G35-92 Ordinance No. G35-92 AN ORDINANCE AMENDING ORDINANCE NO. G20-83 GRANTING A SPECIAL USE FOR A SANITARY TREATMENT FACILITY AT CLIFFORD AVENUE/FRAZIER AVENUE WHEREAS, a special use has heretofore been granted for a sanitary treatment facility at Clifford and Frazier Avenues in the City of Elgin; and WHEREAS, an application has been made to amend said special use so as to permit the expansion of the sanitary treatment facility; and WHEREAS, after due notice as required by law a public hearing was held by the Elgin Land Use Committee; and WHEREAS, the Elgin Land Use Committee has submitted its findings of fact and recommended that the amended special use permit be granted; and WHEREAS, the City Council concurs in the recommendation of the Elgin Land Use Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1 . That the findings of fact of the Land Use Committee are adopted. Section 2 . That the special use heretofore granted is hereby amended to permit the expansion of the sanitary treatment facility on the property legally described as follows : Lots 1 through 5 in Block 18, Lots 1 through 5 in Block 19; Outlot 6 lying South of Frazier Avenue; and vacated Clifford Street lying South of the South line of Frazier Avenue, all in Sadler' s Addition to the City of Elgin, Kane County, Illinois, and that part of Frazier Avenue lying North of Lot 1 and Outlot 6 in Block 19 of Sadler' s Addition. Section 3 . That the expansion permitted by the amended special use hereby granted shall be made in substantial conformance with the Expansion Plan prepared by Weston Managers/Designers/Consultants, dated March, 1992 and in compliance with all applicable codes, ordinances, statutes and regulations . elk Section 4 . SUBJECT Consideration of Petition 23-92 Requesting an Amendment to Ordinance No. G20-83 to Expand an R-2 Single Family Residence District Special Use for a Sanitary Treatment Facility; Property Located West of the Fox River; by the Fox River Water Reclamation District, as Applicant; and the City of Elgin, as Owner. II. CONSIDERATIONS A petition has been filed by the Fox River Water Reclamation District (FRWRD) requesting an amendment to Special Use Ordinance No. G20-83 to expand the North Regional Wastewater Treatment Plan. The subject property ,, is an unimproved section of the Fraizer Avenue right of way, located between Clifton Avenue and the Fox River. The petitioner proposes to expand the existing sanitary treatment facility. Five aeriation tanks are proposed to be constructed along the south side of the subject property. The property would be used to slope the ground down from the proposed aeriation tanks, to the existing grade along a line located about midway into the right of way. The existing security fence would be relocated from the south right of way line of the subject property to the middle of the right of way. III. FINDINGS After due notice, as required by law, the Land Use Committee held a public hearing on Petition 23-92 on May 18, 1992 . City staff testified on behalf of FRWRF at the hearing. Proponents of the petition did not testify at the hearing, and objectors to the petitioner did not testify at the hearing. Written correspondence in support of the petition has not been submitted, and written correspondence in objection to the petition has not been submitted. The Land Use Committee has made the following findings tow with respect to Petition 23-92 : Exhibit A -Page 1 - `. 1 • A. Site Characteristics: The subject property is 66 feet wide, and extends from the east right of way line of Clifton Avenue to the west bank of the Fox River. A portion of the property is located within the floodplain of the Fox River. B. Sewer and Water: Not applicable. C. Traffic and Parking: Not applicable. D. Zoning History: The subject property was annexed and zoned R-2 Single Family Residence District in 1972 . E. Zoning Status: The subject property is presently unimproved. The proposed use of the subject property requires special use approval. F. Surrounding Land Use and Zoning: The area located to the west of the subject property is zoned M-1 and is improved with Clifford-Owasco Park. The area located to the northwest of the subject property is zoned R-4 and is improved with the Clifford-Owasco public housing complex. The remaining surrounding area is zoned R-2. The area located to the north of the subject property was purchased by the city for public park and open space. The Fox River borders the east side of the subject property. The existing sanitary treatment facility borders the south side of the subject property. G. Trend of Development: Development potential in the surrounding area is limited due to various constraints including the Fox River and its floodplain, wetlands in the river basin, extreme topography in the area, and rail lines. H. Comprehensive Plan: The sanitary treatment plant is designated as a "community service facility" . In general the remaining area located between the rail lines and the river is designated "open space" . IV. RECOMMENDATION On a motion to recommend approval of Petition 23-92, subject to the following conditions for approval: 1. Substantial conformance with the Expansion Plan low prepared by Weston Managers/Designers/Consultants, dated March, 1992. -Page 2 - ,,.. 2 . Submission and approval of a landscape plan which provides 100 percent screening of the treatment plant from the public housing complex, public park and open space, and the Fox River. 3. Compliance with all applicable codes and ordinances. the vote was seven yes and zero no. Therefore, the motion to recommend approval of Petition 23-92 was adopted. Robert W.
