AN ORDINANCE
GRANTING A CONDITIONAL USE FOR A CHILD DAY CARE SERVICE
(715 Tollgate Road)
WHEREAS, written application has been made for a GI
General Industrial District conditional use for a child day
care service at 715 Tollgate Road; and
WHEREAS, the Zoning and Subdivision Hearing Board
conducted a public hearing after due notice by publication and
has submitted its written findings of fact and recommended
approval; and
WHEREAS, the City Council of the City of Elgin concurs in
the findings and recommendation of the Zoning and Subdivision
Hearing Board.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1 . That the City Council of the City of Elgin
hereby adopts the findings of fact made by the Zoning and
Subdivision Hearing Board, a copy of which is attached hereto
m and made a part hereof by reference as Exhibit A.
Section 2 . That a conditional use for a child day care
service at 715 Tollgate Road and legally described as follows :
THAT PART OF LOT 1 IN THE RESUBDIVISION OF LOT
37 IN NORTH INDUSTRIAL PLAZA, BEING A SUBDIVISION OF
PART OF SECTIONS 33 AND 34, TOWNSHIP 42 NORTH, RANGE
8 EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO
THE PLAT OF THE AFORESAID SUBDIVISION THEREOF,
RECORDED ON APRIL 26, 19979 AS DOCUMENT NO. 1501649 ,
EXCEPT THAT PART LYING NORTHERLY OF THE FOLLOWING
DESCRIBED LINE: BEGINNING ON THE WEST LINE OF SAID
LOT, 315 . 00 FEET SOUTHERLY (AS MEASURED ALONG SAID
LINE) OF THE NORTHWEST CORNER THEREOF, THENCE
EASTERLY PARALLEL WITH THE NORTH LINE OF SAID LOT,
220 . 00 FEET; THENCE SOUTHEASTERLY ALONG A LINE
FORMING A DEFLECTION ANGLE TO THE RIGHT OF 17
DEGREES, 62 .00 FEET; THENCE EASTERLY PARALLEL WITH
SAID NORTH LINE TO THE EASTERLY LINE OF SAID LOT; IN
THE CITY OF ELGIN, KANE COUNTY, ILLINOIS .
be and is hereby granted subject to the following conditions :
1 . Substantial compliance with the site plan
prepared by Popowych Associates, Ltd. , revised
October 3, 1994, and the Statement of Purpose and
Conformance prepared by Mark Bratkiv, dated July 20,
1994 .
2 . Compliance with all other applicable codes
and ordinances .
Section 3 . That the conditional use granted herein shall
expire if not established within one year from the date of
passage of this ordinance.
Section 4 . That this ordinance shall be in full force
and effect immediately after its passage in the manner
provided by law.
