Ordinance No. G64-90 AN ORDINANCE AMENDING CHAPTER 10 .62 OF THE ELGIN MUNICIPAL CODE REGARDING TRAPPING AND HUNTING WITHIN THE CORPORATE LIMITS BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1 . That Chapter 10. 62 entitled "Trapping" of the Elgin Municipal Code, 1976, as amended, is repealed and deleted. Section 2 . That the Elgin Municipal Code, 1976, as amended, be and is further amended by adding Chapter 10.62 entitled "Hunting/Trapping" , as follows : "CHAPTER 10 .62 HUNTING/TRAPPING 10. 62 . 010 Definitions. A. "Hunt" means the act or attempt of a person possessing a weapon or being accompanied by a dog or a bird of prey to shoot, pursue, chase, track, lure, kill, destroy, ensnare or harass any mammal or bird. B. "Trap" means to capture, or attempt to capture a bird or mammal by setting or placing a leg hold trap, body-gripping trap, spring trap, cage, deadfall, pit/trap, live trap, snare or snare-like device, or other similar device designed or used to capture, hold or kill . 10 . 62 . 020 Unlawful Acts Designated. It is unlawful for any person, other than a law enforcement official acting in the line of duty, to hunt or trap or aid, abet, assist, facilitate or otherwise allow another to hunt or trap any bird or mammal within the City of Elgin. 10 . 62 . 030 Seizure. The police shall seize any weapon, or trap device used in any manner in violation of the provisions of this chapter. Such weapon or trap device shall be held by the police department pending disposition of any court proceedings arising out of such violations . 10.62 . 040 Penalty. A. Any person violating any provisions of this chapter shall be fined not less than $200. 00 nor more than $1,000 . 00. B. In addition to any fine that may be imposed upon conviction of violating any provision of this chapter, the court may transfer the weapon or trap device to the City of Elgin Police Department which shall dispose of the weapon in the manner provided by law. " Section 3 . That all ordinances or parts thereof in conflict with this ordinance are repealed. Section 4 .
