G97-89 f Ordinance No. G97-89 AN ORDINANCE AMENDING ORDINANCE NO. G34-84 AMENDING A SPECIAL USE ORDINANCE FOR A SANITARIUM AT 600 VILLA STREET WHEREAS, by Ordinance No. GI0-81 passed February 25, 1981 a special use permit was granted for the establishment, operation and maintenance of an alcoholic treatment sanitarium at the premises commonly known as 600 Villa Street, Elgin, Illinois; and WHEREAS, by Ordinance No. G42-82 passed August 11, 1982 the special use permit was amended to include non-hospital medical detoxification and an adolescent primary alcoholic rehabilitation program including , related substance abuse treatment as permitted activities under the special use granted for the establishment; and WHEREAS, by Ordinance No. G34-84 passed June 25, 1984 the special use permit granted was amended to include a residential treatment center and therapeutic school program and a day treatment and school program; and WHEREAS, a written application has been made to again amend the special use permit granted by said ordinances so as to permit the expansion of its residential treat- ment program and day school program; and WHEREAS, the Land Use Committee conducted a public hearing after due notice by publication and has submitted its findings of fact and recommended approval; and eink WHEREAS, the City Council of the City of Elgin concurs in the findings and recommendation of the Land Use Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section I. That the City Council of the City of Elgin hereby adopts the findings of fact made by the Elgin Land Use Committee to permit the expansion of the residential treatment program and day school program at 600 Villa Street, Elgin, Illinois, a copy of which is attached hereto and made a part hereof by reference as Exhibit A, subject to the following conditions: I. Substantial conformance with the petitioner's Zoning Statement of Conformance; the amended statement dated September 18, 1989, the Lovellton Academy Program Overview, and the Lovellton Day School brochure. The residential treatment program and the day school program to be limited to a maximum of 60 residents and 32 students. 2. Compliance with the licensing requirements of the Department of Children and Family Services, Illinois State Board of Education, Governor's Purchase Care Review Board, North Central Accreditation, Joint Commission of Accredited Hospitals and Organizations. 3. Submission of a site plan documenting compliance with the off-street parking ordinance. 4. Compliance with all other applicable codes and ordinances. Section 2. That, except as amended herein, Ordinance Nos. G10-81, G42-82 and G34-84 remain in full force and effect. Section 3. SUBJECT Petition 82- 89 Requesting an Amendment to Ordinance No . G34-84 which Granted a Special Use for a Sanitarium , to Allow for the Increased Capacity of the Residential Treatment Program and Day School Program , property located at 600 Villa Street , by Forest Health System, Inc . , as Applicant and Owner. II . CONSIDERATIONS A petition has been filed by Attorney Allen Anderson on behalf of Forest Health Systems , Inc . requesting an amendment to Special Use Ordinance No. 034-84 to increase the number of students allowed in the residential treatment ork program from 40 to 60 . The subject property is located at 600 Villa Street . Lovellton was granted a special use in 1981 to operate an alcoholic treatment sanitarium. The special use was amended in 1982 to include non-hospital detoxification and an adolescent primary alcoholic rehabilitation program , including related substance abuse treatment. The special use was again amended in 1984 to include a residential treatment center and therapeutic school program , and a day treatment and school program. Lovellton has discontinued the operation of the primary alcohol and substance abuse treatment program , and desires to expand their residential treatment program. III , FINDINGS After due notice , as required by law , the Land Use Committee held a public hearing on the proposed special use on September 18 , 1989 . The petitioner testified at the hearing and presented documentary evidence . No objectors appeared at the hearing and no written objection has been filed . The Land Use Committee has made the following findings with eft -Page 1- Exhibit A respect to Petition 82-89 : A. Site Characteristics : The subject property contains approximately 60 ,800 square feet . The property is improved with a former residence , which has been converted to institutional use , and _ accessory off-street parking . B. Sewer and Water : The subject property is served from a ten inch watermain , an eight inch sanitary sewer , and a ten inch storm sewer . There are no capacity limitations for the proposed use . C. Traffic and Parking : Liberty Street and Villa Street function as arterial streets serving the south and east sides of the city. Liberty Street has a design capacity of approximately 15 ,000 vehicles per day and carries approximately 13 ,850 vehicles per day. Villa Street has a design capacity of approximately 20 ,000 vehicles per day and carries approximately 9 ,720 vehicles per day. Trip generation estimates are not available for sanitariums . The off-street parking requirement for a sanitarium is one space per every three beds , plus one space per employee . The petitioner proposes a 60 bed residential therapy program with a maximum of 45 employees during ft peak -hours of operation . Thirty-two students are enrolled in the day school program. It is recommended that one parking space be provided for every six students . Accordingly, a total of 70 parking spaces are required . The existing parking lot contains 52 spaces . Amendments to the special use were granted in 1982 and 1984 . E. Zoning Status : The subject property is improved with a lawful R-4 special use for a sanitarium, which is subject to the provisions of ordinances adopted in 1981 , 1982 and 1984 . r -Page 2- • F. Surrounding Land Use and Zoning : The areas located to the north , east and west of the subject property are tek zoned R-4. These areas are improved with residences , including single family, two family and multiple family. The areas located to the south and southeast of the subject property are zoned B- 1 and B-3 . These areas are improved with an office building , a gas station/convenience store , and residences . G. Trend of Development : The subject property is located within a mature residential neighborhood , with commercial uses centered on the Liberty/Villa intersection . H. Comprehensive Plan : The subject property is designated "urban residential" . Liberty Street and Villa Street , and the lots fronting on those streets , are included in designated "transportation corridors" . I . Special Use Standards , The proposed special use for a residential treatment program and a day school program is in substantial conformance with the special use standards . J . Conditions for Approval : The Land Use Committee is of rft the opinion that approval of Petition 82-89 should be subject to the following conditions : 1 . Substantial conformance with the petitioner's Zoning Statement of Conformance; the amended statement dated September 18 , 1989 , the Lovellton Academy Program Overview , and the Lovellton Day School brochure .
