G13-86 19"4 Ordinance No. G13-86 AN ORDINANCE AMENDING CHAPTER 6.06 OF THE ELGIN MUNICIPAL CODE TO PROVIDE FOR THE IMPOSITION OF FINES BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Section 6.06.120 of the Elgin Municipal Code, 1976, as amended, be and is further amended to read as follows: "6.06.120 License—Revocation--Suspension--Fines A. The local liquor control commission may revoke or suspend any license or permit issued pursuant to this chapter for cause. In lieu of suspension or revocation, the local liquor control commission may impose a fine on the licensee provided such fine shall not exceed $1,000 for each violation; each day on which a violation continues or occurs shall constitute a separate violation. Provided further, not more than $10,000 in fines under this chapter may be imposed against any licensee during the period of his license. B. No license or permit shall be suspended or revoked and no fine shall be imposed except after written notice to the licensee and a hearing before the liquor control commission in the manner provided by law. C. Cause for the imposition of a fine or suspension or revocation of a license to sell alcoholic liquor shall include but is not limited to the following: I. Violation of any provision of this chapter; 2. Indebtedness to the city for license fees required by any ordinance; 3. Violation of criminal laws of the state or of the ordinances of the city; 4. Misstatement or withholding of material information in an application for license or in a hearing before the local liquor control commission. D. For the purposes of this section, every licensee shall be deemed responsible for the unlawful acts of his agents or employees whether or not such licensee knowingly permits or has actual knowledge of such unlawful acts." Section 2. That all ordinances or parts thereof in conflict with this ordinance are hereby repealed. r rSection 3.
