AN ORDINANCE
VACATING WELLINGTON AVENUE FROM NATIONAL
STREET TO LAKE STREET
WHEREAS, Wellington Avenue north of National Street and
south of Lake Street is no longer necessary to serve the
public and the public interest will be served by vacating said
portion of Wellington Avenue; and
WHEREAS, the Chicago and Northwestern Transportation
Company is the adjoining property owner to the east of that
portion of Wellington Avenue to be vacated herein and as such
would obtain an interest to the eastern half of the right of
way to be vacated; and
WHEREAS, the Chicago and Northwestern Transportation
Company, in lieu of paying the fair cash market value for the
eastern half of said vacated right of way has agreed to convey
to the City of Elgin all interest it may have in Wellington
Avenue north of National Street and south of Prairie Street in
exchange for its administrative costs of $750 . 00; and
WHEREAS, it is necessary and desirable for the City to
obtain the interest from the Chicago and Northwestern
Transportation Company in Wellington Avenue north of National
Street and south of Prairie Street and the public interest
will be served by the City acquiring this interest.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS :
Section 1 . That the public street in the City of Elgin,
Kane County, Illinois, legally described as follows :
That part of Wellington Avenue lying in part of
the Southwest Quarter of Section 13, Township 41
North, Range 8 East of the Third Principal Meridian
lying Northerly of the Northerly right of way of
National Street and Southerly of a line drawn from
the intersection of the Southerly right of way line
of Lake Street with the Westerly right of way of
Wellington Avenue, Northeasterly to a point on the
Northerly line of Lot 15, Block 2 of Railroad
Addition to Elgin, said point being 72 . 75 feet
Southwesterly of (as measured along said Northerly
line) the Northeast Corner of said Lot 15, being
situated in the City of Elgin, Kane County, Illinois
be and the same is hereby vacated.
r- Section 2 . That a certified copy of this ordinance
together with a plat of said vacated right of way be filed
with the Recorder of Deeds of Kane County, Illinois .
Section 3 . That the City Manager is hereby authorized to
accept a quit claim deed for the eastern half of Wellington
Avenue north of National Street and south of Prairie Street
from the Chicago and Northwestern Transportation Company which
is the adjoining property owner to the east of said right of
way. In consideration for said quit claim deed, the City
Manager is authorized and directed to pay the sum of $750 . 00
to the Chicago and Northwestern Transportation Company.
Section 4 . That this ordinance shall be in full force
and effect upon the receipt of the quit claim deed from the
Chicago and Northwestern Transportation Company.
