G51-88 (2) Ordinance No. G51-88 Revised AN ORDINANCE GRANTING A SPECIAL USE FOR TEMPORARY MINING WHEREAS, written application has been made for a special use for the temporary mining of gravel in conjunction with site preparation for the proposed industrial park at U.S. Route 20, adjacent to the Elgin, Joliet and Eastern Railroad; and WHEREAS, the 'Land Use Committee conducted a public hearing after due notice by publication and has submitted its findings of fact and recommended approval; and WHEREAS, the City Council of the City of Elgin concurs in the findings and recommendation of the Land Use Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section I. That the City Council of the City of Elgin hereby adopts the findings of fact made by the Elgin Land Use Committee, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. Section 2. That a special use for the temporary mining of gravel at U.S. Route 20, adjacent to the Elgin, Joliet & Eastern Railroad, Elgin, Illinois, legally described as follows: That part of the Southeast Quarter of Section 20, Township 41 North, Range 9 East of the Third Principal Meridian, described as follows: Beginning at the point of intersection of the easterly right-of-way line of the Elgin, Joliet and Eastern Railroad property and the southerly line of Lot "C" in the plat filed with Commissioner's Report in Partition, in Case Number 19700, in the Circuit Court of Cook County; thence South 83 degrees East, along said southerly line, a distance of 896.25 feet, to the East line of Lot 17, in County Clerk's Division of Section 20, according to the plat thereof, recorded May 31, 1895 as Document Number 2227309; thence South 22 degrees 30 minutes west, a distance of 1739.10 feet; thence South 53 degrees 45 minutes West, a distance of 309.80 feet; thence South 60 degrees 29 minutes 39 seconds East, a distance of 415.08 feet; thence South 29 degrees 30 minutes 21 seconds West, a distance of 303.35 feet to the northerly line of U.S. Route 20 (Lake Street) as dedicated by Document Number 9171745; thence northwesterly along said northerly line, and along a curve having a radius of 2321.83 feet, an arc distance of 80.00 feet; thence North 29 degrees 30 minutes 21 seconds East, a distance of 237.35 feet; thence North 60 degrees 29 minutes 39 seconds West, a distance of 364.80 feet; thence South 53 degrees 45 minutes West, a distance of 308.30 feet to the northerly line of U.S. Route 20 (Lake Street) as widened by Document Number 11165591; thence North 64 degrees 28 minutes 54 seconds West, a distance of 105.47 feet to the easterly right-of- way line of the Elgin, Joliet and Eastern Railroad; thence North 8 degrees 52 minutes 30 seconds East, along said Easterly line, a distance of 2116.59 feet, to the point of beginning, all in the City of Elgin, Cook County, Illinois, and containing 35.321 acres, more or less. be and is hereby granted subject to the following conditions: I. Substantial compliance with revised Operation and Reclamation Plan, a copy of which is attached. 2. Compliance with all other applicable codes and ordinances. Section 3. That the special use granted herein shall expire if not established within one year from the date of passage of this ordinance. Section 4. SUBJECT Consideration of Petiton 51-87 Requesting a M-I Limited Manufacturing District Special Use for Temporary Mining, property located on U. S. Route 20, East of and Adjacent to the Elgin, Joliet and Eastern Railroad by Oakridge Development , as Applicant and by Trust No. 86-030, First American Bank of Kane County, as Owner . II. CONSIDERATIONS A petition has been filed by Oakridge Development, that requests a M-1 special use for temporary mining. The subject property is located north of U.S. Route 20 and east of E.J. and E. Railroad . The applicant proposes to develop the 35.321 acre parcel into an industrial subdivision to be known as the Oakridge Industrial Park. As part of the site preparation phase of the development, the applicant desires to mine gravel for on-site road construction, as well as for sale. III. FINDINGS After due notice, as required by law, the Land Use Committee held a public hearing on the proposed special use on August 3, 1987. The petitioner testified at the public hearing and presented documentary evidence. Objectors appeared at the hearing but no written objection has been filed to the proposed special use. The Land Use Committee has made the following findings with respect to Petition 51-87: A. Site Characteristics : The subject property is an irregularly shaped parcel containing approximately 35. 