G41-91 a Ordinance No. G41-91 AN ORDINANCE GRANTING A SPECIAL USE FOR A COMMUNITY SERVICE FACILITY AT 695 SOUTH STATE STREET WHEREAS, written application has been made for a special use for the establishment, maintenance and operation of a community service facility at 695 South State Street; and WHEREAS, the Land Use Committee conducted a public hearing after due notice by publication and has submitted its findings of fact and recommended approval; and WHEREAS, the City Council of the City of Elgin concurs in the findings and recommendation of the Land Use Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1 . That the City Council of the City of Elgin hereby adopts the findings of fact made by the Elgin Land Use Committee, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. Section 2 . That a special use for a community service facility at 695 South State Street, Elgin, Illinois, legally described as follows: That part of the Southeast quarter of Section 23 and part of the Southwest quarter of Section 24, all in Township 41 North, Range 8 East of the Third Principal Meridian, described as follows : Commencing at the point of intersection of the center line of State Route 31 with the North line of the Northeast quarter of Section 26, township and range aforesaid; thence easterly, along a line which forms an angle of 105 degrees 56 minutes (measured southwesterly to easterly from the center line tangent to said State Route 31) , 33 . 90 feet to the most northerly corner of the lands of the Department of Public Safety, as described in instrument dated March 10, 1961, made with the Department of Public Welfare, said corner being on the easterly right of way line of said State Route 31; thence northeasterly, along the easterly right of way line of State Route 31, on a curve to the left having a radius of 8218 . 16 feet and whose long chord forms an angle of 75 degrees 17 minutes to the left with the prolongation of the last described course, for a long chord distance of to'` 446 . 36 feet (arc distance of 446 .41 feet) , for the point of beginning, said point of beginning being 33 . 0 feet radially distant southeasterly of the 4 center line of said State Route 31; thence easterly along a line which forms an angle of 68 degrees 37 minutes 50 seconds to the right with a prolongation of the said long chord, for a distance of 811 . 09 feet; thence northerly, along a line which forms an angle of 85 degrees 51 minutes 54 seconds to the left with a prolongation of the last described course, a distance of 1113 . 89 feet; thence northwesterly along said southerly line, at an angle of 92 degrees 11 minutes 44 seconds to the left with a prolongation of the last described course, 649 . 02 feet to the easterly right of way line of State Route 31; thence southerly, along said easterly right of way line, along the arc of a curve to the right having a radius of 3307 . 17 feet through a central angle of 15 degrees 53 minutes 16 seconds (the chord of said curve forms an angle of 81 degrees 41 minutes 38 seconds to the left with the prolongation of the last described course) , 917 . 07 feet; thence southwesterly, along said easterly right of way line, being tangent to the last described curve, a distance of 13 . 90 feet; thence southwesterly, along said easterly right of way line, being along a curve to the right having a radius of 8218 . 16 feet and being tangent to the last described course, a distance of 232 . 91 feet to the point of beginning, in the City of Elgin, Kane County, Illinois . be and is hereby granted subject to the following conditions : 1 . The number of adults temporarily residing at the crisis residential center at any given time shall be limited to eight. 2 . The average length of stay for residents shall be two weeks ( 14 days) . 3 . Compliance with the site plan prepared by Halsey Construction Company and dated May 25, 1991, revised July 1, 1991 . 4 . Substantial conformance with the petitioner' s statement. 5 . Compliance with all other applicable codes and ordinances . Section 3 . That Ordinance No. G-1626 entitled "An Ordinance Granting a Special Use for a Geriatric Day Care Center" passed on September 26, 1973 be and is hereby repealed. Section 4 . That Ordinance No. G31-77 entitled "An Ordinance Granting a Special Use for a Transitional Care Program for Ex-Drug Abusers" passed on June 22, 1977 be and is hereby repealed. Section 5 . That the special use granted herein shall expire if not established within one year from the date of passage of this ordinance. Section 6 . SUBJECT Consideration of Petition 35-91 Requesting a R-2 Single Family Residence District Special Use for a Community Service Facility, Property Located 695 South State Street by the Ecker Center for Mental Health, as Applicant