COUNTY OF KANE CERTIFICATE I , Dolonna Mecum, certify that I am the duly appointed and acting municipal clerk of the City of Elgin, Cook and Kane Counties, Illinois . I further certify that on May 8, 1996 , the Corporate Authorities of such municipality passed and approved Ordinance No. G21-96, entitled An Ordinance Amending Chapter 11 . 40 of the Elgin Municipal Code, 1976, by Adding Section 11 .40 . 095 Entitled "Sound Amplification Devices" which provided by its terms that it should be published in pamphlet form. The pamphlet form of Ordinance No. G21-96 , including the Ordinance and a cover sheet thereof, was prepared, and a copy of such Ordinance was posted in the municipal building, commencing on May 9 , 1996 , and continuing for at least ten days thereafter. Municipal Clerk (SEAL) Ordinance No. G21-96 /h, AN ORDINANCE AMENDING CHAPTER 11 . 40 OF THE ELGIN MUNICIPAL CODE, 1976 , BY ADDING SECTION 11 . 40 . 095 ENTITLED "SOUND AMPLIFICATION DEVICES" BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS : Section 1 . That Chapter 11 . 40 of the Elgin Municipal Code, 1976 , as amended, entitled "Special Stops Required-- Miscellaneous Rules of the Road" be and is hereby further amended by adding Section 11 . 40 . 095 to read as follows : 11 . 40 . 095 Sound Amplification Devices . A. No driver of any motor vehicle within this city shall operate or permit operation of any sound amplification system which can be heard outside the vehicle from 75 or more feet when the vehicle is being operated upon a highway, unless such system is being operated to request assistance or warn of a hazardous situation. This section does not apply to authorized emergency vehicles or vehicles engaged in advertising. B. Any person convicted of violating the provisions of this section shall be fined $150 . 00 . C. Any person convicted of a second offense under this section within any 12 month period shall be fined $250 . 00 . D. Any person convicted of a third or subsequent offense under this section within any 12 month period shall be fined $500 . 00 . Section 2 . That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. Section 3 . That this ordinance shall be in full force and effect ten days after its passage and publication in the manner provided by law.
