G84-86 Ordinance No. G84-86 AN ORDINANCE AMENDING CHAPTER 10.88 ENTITLED "DISCHARGE OF WEAPONS" OF THE ELGIN MUNICIPAL CODE, 1976, AS AMENDED BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section I. That Chapter 10.88 of the Elgin Municipal Code, 1976, as amended, be and is hereby repealed. Section 2. That Chapter 10.88 of the Elgin Municipal Code, 1976, as amended, be and is hereby added to read as follows: "DISCHARGE OF FIREARMS 10.88.010 Discharge of firearms It is unlawful for any person to fire or discharge any cannon, gun, pistol or other firearm in any part of the City; provided, that this para- graph shall not be construed to prohibit the discharge of blank cartridges by any military company while on parade and under a commanding officer, or the discharge of firearms by any city officer or other person in the dis- charge of a legal duty, when the same is done in such a manner so as not to endanger the safety of any person or injure any property; and further elk provided, that this section shall not be construed to apply to the discharge of blank cartridges for ceremonial purposes by any veterans, civic or religious group while under the direct supervision of the Police Department after having obtained and pursuant to a permit issued by the Chief of Police. 10.88.020 Permit--Application Applications for a permit for the discharge of blank cartridges for ceremonial purposes by any veterans, civic or religious group shall be filed with the Chief of Police upon a form to be provided by that office. Such applications shall set forth the name and address of the organization, the names and addresses of all persons who will participate in the ceremony, the date, time, location and nature of the ceremony, and the number of firearms to be discharged." Section 3. That all ordinances or parts of ordinances in conflict with the provi- sions of this ordinance be and are hereby repealed. Section 4. That this ordinance shall be in full force and effect from and after its passage and publication in the manner provided by law.