and the Association for Individual Development, Inc. , as Owner. II.CONSIDERATIONS A petition has been filed by the Ecker Center for Mental Health, Inc. requesting a special use for a community service facility in the R-2 Single Family Residence District. The subject property is located at 695 South State Street. The petitioner desires to operate a crisis residential ( center to provide assistance to individuals who are in need of care beyond outpatient psychiatric counseling. The center would provide a short term, 24 hour home environment for a maximum of eight adult individuals. The average length of stay for program residents would be approximately two weeks (14 days) . The center would be staffed by a maximum of four employees at any one time. III.FINDINGS • After due notice, as required by law, the Land Use Committee held a public hearing on Petition 35-91 on May 20, 1991. The petitioner testified at the public hearing and presented documentary evidence. No objectors appeared at the hearing and no written objection has been filed. The Land Use Committee has made the following findings with respect to Petition 35-91: A. Site Characteristics: The subject property contains six acres and is improved with a one story residential structure. B. Sewer and Water: The subject property is serviced by a 10 inch sanitary sewer which is located southwest of the subject property and extended from the Elgin Mental Health facility. The subject property is -Page 1 - Exhibit A serviced by a 10 inch water main which extends from the Elgin Mental Health facility. C. Traffic and Parking: The subject property fronts on State Street (Illinois Route 31) . State Street is a major north-south arterial street serving the city' s near westside. Route 31 serves Kane and McHenry Counties, from the Illinois/Wisconsin border on the north, to Oswego on the south. State Street carries approximately 17,500 vehicles per day (1990 traffic count) . Trip generation data for the proposed community service facility are not available. The off-street parking ordinance does not contain provisions to regulate vehicle parking for community service facilities. However, city staff recommends the following parking requirements for the subject property: One space per employee plus one space per client and/or visitor, for a total of twelve parking spaces. There is sufficient area on site to provide the required number of parking spaces. Sources: Transportation Study, Elgin, 1990. D. Zoning History: The subject property was annexed in 1956, and is currently zoned R-2 special use. IE. Zoning Status: The subject property was granted a special use for a geriatric day care center by Ordinance No. G-1626 in 1973. The property was granted a special use for a transitional care program for ex-drug abusers in 1977 . F. Surrounding Land Use and Zoning: The subject property is located within an area zoned R-2. The Fox River is located to the east of the subject property. The area located to the north of the subject property is developed with the Secretary of State - State Highway Department Complex. The area located to the south of the subject property is developed with the State Police facility. The area located to the west of the subject property is developed with the Elgin Mental Health Facility. G. Trend of Development: The subject property is located in an area developed with community service facilities and office uses. H. Comprehensive Plan: The subject property is designated as Community Facilities in the Comprehensive Plan. -Page 2 - I. Special Use Standards: The Land Use Committee is of the opinion that Petition 35-91 is in substantial conformance with the special use standards. J. Conditions For Approval: The Land Use Committee is of the opinion that approval of Petition 35-91 should be subject to the following conditions: 1 . That Ordinance No. G-1626 which "granted a special use for a geriatric day care center" , on September 26, 1973 , is hereby repealed. 2. That Ordinance No. G31-77 which "granted a special use for a transitional care program for ex-drug abusers" on June 22, 1977, is hereby . repealed. • 3. The number of adults temporarily residing at the crisis residential center at any given time shall be limited to eight. 4 . The average length of stay for residents shall be two weeks (14 days) . [ 5. Submission and approval of a revised site plan per the Planning Department, with the exception that the revised plan shall include a minimum 20 feet drive aisle and 10 parking spaces. 6. Substantial conformance with the Petitioner's Statement. 7. Compliance with all other applicable codes and ordinances. IV. RECOMMENDATION On a motion to recommend approval of Petition 35-91, subject to the conditions for approval, the vote was five yes and zero no.
