G32-91 Ordinance No. G32-91 AN ORDINANCE GRANTING A SPECIAL USE FOR A DAY CARE CENTER ( 735 Dundee Avenue) WHEREAS, written application has been made for a special use for the establishment, maintenance and operation of a day care center at 735 Dundee Avenue; and WHEREAS, the Land Use Committee conducted a public hearing after due notice by publication and has submitted its findings of fact and recommended approval; and WHEREAS, the City Council of the City of Elgin concurs in the findings and recommendation of the Land Use Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1 . That the City Council of the City of Elgin hereby adopts the findings of fact made by the Elgin Land Use Committee, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. Section 2 . That a special use for a day care center at 735 Dundee Avenue, Elgin, Illinois, legally described as follows : McBride Heir' s Second Addition Except North 10 feet Lot 5 and Lot 6, Block 4, in the City of Elgin, Kane County, Illinois . be and is hereby granted subject to the following conditions: 1 . Substantial conformance with the site plan, prepared by RMD and Associates, dated February 20, 1991 . 2 . Compliance with all other applicable codes and ordinances . Section 3 . That Ordinances G21-85 and G1-90 granting a special use for an antique automobile repair garage are hereby repealed. Section 4 . That the special use granted herein shall expire if not established within one year from the date of passage of this ordinance. eft Section 5 . SUBJECT Consideration of Petition 23-91 Requesting a B-1 Community Business District Special Use for a Day Care Center, Property Located at 735 Dundee Avenue, by Two Rivers Headstart, as Applicant, and William B. O'Rourke, as Owner. II. CONSIDERATIONS A petition has been filed by Two Rivers Headstart requesting a B-i Community Business District Special Use for a day care center. The subject property is located at 735 Dundee Avenue. The petitioner proposes to utilize the existing structure to house a not-for-profit day care center. III.FINDINGS After due notice, as required by law, the Land Use Committee held a public hearing on Petition 23-91 on April 1 , 1991 . The petitioner testified at the public hearing and presented documentary evidence. No objectors appeared at the hearing and no written objection has been filed. The Land Use Committee has made the following findings with respect to Petition 23-91: A. Site Characteristics: The subject property is an irregularly shaped parcel containing approximately 19,802 square feet. The subject property is relatively flat and is improved with a one story building and an off-street parking lot. B. Sewer and Water: The subject property is currently serviced by an eight inch sanitary sewer, an eight inch water main, and a 12 inch storm sewer. Traffic and Parking: Dundee Avenue functions as a major arterial street serving the city' s northeast side. Dundee Avenue carries approximately 20,000 vehicles per day. Trip generation information is unavailable for day care centers. Full compliance with Section 19.44 - Off-street Parking of the Elgin Municipal Code is required, including the required number of parking spaces, access, aisles and stalls, setbacks, perimeter curb,. surfacing, stormwater control, landscaping, lighting, striping and marking, and signs. Surrounding Land Use and Zoning: The area located to the north of the subject property is zoned B-1 Community Business District and is developed with retail and office uses. The area located to the south of the subject property is zoned B-1 Community Business District and is developed with office and residential uses. The area located farther to the south is zoned R-2 Single Family Residence District and is developed with Larsen Middle School. The area located to the east of the subject property is zoned R-3 Two Family Residence District and is developed with residential uses. The area located to the west of the subject property is zoned B-1 Community Business District and is developed with retail, office, and residential uses. The area located farther to the west is zoned R-3 Two Family Residence District and is developed with residential uses. emb. -Page 2 - G. Trend of Development: The subject property is located within a strip commercial area. This area was developed prior to the adoption and implementation of zoning regulations governing site development, including setbacks, off-street parking and graphics. H. Comprehensive Plan: The subject property is designated transportation corridor in the Comprehensive Plan. I. Special Use Standards: The Land Use Committee is of the opinion that the proposed special use is in substantial conformance with the special use standards. J. Conditions for Approval: The Land Use Committee is of the opinion that approval of Petition 23-91 should be subject to the following conditions: 1. Remove the special use for an antique automobile repair garage, granted by Ordinances No. G21-85 and G1-90 2. Substantial conformance with the site plan, prepared by RMD and Assoc. , dated February 20, 1991.. 3. Compliance with all other applicable codes and ordinances. IV. RECOMMENDATION On a motion to recommend approval of Petition 23-91, subject to the conditions for approval, the vote was five yes and zero no. Therefore, the motion to recommend approval of Petition 23-91 was adopted. Robert W.
