G53-90 Ordinance No. G53-90 AN ORDINANCE AMENDING THE PROVISIONS OF THE MUNICIPAL CODE RELATING TO THE BOARD OF FIRE AND POLICE COMMISSIONERS WHEREAS, the City of Elgin is a home rule unit within the meaning of the 1970 Constitution of the State of Illinois; and WHEREAS, a home rule unit may exercise any power and perform any function pertaining to its government and affairs; and WHEREAS, the authority of the Board of Fire and Police Commissioners is a matter pertaining to the government and affairs of the City of Elgin. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1 . That Section 3 . 08 . 020 (B) and (C) of Chapter 3 . 08 of the Elgin Municipal Code, 1976 as amended, is hereby amended to read as follows : B. The fire chief, deputy chiefs, the supervisor of training, superintendent of the bureau of inspection services for the fire department and the chief and deputy chiefs of the police department shall be appointed by the city manager and shall be subject to removal by the city manager. C. No person shall be permitted to test for, nor be appointed by the Board to any position in the fire or police department unless such person is a citizen of the United States of America. Section 2 . That all ordinances or parts thereof in conflict with this ordinance be and are hereby repealed. Section 3 .
