elgin Heritage Commission and consultant Thomason and Associates, as a standard for whether to issue such certificates and other guidelines which may be adopted by the City Council from time to time. " Section 6 . That Section 20 . 12 . 050 entitled "Affirmation of Existing Code and Ordinances" of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended to read as follows : "Nothing contained in this title shall supersede the powers of other local legislative or regulatory bodies, or relieve any property owner from complying with the requirements of other applicable codes and ordinances . Specifically, this title shall not be construed to modify any applicable codes or ordinances . In the event of any conflict between the provisions of this title and any other applicable codes and ordinances, the more restrictive ordinance provision shall be deemed to apply. " Section 7 . That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. Section 8 .
