Ordinance No . T2-93
AN ORDINANCE
ESTABLISHING FEES FOR THE CONNECTIOt AND USE OF CERTAIN
WATERMAIN IMPROVEMENTS
(Oak Grove Subdivis on)
WHEREAS, the City of Elgin has caused certain watermain
improvements to be made and identif ' ed as the Oak Grove
Subdivision watermain improvement; and
WHEREAS, the cost of the City of Elgin to be reimbursed
amounted to $25, 715 . 57 ; and
WHEREAS, said improvements extend .:cross property located
within the City of Elgin for a distance of 1 , 525 . 60 feet; and
WHEREAS, the City of Elgin is a home rule unit empowered
to exercise any power and perform any function pertaining to
its government and affairs ; and
WHEREAS , it is reasonable to req ire owners of property
adjoining said improvements to bear a proportionate share of
the cost of said improvement in the -vent that said owners
desire to connect to and use said water ain.
NOW, THEREFORE, BE IT ORDAINED BY HE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS :
Section 1 . That any owner of Nroperty adjoining the
above described Oak Grove Subdivisio watermain improvement
and legally described as follows who d-sires to connect to and
use said facilities shall pay to the City Treasurer of the
City of Elgin, Illinois, a fee in an amount determined at the
rate of $16 . 86 per front foot of such owner' s property
adjoining said improvement. Said fee shall be in addition to
any and all other fees established by the City of Elgin for
water service .
Section 2 . That in accordance ith the provisions of
Section 1 of this ordinance, the following amounts are
established to be paid for connectio to property adjoining
the Oak Grove Subdivision watermain improvement:

Section 3 . That adjoining prope ties held in common
ownership shall be subject to payment of an amount based upon
the frontage of all said properties when application for
connection for any of said lots is made .
Section 4 . That any person desir ng to hook on to said
watermain improvement prior to May , 1993, may pay said
amount in full without interest .
Section 5 . That any person desiring to hook on to said
watermain improvement after May 1, 1993 , shall pay an amount
equal to the amount established for th- property to be served
plus interest at the rate of seven ( 7'. ) percent of the total
amount due accruing from and after May 1 , 1993 to the date of
payment .
Section 6 . That a certified copy of this ordinance shall
be recorded with the Recorder of Deeds , Kane County, Illinois .
Section 7 . That all ordinances of parts of ordinances in
conflict with the provisions of thi_ ordinance are hereby
repealed.
Section 8 . That this ordinance -hall be in full force
r.; and effect from and after its passag= in the manner provided
by law.
