G71-95 emw Ordinance No. G71-95 AN ORDINANCE GRANTING A CONDITIONAL USE FOR A MASTER SIGNAGE PLAN ( 127 South Grove Avenue) WHEREAS, written application has been made for a CC1 Center City Business District conditional use for a a master signage plan at 127 South Grove Avenue; and WHEREAS, the Zoning and Subdivision Hearing Board conducted a public hearing after due notice by publication and has submitted its findings of fact and recommended approval; and WHEREAS, the City Council of the City of Elgin concurs in the findings and recommendation of the Zoning and Subdivision Hearing Board. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1 . September 6, 1995 FINDINGS OF FACT ZONING AND SUBDIVISION HEARING BOARD CITY OF ELGIN I. SUBJECT Petition 43-95 Requesting Approval of a CC1 Center City Business District Conditional Use for a Master Signage Plan; Property Located at 127 South Grove Avenue; by Planned Development and Construction, Inc. , as Applicant and Owner. II. CONSIDERATIONS A petition has been filed by Planned Development and Construction, Inc. , requesting approval of a CC1 Center City Business District conditional use for a master signage plan. The subject property is located at 127 South Grove Avenue. Section 19.50. 150 of the Zoning Ordinance establishes the procedure for the consideration of "master signage plans" . The City Council may approve a conditional use for a master signage plan to provide an opportunity for a creative approach to signage which may not conform to all of the provisions of the sign ordinance. No departures from the provisions of the sign ordinance are to be granted unless the requested departures are mitigated through an equivalent or more restrictive application of the regulations. The applicant is in the process of renovating the existing commercial structure located at 127 South Grove Avenue for occupancy with an eating and drinking place (microbrewery) . The applicant proposes to install two wall signs on the Prairie Street side of the building. The proposed signs will advertise the Prairie Rock Brewing Company. The combined surface area of the proposed signs is 160 square feet. The maximum permitted surface area on the Prairie Street side of the building is 80 square feet. The applicant is proposing to mitigate the additional sign surface area proposed to be installed on the Prairie Street side of the building by relinquishing the right to install a maximum 80 square feet of sign surface area on the South Grove Avenue side of the building. FINDINGS After due notice, as required by law, the Zoning and Subdivision Hearing Board held a public hearing on Petition 43-95 on August 16, 1995. The petitioner testified at the public hearing. A Petition Review, dated August 8, 1995, was submitted by the Planning Department, which neither recommended approval nor denial of Petition 43-95. This Petition Review, along with the exhibits attached thereto, and the written transcription of the proceedings of the public hearing, are attached hereto and made a part hereof. A majority of the Zoning and Subdivision Board made the following findings with respect to Petition 43-95 : A. Site Characteristics The subject property is located at the northeast corner of Prairie Street and South Grove Avenue. The property is improved with a masonry commercial building. B. Sewer and Water (Pk The existing building is served with municipal sewer and water service. C. Traffic and Parking The subject property is located at the intersection of South Grove Avenue and Prairie Street. Grove Avenue and Prairie Street provide access to the adjoining business properties and facilitate traffic movement through the downtown area. Uses located within the CC1 District are not required to provide off-street parking. Two municipal parking lots are located in close proximity to the subject property. D. Surrounding Land Use and Zoning The areas located to the north, east, and west of the subject property are zoned CC1 District. These areas are developed with retail and commercial service uses, and public parking. The area located to the south of the subject property is zoned CC2 District. The area is developed with a public parking lot and open space. G. Trend of Development The subject property is located at the south end of the commercial core of Elgin's center city. The trend is for the continued occupancy of buildings within this core district with traditional retail and commercial service uses . H. Comprehensive Plan/Center City Master Plan The subject property is located in an area designated "downtown commercial" in the Comprehensive Plan. The property is located in an area designated as the "commercial core district" in the Center City Master Plan. IV. RECOMMENDATION On a motion to recommend approval of Petition 43-95 , subject to the following conditions: 1.