321 acres. Elevations range from 774 feet to 802 feet for a maximum relief of 28 feet. The property is not developed. B. Sewer and Water: The developer proposes to provide onsite stormwater detention on the northerly 250 feet of the subject property . A temporary stormwater detention basin is proposed to be located on Lot 9 and a portion of Lot -Page 1- Exhibit A 11 . No construction is to be permitted on the temporary stormwater detention basin until the permanent stormwater control facilities are completed . fl The subject property may be serviced through a 12 inch sanitary sewer located on the west side of the E.J. & E. railroad . The existing sanitary sewer line was designed and intended to serve the subject property. The subject property may be serviced through a 12 inch watermain which now services the property located on the west side of the E.J. & E. railroad, or the property may be serviced directly from the 16 inch Elgin-Bartlett watermain. There are no capacity limitations with respect to providing water service to the property. Source: City of Elgin, Engineering Division. C. Traffic and Parking: The Route 20 Bypass serves as a major arterial street serving the south and west sides of the city. Route 20 has a design capacity of approximately 30,000 vehicles per day. Currently Route 20 carries approximately 23,000 vehicles per day. Assuming that an average of 45,000 square feet of building area will be constructed for every two acres of land, a total of 487, 241 square feet of gross floor area could be developed on the subject property. With 90 percent of the gross floor area developed with industrial use and 10 percent developed with office use, approximately 3,932 vehicle trips per day could be generated from the proposed development onto U.S. Route 20. Office uses generate approximately 17. 7 vehicle trips per day per 1 ,000 square feet of gross floor area. Industrial uses generate approximately 7 vehicle trips per day per 1 , 000 square feet of gross floor area . Off-street parking requirements for individual buildings will be determined during the plan review process , prior to the issuance of a building permit. Office uses require 1 parking space per 250 square feet of gross floor area. Industrial uses require 1 parking space per 1 ,000 square feet of gross floor area. Zoning History: The subject property was annexed and zoned M-1 and R-4 in 1966. E. Zoning Status: The existing and proposed lots are in conformance with the M-1 district design standards. The R-4 portion is to be developed with a stormwater detention facility and will remain as permanent open space. F. Surrounding Land and Zoning: The area located to the north of the subject property is zoned Cook County R-4 Single Family Residence District . The area is developed with single family residences . The area located to the east of the subject property is zoned Cook County R-4 Single Family Residence District . The area is the site of a former training ground for race horses. The area located to the south of the subject property is zoned M-1 . The area is developed with a cartage and express facility. The area located to the west of the subject property is zoned M-1 . The area is largely undeveloped , except for the Safety Kleen recycling center. The E.J. & E. railroad right of way is located to the immediate west of the subject property. fG. Trend of Development : The subject property is located along U.S. Route 20 on the city ' s southeast side. The property fronting on Route 20 is developing with a variety of commercial , industrial and recreational activities . H. Comprehensive Plan: 1 . Economic Growth and Development - The economic growth and development component of the comprehensive plan contains the following objectives and policies: a. Facilitate the retention and expansion of existing commerce and industry by providing suitable industrial sites for businesses and industries seeking to relocate. b. Attract new firms and economic activity to Elgin by assuring the availability of office-research and light manufacturing property . 2 . Land Use - The subject property is designated "urban residential" on the Land Use Plan. This designation contemplates residential development ranging from urban density single family residences to apartments. '' The land use component of the Comprehensive Plan encourages compact and contiguous growth, and the -Page 3- . . r. logical extension of utilities. I . Special Use Standards : The proposed special use for temporary mining is in substantial conformance with the special use standards. J. Conditions for Approval : The Land Use Committee is of the opinion that approval of Petition 51-87 should be subject to the following conditions: 1 . Revisions to the Operation and Reclamation Plan prepared by John Hilliard , dated July 27, 1987 per the Planning Department . 2. Substantial conformance to the revised Operation and Reclamation Plan. 3. Compliance with all other applicable codes and ordinances. IV. RECOMMENDATION On a motion to recommend approval of Petition 51-87, subject to the conditions for approval, the vote was seven (7) yes and zero (0) no.
