G56-88 [ Ordinance No. G56-88 AN ORDINANCE GRANTING A SPECIAL USE FOR AN OFF-STREET PARKING LOT WHEREAS, written application has been made for a special use for the establish- ment, maintenance and operation of an off-street parking lot at 562, 566 and 570 Lincoln Avenue and 802 and 810 North Liberty Street, Elgin, Illinois; and WHEREAS, the Land Use Committee conducted a public hearing after due notice by publication and has submitted its findings of fact and recommended approval; and WHEREAS, to grant the special use requested the City Council of the City of Elgin concurs in the findings and recommendation of the Land Use Committee; and WHEREAS, the applicant has made certain representations concerning the use of adjoining property to be served by the off-street parking lot which is the subject of the special use application. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section I. That the City Council of the City of Elgin hereby adopts the findings of fact made by the Elgin Land Use Committee, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. Section 2. That a special use for an off-street parking lot at 562, 566 and 570 Lincoln Avenue and 802 and 810 North Liberty Street, Elgin, Illinois, legally described as follows: The East 44 feet of Lot 8; the East 22 feet of Lot 7 and the West 22 feet of Lot 8; the North half of Lots 9 and 10; the South half of Lot 9, except the West 50 feet, and the South half of Lot 10; and the South half of the West 50 feet of Lot 9; all in Block I of McBride Heirs' Second Addition to Elgin, in the City of Elgin, Kane County, Illinois. be and is hereby granted subject to the following conditions: I. Access shall be limited to that existing on North Liberty Street and Chester Avenue. 2. One hundred percent screening on all sides of the parking lot adjacent to residence districts including continuation of six foot solid fence which exists along westerly property line to the 20 foot setback line along Lincoln Avenue. 3. Removal of curb-cut off-street parking along the north property line of the property located at 820 North Liberty Street. 4. Removal of asphalt surfacing and installation of suitable landscaping ground cover in the tree bank of the property located at 820 North Liberty Street. rek 5. An eight foot setback along Lincoln Avenue shall be maintained and no parking shall be permitted in the setback. 6. A solid fence shall be constructed from Chester Avenue to Lincoln Avenue. 7. Existing fence shall be repaired and maintained in good condi- tion. 8. Parking lot shall be illuminated by directional lighting which shall not intrude onto adjoining residential areas. 9. Submission by applicant of written consent to all conditions imposed by this ordinance. 10. Compliance with all other applicable codes and ordinances. Section 3. That the special use granted herein shall expire if not established within one year from the date of passage of this ordinance. Section 4. SUBJECT Consideration of Petition 28-88 Requesting a R-3 Two Family Residence District Special Use for an Off-street Parking Lot, property located at 562, 566, and 570 Lincoln Avenue and at 802 and 810 North Liberty Street by the Elgin American Legion Post 57 Home Association, as Applicant and Owner. II. CONSIDERATIONS A petition has been filed by the Elgin American Legion Post 57 Home Association which requests a special use for off-street parking. The subject properties are located at 562, 566 and 570 Lincoln Avenue and 802 and 810 North Liberty Street. The petitioners desire to expand the off-street parking for their meeting hall and dining facility which is located at 820 North Liberty Street. The petitioners plan to demolish the five existing residential structures located at 562, 566 and 570 Lincoln Avenue and 802 and 810 North Liberty to develop an off-street parking facility. When combined with the existing off-street parking supply of 40 spaces, the total will be 100 spaces. V. FINDINGS After due notice, as required by law, the Land Use Committee held a public hearing on the proposed special use for a parking lot on May 16, 1988. The petitioner testified at the hearing and presented documentary evidence. Objectors appeared at the hearing and written objection has been filed to the proposed special use. A majority of the Land Use Committee has made the following findings with respect to Petition 28-88: A. Site Characteristics: The subject property is comprised of five residential lots containing approximately 29,000 square feet ( .66 acre) . The subject property is improved with five residential structures. Exhibit A -Page 1- B. Zoning History: 1927 B-Res. 1960 D-Comm. 1962 R-3 1950 D-Comm. 1961 D-Comm. Present R-3 C. Surrounding Land Use and Zoning: The areas located to the east, south, and west of the subject property are zoned R-3 Two Family Residence District and are developed with single and two family residences. The areas located to the immediate north and northeast fronting on North Liberty, are zoned B-3 Service Business District and are developed with the American Legion building and several retail uses. The area located north of Chester Avenue is zoned M-1 and is developed with a multi-level manufacturing and office structure. D. Trend of Development: The subject property is located in a mature residential neighborhood which is bisected by North Liberty Street. Generally, retail and business uses have concentrated along North Liberty Street, north of Chester Avenue. E. Traffic and Parking: North Liberty Street (Rt. 25) functions as a major north-south arterial for the east central portion of the city. North Liberty Street has a design capacity of approximately 15,000 vehicles per day. Currently, North Liberty Street carries approximately 14,780 vehicles per day. Lincoln Avenue functions as a neighborhood service road. Lincoln Avenue has a design capacity of approximately 8,000 vehicles per day. Currently, Lincoln Avenue carries 287 vehicles per day. Based upon information supplied by the petitioner, a total of 51 off-street parking spaces will be required. The meeting room will require 28 off-street parking spaces (at least four spaces plus one space for every five chairs in the meeting hall/120 chairs) . The restaurant/bar use will require 22 off-street parking spaces (one space for every 60 square feet of floor area) . The office use will require one off-street parking space (one space for every 250 sqare feet of floor area) . E.M.C. 19.44.090 - Off-street Parking. e.. F. Sewer and Water: The subject property is serviced by four and eight inch watermains, a 12 inch storm sewer, and eight and ten inch sanitary sewers. There are no capacity limitations for the proposed use at the subject property. G. Special Use Standards: The committee has found that the proposed special use for parking is in substantial conformance to the special use standards. H. Conditions for Approval: The Land Use Committee is of the opinion that the approval of Petition 28-88 should be subject to the following conditions: 1. Access limited to those existing onto North Liberty Street and Chester Avenue. 2. Maintain a twenty (20) foot parking lot setback on the Lincoln Avenue blockface. This area to be used solely for green space. 3. One hundred percent screening on all sides of the parking lot adjacent to residence districts. One hundred percent landscape screening on the south and east sides of the parking lot. Continuation of six rft. foot solid fence which exists along the westerly property line to the 20 foot setback line along Lincoln Avenue. 4. Restoration of the treebank areas, including the removal of cement around the American Legion building. 5. Submission of a site plan prior to the granting of a construction permit that conforms to the Elgin Muncipal Code. 6. Review and recommendation from the Traffic Committee to the City Council regarding the current on-street parking situation in that area. 7. Compliance with all other applicable codes and ordinances. IV. RECOMMENDATION On a motion to recommend approval of Petition 28-88, subject to the conditions for approval, the vote was six (6) yes and one (1) no.
