G61-90 Ordinance No. G61-90 AN ORDINANCE CLASSIFYING CERTAIN NEWLY ANNEXED TERRITORY AND GRANTING A SPECIAL USE FOR A FREESTANDING COMMERCIAL STRUCTURE (Southwest Corner of Randall Road and Weld Road) WHEREAS, the territory herein described has been annexed to the City of Elgin; and WHEREAS, written application has been made to classify said territory in the R-2 Single Family Residence District and B-3 Service Business District and for a special use for a freestanding commercial structure; and WHEREAS, after due notice in the manner provided by law the Land Use Committee conducted a public hearing concerning said application and has submitted its written findings and recommendation. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1 . That Chapter 19 . 08.020, entitled "Zoning District Map" of the Elgin Municipal Code, 1976, as amended, be and the same is hereby further amended by adding thereto the following paragraph: "The boundaries hereinbefore laid out in the 'Zoning District Map' , as amended, be and are hereby altered by including in the R-2 Single Family Residence District the following described property: Part of the Southwest Quarter of Section 16, part of the Southeast Quarter of Section 17, part of the Northeast Quarter of Section 20 and part of the Northwest Quarter of Section 21, all in Township 41 North, Range 8 East of the Third Principal Meridian, described as follows : Beginning at the Southeast corner of said Northeast Quarter of Section 20; thence North 89 degrees 57 minutes 58 seconds West, along the South line of said Northeast Quarter, a distance of 1425.00 feet to a monumented line; thence North 01 degrees 18 minutes 42 seconds East, along said monumented line, a distance of 1064 .86 feet (record being 1056 .00 feet) to an existing iron stake; thence North 81 degrees 46 minutes 06 seconds East, along a monumented line, a distance of 105.32 feet (record being 105.50 feet) to the southerly extension of the westerly line, as monumented, of Weldwood Oaks, being a subdivision of part of the e Southwest Quarter of Section 16 and part of the Southeast Quarter of Section 17 and part of the Northeast Quarter of Section 20, all in township and p range aforesaid; thence South 88 degrees 40 minutes 08 seconds East, a distance of 383. 19 feet (record being 384 . 14 feet) ; thence North 10 degrees 46 minutes 46 seconds East, parallel with the westerly line, as monumented, of said Weldwood Oaks, a distance of 253.00 feet to the southerly line, as monumented, of a dedicated public road per Document No. 1124023; thence South 79 degrees 07 minutes 58 seconds East, along said southerly line, as monumented, a distance of 106 . 10 feet (record being 106 . 00 feet) to the southeasterly corner thereof; thence North 10 degrees 52 minutes 02 seconds East, along an easterly line, as monumented, of said dedicated road, a distance of 40.00 feet; thence North 32 degrees 12 minutes 07 seconds East, along said easterly line, as monumented, tangent to the last described curve, a distance of 101 .22 feet (record being 101.27 feet) ; thence northerly, along said easterly line, as monumented, being along a curve to the left having a radius of 112 . 67 feet, tangent to the last described course, an arc distance of 88.49 feet; thence North 80 degrees 54 minutes 53 seconds West, a distance of 436 .39 feet to a line that is 150 .00 feet, measured perpendicular, southeasterly of and parallel with the aforesaid Line "A"; thence South 20 degrees 11 minutes 45 seconds West, parallel with said Line "A", a distance of 483.49 feet to a line that is 945. 00 feet, measured perpendicular, westerly of and parallel with the aforesaid westerly right of way line, as monumented, of Randall Road; thence South 09 degrees 05 minutes 07 seconds West, along said parallel line, a distance of 600.00 feet; thence South 11 degrees 46 minutes 19 seconds West, a distance of 320 .00 feet; thence South 41 degrees 10 minutes 31 seconds West, a distance of 160. 