and acting municipal clerk of the City of Elgin, Cook and Kane
Counties, Illinois .
I further certify that on April 10, 1996 , the
Corporate Authorities of such municipality passed and approved
Ordinance No. G14-96 , entitled An Ordinance Amending Chapter
7 . 04 of the Elgin Municipal Code, 1976 , as Amended, Entitled
"Dogs and Cats" which provided by its terms that it should be
published in pamphlet form.
The pamphlet form of Ordinance No. G14-96, including
the Ordinance and a cover sheet thereof, was prepared, and a
copy of such Ordinance was posted in the municipal building,
commencing on April 12 , 1996, and continuing for at least ten
days thereafter. Copies of such Ordinance were also available
for public inspection upon request in the office of the
municipal clerk.

AN ORDINANCE
AMENDING CHAPTER 7 . 04 OF THE ELGIN MUNICIPAL CODE, 1976 ,
AS AMENDED, ENTITLED "DOGS AND CATS"
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS:
Section 1 . That Section 7 . 04 . 030 of the Elgin Municipal
Code, 1976 , as amended, entitled "Rabies Inoculation and
License-Required" be and is hereby amended in its entirety to
read as follows :
"7 . 04 . 030 Rabies Inoculation Required.
No dog or cat shall be permitted to be kept in
the city unless properly inoculated for rabies as
required by law. It shall be the duty of the owner
to cause the tag issued to the owner evidencing
rabies inoculation to be securely attached around
the inoculated animal ' s neck and kept there during
the effective period of rabies inoculation. "
Section 2 . That Section 7 . 04 . 040 of the Elgin Municipal
elk Code, 1976 , as amended, entitled "License-Fees" be and is
hereby repealed.
Section 3 . That Sections 7 . 04 . 050 through 7 . 04 . 130,
inclusive, of the Elgin Municipal Code, 1976 , as amended, be
and are hereby renumbered as Sections 7 . 04 . 040 through
7 . 04 . 120 .
Section 4 . That Section 7 . 04 . 140 of the Elgin Municipal
Code, 1976 , as amended, entitled "Impoundment-Redemption-Fees"
be and is hereby renumbered as Section 7 . 04 . 130 and amended to
read as follows :
"7 . 04 . 130 Impoundment-Redemption-Fees .
A. Any dog which has been impounded or taken
up for being at large or for any violation of law
may be redeemed by the owner of such dog upon
payment to the city of the sum of $50 . 00, for the
cost of taking up and impounding such animal . The
owner must also pay the cost of keeping the animal
during the impoundment.
B. Payment of redemption or professional fees
shall not release the owner from other complaints
ft being brought or fines being levied under this
chapter. "
Section 5 . That Section 7 . 04 . 150 of the Elgin Municipal
Code, 1976 , as amended, entitled "Nuisance Declaration-Removal
or Destruction of Dog" be and is hereby renumbered as Section
7 . 04 . 140 .
Section 6 . That Chapter 7 . 04 of the Elgin Municipal
Code, 1976 , as amended, be and is hereby further amended by
adding Section 7 . 04 . 150 to read as follows :
"7 . 04 . 150 Penalty for Violation.
Any person violating the provisions of this
chapter shall be punished for a first offense by a
fine of not less than $50 nor more than $500, for a
second offense by a fine of not less than $100 nor
more than $500, and for a third offense and any
subsequent offenses by a fine of not less than $200
nor more than $500 . Each day that an offense
continues shall be deemed to constitute a separate
violation of this chapter. "
Section 7 . That the Director of Finance is hereby
directed to refund all license fees paid pursuant to Elgin
Municipal Code Chapter 7 . 04 for the 1996 license year.
rft Section 8 . That all ordinances or parts of ordinances in
conflict with the provisions of this ordinance be and are
hereby repealed.
Section 9 . That this ordinance shall be in full force
and effect immediately upon its passage.
