G71-89 Ordinance No. G71-89 AN ORDINANCE AMENDING ORDINANCE NO. G70-82 ENTITLED "AN ORDINANCE DESIGNATING AN ENTERPRISE ZONE UNDER THE ILLINOIS ENTERPRISE ZONE ACT" WHEREAS, Ordinance No. G70-82, passed on December 22, 1982, designated a contiguous area within the City of Elgin as an enterprise zone under the Illinois Enter- prise Zone Act; and WHEREAS, it is proposed that certain territory be added which is hereafter described and located in the City of Elgin, which is contiguous to said enterprise zone, will not result in a zone which is more than 10 square miles in total area. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section I. That it hereby finds and determines that the territory described in Section 2 of the ordinance is contiguous to the enterprise zone designated by Ordinance No. G70-82, passed December 22, 1982, and will not result in a zone which is more than 10 square miles in area. Section 2. That Section 2 of Ordinance No. G70-82, passed December 22, 1982, is amended to add the following territory to the enterprise zone designated in said ordi- nance: Subarea A That part of the Southwest Quarter of Section 13 and the Northwest Quarter of Section 24, Township 41 North, Range 8, East of the Third Principal Meridian described as follows: Beginning at the point of inter- section of the right-of-way centerline of Prairie Street with the right-of- way centerline of Villa Street; thence Southeasterly along said Villa Street centerline to the intersection with the right-of-way centerline of National Street; thence Southwesterly along said National Street centerline to the intersection with the right-of-way centerline of Raymond Street; thence Southeasterly along said Raymond Street centerline to the intersection with the right-of-way centerline of Watch Street; thence Southwesterly along said Watch Street centerline to the intersection with the right-of- way centerline of Wellington Avenue; thence Northwesterly along said Wellington Avenue centerline to the intersection with the right-of-way centerline of Prairie Street; thence Easterly along said Prairie Street centerline to the place of beginning. Being situated in the City of Elgin, Elgin Township, Kane County, Illinois. Subarea B That part of the Northeast Quarter of Section 14, Township 41 North, Range 8, East of the Third Principal Meridian described as follows: Beginning at the point of intersection of the right-of-way centerline of Highland Avenue with the East bank of the Fox River; thence North- westerly along said East bank of the Fox River to the intersection with the i Y right-of-way centerline of Kimball Street; thence Southwesterly along said Kimball Street centerline of the intersection with the right-of-way center- line of State Street, Illinois Route 31; thence continuing in a Southwesterly direction along the right-of-way centerline of Lawrence Avenue to the point of intersection with the right-of-way centerline of Crystal Avenue; thence Southeasterly along said Crystal Avenue centerline to the inter- section with the right-of-way centerline of Highland Avenue; thence Northeasterly along said Highland Avenue centerline to the place of beginning. Being situated in the City of Elgin, Elgin Township, Kane County, Illinois. Section 3. That the City Manager is hereby authorized and directed to cause to be prepared and filed an application with the Illinois Department of Community Affairs to add the territory described in Section 2 to the enterprise zone designated by Ordi- nance No. G70-82, passed December 22, 1982, and previously certified by the Depart- ment. Both Rohlwing Brothers, Inc. and Joe's Quality Glass are interested in making substantial improvements to their respective business properties, each of which are located on the west side of Nurtll Stale Stleet in the block acruss from the Woodruff and Edwards property. Both of my clients would like to have the Elgin Enterprise Zone expanded to include their respective properties. Currently the Enterprise Zone does cross over to the west side of the Fox River along Highland Avenue but does not extend to the north of Highland Avenue. We would ask that the City of Elgin cause the Enterprise Zone to be extended northward along State Street so as to include the properties of Rohlwing Brothers, Inc. and Joe's Quality Glass. Given the fact that North State Street is a main entrance corridor to the City's downtown area, we would hope that the City would support this expansion and actively move to implement the expansion through the appropriate channels of the State of Illinois. , The Honorable Mayor George VanDeVoorde Page Two January 17, 1989 After briefly discussing this matter with Roger Dahlstrom of the City's Planning Department, it is my understanding that this matter must be brought before one of Elgin's Advisory Commissions and then eventually to the City Council for approval. Thereafter, it is my understanding that the City would have to file an application to amend its current Enterprise Zone with the State of Illinois, Department of Commerce and Community Affairs. Since each of my clients wishes to make substantial improvements to its property sometime during mid-1989, we would very much appreciate the City taking prompt action on this request. BACKGROUND: Each year the City crews perform work within the right-of-way of State highways. The work may be in the form of route maintenance or of an emergency nature. If contractors are hired to do the work, they are to obtain a performance bond for each project. The State allows the City to do the work without a performance bond provided the City adopts a resolution pledging its good faith and guarantees that all work will he performed in accordance with State standards and holds the State harmless of any accidents and damages. One resolution covers all work for the entire year. For normal work, a permit application and approval is necessary for each project . For emergency work we are required to call and get a verbal approval. This is followed by an application for a permit. The period covered by this resolution is January 1 to December 31 , 1989 . FINANCIAL IMPACT: There is no cost involved. On the other hand, there is a saving since the resolution permits the City crews to perform the work without delay and without any perfor- mance bond. RECOMMENDATION: It is recommended that the City Council adopt this resolution, a opy of which is attached for your review. CITY ER attachment ' A RESOLUTION IN LIEU OF SURETY BOND FOR WORK DONE IN STATE OF ILLINOIS RIGHTS OF WAY WHEREAS, the City of Elgin, located in the Counties of Kane and Cook, State of Illinois, desires to undertake, in the year 1989, the location, construction, operation and maintenance of driveways and street returns, watermains, sanitary and storm sewers, street light, traffic signals, sidewalk, landscaping, etc., on State highways, within the City of Elgin, which by law and/or agreement come under the jurisdiction and control of the Department of Transportation of the State of Illinois hereinafter referred to as Department; and WHEREAS, an individual working permit must be obtained from the Department of Transportation prior to any of the aforesaid installations being constructed either by the City of Elgin or by a private person or firm under contract and supervision of the City of Elgin. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that the City of Elgin hereby pledges its good faith and guarantees that all work shall be performed in accordance with the conditions of the permit to be granted by the Department of Transportation, and to hold the State of Illinois harmless on account of any damages that may occur to persons or property during the prosecution of such work, and assume all liability for damages to persons or property due to accidents or otherwise by reason of the work which is to be performed under the provision of said permit. BE IT FURTHER RESOLVED that all authorized officials of the City of Elgin are hereby instructed and authorized to sign said working permit on behalf of the City of Elgin.
