G42-88 0 Ordinance No. G42-88 AN ORDINANCE RECLASSIFYING PROPERTY AT 975 VILLA STREET AND GRANTING A SPECIAL USE FOR AN AUTOMOBILE SERVICE STATION WHEREAS, written application has been made to reclassify certain property located at 975 Villa Street from R-2 Single Family Residence District to B-4 General Service District and for a special use for an automobile service station; and WHEREAS, after due notice in the manner provided by law the Land Use Committee conducted a public hearing concerning said application and has submitted its written findings and recommendation to the City Council; and WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings and recommendation of the Land Use Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section I. That Chapter 19.08, Section 19.08.020, entitled "Zoning District Map" of the Elgin Municipal Code, 1976, as amended, be and the same is hereby further amended by adding thereto the following paragraph: "The boundaries hereinbefore laid out in the 'Zoning District Map', as amended, be and are hereby altered by excluding from R-2 Single Family Residence District and including in the B-4 General Service District the following described property: That part of Lot 13 in Block I in Elgin Heights Addition to the City of Elgin, in Section 19, Township 41 North, Range 9 East of the Third Principal Meridian, in Cook County, Illinois, described as follows: Commencing at a point in the easterly line of Wright Avenue that is 424.0 feet northeasterly (measured along said easterly line) of the southwest corner of said Lot 13; thence southeasterly parallel with the southerly line of said lot, 158.6 feet for the point of beginning; thence southwesterly and parallel to the westerly line of Dickie Avenue, 24.38 feet; thence south- easterly along a line 399.9 feet northeasterly and parallel with the southerly line of Lot 13, 105.14 feet to the westerly line of Dickie Avenue; thence northeasterly along said westerly line, 24.38 feet; thence north- westerly parallel to the southerly line of Lot 13 to the point of beginning, in the City of Elgin, Cook County, Illinois." Section 2. That a special use for an automobile service station at 975 Villa Street, Elgin, Illinois, legally described as follows: "Parcel I: That part of Lot 13 in Block I in Elgin Heights Addition to the City of Elgin, in Section 19, Township 41 North Range 9 East of the Third Principal Meridian, in Cook County, Illinois, described as follows: Beginning at a point in the easterly line of Wright Avenue that is 424.0 feet northeasterly measured along said easterly line of the southwest corner of said Lot 13; thence southeasterly parallel with the southerly line of said lot, 158.6 feet; thence southwesterly and parallel to the westerly line of Dickie Avenue to a line that is 399.0 feet northeasterly of and parallel to the southerly line of said Lot 13; thence southeasterly along said parallel line 105.0 feet to the westerly line of Dickie Avenue; thence northeasterly along said westerly line 226.45 feet to the southerly line of Villa Street; thence northwesterly along said southerly line to the southeasterly line of Wright Avenue; thence southwesterly along said southeasterly line 202.10 feet to the point of beginning, in the City of Elgin, Cook County, Illinois. Parcel 2: That part of Lot 13 in Block I in Elgin Heights Addition to the City of Elgin, in Section 19, Township 41 North, Range 9 East of the Third Principal Meridian, in Cook County, Illinois, described as follows: Commencing at a point in the easterly line of Wright Avenue that is 424.0 feet northeasterly (measured along said easterly line) of the southwest corner of said Lot 13; thence southeasterly parallel with the southerly line of said lot, 158.6 feet for the point of beginning; thence southwesterly and parallel to the westerly line of Dickie Avenue, 24.38 feet; thence south- easterly along a line 399.9 feet northeasterly and parallel with the southerly line of Lot 13, 105.14 feet to the westerly line of Dickie Avenue; thence northeasterly along said westerly line, 24.38 feet; thence north- westerly parallel to the southerly line of Lot 13 to the point of beginning, in the City of Elgin, Cook County, Illinois." be and is hereby granted subject to the following conditions: I. Revisions to the site plan prepared by McLane and McLane Architects to include: a. Access is to be limited to one 36 foot entryway onto Villa Street and one 30 foot entryway onto Dickie Avenue; and b. Provide a 50 percent screen within the parking lot setback along Villa Street and a 100 percent screen within the parking lot setback along Dickie Avenue; and c. Provide a six foot solid fence, where permitted, along the southerly property line between Dickie Avenue and Wright Avenue. 2. Substantial conformance to the revised site plan. 3. Preserve all existing healthy vegetation not in conflict with approved development plans. 4. Compliance with all other applicable codes and ordinances. Section 3. That the special use granted herein shall expire if not established within one year from the date of passage of this ordinance. r Section 4.
