S10-90 Ordinance No. S 10-90 AN ORDINANCE AUTHORIZING THE ACQUISITION OF CERTAIN PROPERTY FOR PUBLIC PURPOSES (Dundee Avenue Business District) WHEREAS, the City of Elgin has heretofore approved a redevelopment project area in the manner provided by Division 74.4 of Article 11 of Chapter 24 of the Illinois Municipal Code; and WHEREAS, real property located within said project area may be acquired for purposes of the objectives of the redevelopment project or plan; and WHEREAS, the acquisition of said property by purchase or eminent domain is authorized; and WHEREAS, the acquisition by eminent domain, if necessary, of certain real property described below is hereby determined reasonably necessary to achieve the objectives of the redevelopment plan and project. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section I. That it is hereby determined that it is necessary and desirable that the City of Elgin shall acquire title to and possession of the following described real property, which property is necessary, required and needed for the purpose of achieving eak the objectives of the redevelopment plan and project. Parcel 8: Lots I and 2 of Babbitt's Addition to Elgin, being a subdivision of Block 25 of P.J. Kimball's Jr. Third Addition, in the City of Elgin, Kane County, Illinois. (Commonly known as 470 Dundee Avenue) Parcel 10: Lot 4 of Babbitt's Addition to Elgin, being a subdivision of Block 25 of P.J. Kimball Junior's Third Addition, in the City of Elgin, Kane County, Illinois. (Commonly known as 450 Dundee Avenue) Parcel I I: Lot 4 (except the South 45 feet) of Wm. H. Wilcox's Second Addition to Elgin, in the City of Elgin, Kane County, Illinois. (Commonly known as 436-438 Dundee Avenue) Parcel 13: Lot 3 of Wm. H. Wilcox's 2nd Addition to Elgin, in the City of Elgin, Kane County, Illinois. (Commonly known as 432 Dundee Avenue) eulk Parcel 14: Lots I and 2 of W. H. Wilcox's Second Addition to Elgin, in the City of Elgin, Kane County, Illinois. (Commonly known as 400 Dundee Avenue) Section 2. That Larry L. Rice, City Manager of the City of Elgin, be and is hereby authorized, empowered and directed to negotiate for and on behalf of the City of Elgin with the owner or owners of the above described real property for the purchase by the City of Elgin of the real property described in Section I. Section 3. That the City Manager be and is hereby authorized to offer the following sums as and for compensation to the owner or owners of the above-described property; said offer shall be in writing: Parcel as Described Above Authorized Sum Parcel 8 $ 221,000.00 Parcel 10 $ 180,000.00 Parcel II $ 94,000.00 • Parcel 13 $ 81,200.00 Parcel 14 $ 245,000.00 lg.6' Section 4. In the event that the City Manager is unable to agree with the owner or owners of said property as to compensation to be paid therefor, in accordance with the provisions of this ordinance, then title to and possession of said property shall be acquired by the City of Elgin in accordance with the laws of eminent domain of the State of Illinois, and Wayne M.
