AN ORDINANCE
AMENDING SECTION 9.28.130(B) OF THE ELGIN MUNICIPAL CODE
EMPOWERING THE CITY MANAGER TO AUTHORIZE LIMITED OPEN BURNING
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS:
Section I. That Section 9.28.130(B) of Chapter 9.28 of the Elgin Municipal Code,
1976, as amended, be and is hereby amended to read as follows:
B. The city manager may, however, authorize upon specific request,
controlled burning on a limited basis, for school, publicly regulated utilities
and governmental institutions, provided that the city manager finds that
such burning will pose no danger, or inconvenience to adjoining property
owners and will not be detrimental to the general public health and safety
of the community.
Section 2. That all ordinances or parts thereof in conflict with this ordinance be
and are hereby repealed.
Section 3. That this ordinance shall be in full force and effect from and after its
passage and publication in the manner provided by law.
