I further certify that on September 22, 1993, the Corporate Authorities of such municipality passed and approved Ordinance No. G48-93, entitled An Ordinance Amending Chapter 6 . 06 Entitled "Alcoholic Liquor Dealers" of the Elgin Municipal Code, 1976, as Amended, Pertaining to Penalty for Purchase of Liquor by a Minor and Vendors for Class I Liquor License which eh' provided by its terms that it should be published in pamphlet form. The pamphlet form of Ordinance No. G48-93, including the Ordinance and a cover sheet thereof, was prepared, and a copy of such Ordinance was posted in the municipal building, commencing on September 23, 1993, and continuing for at least ten days thereafter. Copies of such Ordinance were also available for public inspection upon request in the office of the municipal clerk. DATED at Elgin, Illinois, on September 23, 1993 . g A Municipal Clerk (SEAL) few Ordinance No. G48-93 AN ORDINANCE AMENDING CHAPTER 6 . 06 ENTITLED "ALCHOLIC LIQUOR DEALERS" OF THE ELGIN MUNICIPAL CODE, 1976, AS AMENDED, PERTAINING TO PENALTY FOR PURCHASE OF LIQUOR BY A MINOR AND VENDORS FOR CLASS I LIQUOR LICENSE WHEREAS, the City of Elgin is an Illinois municipal corporation and a home rule unit pursuant to the Constitution and laws of the State of Illinois; and WHEREAS, a home rule unit may exercise any power and perform any function pertaining to its government and affairs; and WHEREAS, the regulation of the sale of alcoholic liquor is a matter pertaining to the government and affairs of the City of Elgin. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS : Section 1 . That Section 6 . 06 . 040 entitled "License-- Classes--Fees" of the Elgin Municipal Code, 1976 , as amended, is hereby further amended to read as follows : J. Class I . For retail sale of alcoholic liquor during a special event sponsored by a not-for-profit corporation or association and conducted by such association or corporation in conjunction with a vendor who shall actually conduct and be responsible for all liquor sales and who pursuant to the provisions of this chapter, holds a current and valid liquor license in the city other than a Class G, I or K license, subject to the terms of such license; provided, however, no license shall issue for more than two consecutive days nor for more than twelve hours during any single day. The license fee shall be twenty-five dollars per day. No more than five Class I licenses shall be issued to any not-for-profit corporation or association during any one calendar year. Section 2 . That Section 6 . 06 . 150 entitled "Offenses by other than Licensee" of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended by amending Subsection E to read as follows : E. It is unlawful for any minor, intoxicated person, or habitual drunkard to purchase alcoholic liquor. It is further unlawful for any minor or other person to misrepresent the age of any minor for the purpose of inducing any licensee under this P. chapter to sell or give such minor any alcoholic liquor in violation of this chapter. In every place of business in the city where alcoholic liquor is sold for beverage purposes there shall be displayed in a prominent place a card or sign containing a warning to minors to the effect that they will be subject to the penalties of this chapter if they purchase or misrepresent their age in the attempt to purchase alcoholic liquor. Violation of this subsection shall be punishable by a fine of not less than fifty dollars nor more than one thousand dollars . Section 3 . That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. Section 4 .
