G31-89 Ordinance No. G31-89 AN ORDINANCE CLASSIFYING CERTAIN NEWLY ANNEXED TERRITORY (Northwest Corner of Randall Road and WinHaven Drive) WHEREAS, the territory herein described has been annexed to the City of Elgin; and WHEREAS, written application has been made to classify said territory in the R-2 Single Family Residence District; and WHEREAS, after due notice in the manner provided by law the Land Use Committee conducted a public hearing concerning said application and has submitted its written findings and recommendation; and WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings and recommendations of the Land Use Committee and concurs in its recommendation; and WHEREAS, Ordinance No. G3I-89 passed April 12, 1989 does not accurately describe the territory classified. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section I. That Ordinance No. G3I-89 passed April 12, 1989 be and is hereby repealed. Section 2. That Chapter I9.08, Section 19.08.020, entitled "Zoning District Map" of the Elgin Municipal Code, 1976, as amended, be and the same is hereby further amended by adding thereto the following paragraph: "The boundaries hereinbefore laid out in the 'Zoning District Map', as amended, be and are hereby altered by including in the R-2 Single Family Residence District, the following described property: Lots 7, 8 and 9 and Outlot "A" in Block 9 of Fourth Addition to Almora Heights, excepting that part thereof dedicated for highway purposes by Document Number 880361 (affects Lot 9 and Outlot "A") and Document Number 1151904 (affects Outlot "A"), in the Township of Elgin, Kane County, Illinois. Also that part of WinHaven Drive, being adjacent to and contiguous to said Lots 7, 8, and 9 except that part of WinHaven Drive, being adjacent to and contiguous to Lot 21 in Block 7 of Fourth Addition to Almora Heights and that part of Howard Avenue, being adjacent to and contiguous to Outlot "A"." 41. Section 3. BACKGROUND The City Council passed ordinances annexing and classifying the referenced territory on April 12 , 1989 . The City Clerk was emk unable to record the annexation documents due to an error in the legal description . The petitioner has corrected the legal description on the annexation plat . The City Council must consider an amended ordinance classifying the newly annexed territory, which includes the corrected legal description (see attached) . RECOMMENDATION Adopt Ordinance No .
