G47-93 Ordinance No. G47-93 AN ORDINANCE AMENDING ORDINANCE NO. S31-85 GRANTING A SPECIAL USE FOR A CHURCH AT 1900 BIG TIMBER ROAD WHEREAS, written application has been made to amend the special use heretofore granted for a church at 1900 Big Timber Road; and WHEREAS, the Zoning and Subdivision Hearing Board conducted a public hearing after due notice in the manner required by law and has submitted its written findings and recommended approval; and WHEREAS, the City Council of the City of Elgin, Illinois, concurs in the findings and recommendations of the Zoning and Subdivision Hearing Board. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1 . That the City Council of the City of Elgin hereby adopts the findings of fact made by the Zoning and Subdivision Hearing Board, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. Section 2 . SUBJECT Consideration of Petition 32-93 Requesting an Amendment to Ordinance No. G31-85 Which Granted• a Conditional Use for a Church; Property Located at 1900 Big Timber Road; by Elgin Evangelical Free Church, as Applicant and Owner. II . CONSIDERATIONS A petition has been filed by Elgin Evangelical Free Church requesting an amendment to an existing conditional use for a church. The subject property is located at 1900 Big Timber Road. The petitioner proposes to construct an addition to the existing church. The addition would house Sunday school classrooms and a multi-purpose room to be used for recreational purposes by the congregation. III. FINDINGS After due notice, as required by law, the Zoning and Subdivision Hearing Board held a public hearing on Petition 32-93 on August 4, 1993 . The petitioner testified at the public hearing. Proponents of the petition did not testify at the public hearing, and objectors to the petition did not testify at the public hearing. Written correspondence in support of the petition has not been submitted, and written correspondence in objection to the petition has not been submitted. The Zoning and Subdivision Hearing Board has made the following findings with respect the Petition 32-93 : A. Site Characteristics The subject property is an irregularly shaped parcel containing approximately 4 .72 acres . The subject property is improved with a church building and accessory off street parking. Exhibit A -Page 1- B. Sewer and Water The subject property is currently served by municipal sanitary sewer and water lines . The proposed amendment will not impact the provision of municipal services to the subject property. C. Traffic and Parking Big Timber Road is an arterial street serving the city's northwest side. Big Timber Road carries approximately 13,000 vehicles per day. Traffic counts are unavailable for Sunday schools and multipurpose rooms . The Off Street Parking Ordinance requires one stall per four seats in the main assembly area, plus one stall per employee for churches. Because no additional seats are being provided and no additional employees will be employed, no additional stalls are required. D. Zoning History The subject property was annexed and zoned R-4 General eft Residence District in 1972 as part of the Century Oaks West subdivision. A special use for a church was granted to a portion of the subject property in 1982, and amended in 1985 . The subject property was rezoned to CF Community Facility District as part of the Comprehensive Amendment to the Zoning Ordinance in 1992 . E. Zoning Status The subject property is developed with a lawful church and accessory parking area. F. Surrounding Land Use and Zoning The area located to the north of the subject property is zoned TFR Two Family Residence District and is developed with duplexes (Century Oaks West) . The area located to the east of the subject property is zoned GI General Industrial District and AB Area Business District and is undeveloped. The area located to the south of the subject property is zoned GI General Industrial District and is developed with manufacturing uses. The area located to the west of the subject property is zoned MFR Multiple Family Residence District and is undeveloped. -Page 2- G. Trend of Development The area surrounding the subject property is developing with residential and manufacturing uses . H. Comprehensive Plan The subject property is designated urban residential in the Comprehensive Plan, and in the Northwest Area Plan, an amendment to the Comprehensive Plan. IV. RECOMMENDATIONS On a motion to recommend approval of Petition 32-93 , subject to the following conditions : 1. Compliance with the site plan, dated June 25, 1993. 2 . Compliance with all applicable codes and ordinances . the vote was six yes and zero no.