00 feet to a line that is 1045.00 feet, measured perpendicular, westerly of and parallel with the aforesaid westerly right of way line, as monumented, of Randall Road; That Chapter 19 .08.020, entitled "Zoning District Map" of the Elgin Municipal Code, 1976, as amended, be and the same is hereby further amended by adding thereto the following paragraph: "The boundaries hereinbefore laid out in the 'Zoning District Map' , as amended, be and are hereby altered by including in the B-3 Service Business District the following described property: Part of the Southwest Quarter of Section 16, part of the Southeast Quarter of Section 17, part of the Northeast Quarter of Section 20 and part of the Northwest Quarter of Section 21, all in Township 41 North, Range 8 East of the Third Principal Meridian, described as follows: Beginning at a point of the westerly right of way line, as monumented, of Randall Road per Document No. 1040510 that is 298.00 feet, measured along said westerly right of way line, as monumented, southerly of the intersection of said westerly right of way line, as monumented, and a southerly line, as monumented, according to the plat of condemnation for right of way for a public highway (U.S. Route 20 - Federal Aid Route 6) as established by proceedings in the Circuit Court of Kane County, Illinois, Case No. 60-1166; thence North 80 degrees 54 minutes 53 seconds West, perpendicular to said westerly right of way line, as monumented, of Randall Road, a distance of 250. 17 feet (record being 247.78 feet) to the intersection with the southeasterly extension of a southwesterly line, as monumented, of said Circuit Court Case No. 60-1166; thence North 14 degrees 14 minutes 25 seconds West, along the said southeasterly extension . of and along the southwesterly line, as monumented, of said Circuit Court Case No. 60-1166 and being rft. along the westerly line of Parcel No. 0003, according to page two of five per the right of way plan per Document No. 1685673, a distance of 417 .40 feet; thence North 80 degrees 54 minutes 53 seconds West, a distance of 436 .39 feet to a line that is 150 . 00 feet, measured perpendicular, southeasterly of and parallel with a southeasterly line, as monumented, of Weldwood Oaks, being a subdivision of part of the Southwest Quarter of Section 16 and part of the Southeast Quarter of Section 17 and part of the Northeast Quarter of Section 20, all in township and range aforesaid; thence South 20 degrees 11 minutes 45 seconds West, along said parallel line, a distance of 483 .49 feet to a line that is 945 .00 feet, measured perpendicular, westerly of and parallel with the aforesaid westerly right of way line, as monumented, of Randall Road; thence South 09 degrees 05 minutes 07 seconds West, along said parallel line, a distance of 600. 00 feet; thence South 11 degrees 46 minutes 19 seconds West, a distance of 320 . 00 feet; thence South 41 degrees 10 minutes 31 seconds West, a distance of 160.00 feet to a line that is 1045 .00 feet, measured perpendicular, westerly of and parallel with the aforesaid westerly right of way line, as monumented, of Randall Road; thence South 09 degrees 05 minutes 07 seconds West, along said parallel line, a distance of 639 .07 feet; thence South 80 degrees 54 minutes 53 seconds East, perpendicular to the last described course, a distance of 649 .72 feet; thence South 45 degrees 03 minutes 04 seconds West, a distance of 240 .00 feet; thence South 09 degrees 05 minutes 07 seconds West, parallel with the aforesaid westerly right of way line, as monumented, of Randall Road, a distance of 211.98 feet; thence South 80 degrees 54 minutes 53 seconds East, perpendicular to the last described course, a distance of 536 .23 feet to the aforesaid westerly right of way line, as monumented, of Randall Road; thence North 09 degrees 05 minutes 07 seconds East, along said westerly right of way line, as monumented, a distance of 2191. 64 feet to the point of beginning. Being situated in Elgin Township, Kane County, Illinois and containing 50 .00 acres more or less . " Section 3. That the City Council of the City of Elgin hereby grants a special use for a freestanding commercial structure with a maximum floor area of 5,000 square feet within the parking area of the shopping center north of South Street extended. Section 4 .
