G25-86 Ordinance No. G25-86 AN ORDINANCE RECLASSIFYING PROPERTY AT 308 DUNDEE AVENUE FROM B-I COMMUNITY BUSINESS DISTRICT TO B-3 SERVICE BUSINESS DISTRICT WHEREAS, written application has been made to reclassify certain property located at 308 Dundee Avenue from B-I Community Business District to B-3 Service Business District; and WHEREAS, the Land Use Committee has conducted a public hearing after due notice and submitted its written findings and recommendations to the City Council; and WHEREAS, the City Council has reviewed the recommendations of the Land Use Committee and concurs in such recommendations. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section I. That Chapter 19.08, Section 19.08.020, entitled "Zoning District Map" of the Elgin Municipal Code, 1976, as amended, be and the same is hereby further amended by adding thereto the following paragraph: "The boundaries hereinbefore laid out in the 'Zoning District Map', as amended, be and are hereby altered by excluding from the B-I Community Business District and including in the B-3 Service Business District, the following described property: That part of Lot 2 in Block 4 of P. J. Kimball Jr. Third Addition to Elgin, described as follows: Commencing at the point of intersection of the North line of Franklin Street with the Westerly line of Dundee Road; thence North 89 degrees, 45 minutes West along the North line of said Franklin Street 108 feet 3 inches (this point hereinafter referred to as point "A"); thence South 89 degrees 45 minutes East along said North line 108 feet 3 inches to the Westerly line of said Dundee Road; thence North- easterly along said Westerly line 83 feet for the point of beginning; thence North 78 degrees 45 minutes West 134 feet to a line drawn North 10 degrees 45 minutes East from point "A" aforesaid; thence North 10 degrees 45 minutes East to a line drawn parallel with and 120 feet South of the North line of said lot; thence East along said parallel line 40.9 feet to the West line extended South of a tract of land conveyed to Asa L. Heath by Deed dated July 14, 1866 and recorded September 4, 1867 in Book 103, Page 47; thence North along said extended West line 4.5 feet to the South- west corner of said Heath tract; thence South 78 degrees 45 minutes East along the Southerly line of said Heath tract 110.9 feet to the Westerly line of said Dundee Road; thence Southwesterly along said Westerly line 63 feet to the point of beginning, in the City of Elgin, Kane County, Illinois." Section 2. That this ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law and shall be published in pamphlet form by authority of the City Council. s/ Richard L.
