AN ORDINANCE
VACATING KELLY CIRCLE IN THE FOX BLUFF CORPORATE CENTER
WHEREAS, the City of Elgin is the owner of the property
commonly known as the Fox Bluff Corporate Center in the City
of Elgin, Kane County, Illinois; and
WHEREAS, as part of development efforts within the City
of Elgin the City recorded a plat of subdivision for the Fox
Bluff Corporate Center which included the creation and
dedication of streets therein, including Kelly Circle; and
WHEREAS, the City has agreed to a contract for the sale
of property within the Fox Bluff Corporate Center including
Kelly Circle; and
WHEREAS, Kelly Circle is no longer necessary to serve the
public and the public interests will be served by vacating
Kelly Circle.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1 . That the public street in the City of Elgin,
ep►• Kane County, Illinois, legally described as follows :
Kelly Circle lying within Fox Bluff Corporate
Center, being a subdivision of part of Section 27,
Township 41 North, Range 8 East of the Third
Principal Meridian, according to the plat thereof
recorded as Document No. 92K59007 , being in the City
of Elgin, Kane County, Illinois and containing 0 . 65
acre more or less .
be and the same is hereby vacated.
Section 2 . That all easements including all public
utility easements within said vacated Kelly Circle be and the
same are hereby vacated.
Section 3 . That the 20 foot public utility easement
adjacent and parallel to said vacated Kelly Circle be and the
same is hereby vacated.
Section 4 . That the 35 foot building line adjacent and
parallel to said vacated Kelly Circle and be and the same is
hereby vacated.
Section 5 . That a certified copy of this ordinance
together with a plat of said vacated right of way, easement
and building line be filed with the Recorder of Deeds of Kane
County, Illinois .
Section 6 . That this ordinance shall be in full force
and effect upon the payment of compensation by the contract
purchaser as set forth in the pending contract to purchase the
said vacated street and surrounding property.
